HomeMy Public PortalAbout20231129104448812A special meeting of the Common Council was called to order at 4:00 p.m. Aldermen present were Edward Bohne, Richard Johns, Art Larson, William Hack, Thomas Lawrence, Julius Petta, Claribel Prosser and Clifford Bourcier. The purpose of this meeting was to grant a Class BB liquor license to Joe Hough, and any other business before the Council at this time. A MOTION was made by Alderman Larson seconded by Alderman Johns to grant a Class BB liquor license to Joseph Hough for the premises at 324 Thayer Street (formerly Tremont Bar) On roll call vote all aye. Motion carried. A letter from the Fire Chief was read to the Council in regard to some repairs tht are required in the City Nall building to eliminate fire hazards, and steps to be taken to protect valuable records in the Assessor's office. There was a discussion on this -letter and the repairs and protection of records by Fire Chief Manning, the City Inspector, and the Council. The Mayor stated Dietz Construction bid $632.00 to repair the furnace room. A MOTION was made by Alderman Bohne seconded by Alderman Petta to refer to the Public Property Committee the possibility of relocating the Assessor somewhere in City Nall where a fire proof vault would be available to him. All aye. Motion carried. A MOTION was made by Alderman Lawrence seconded by Alderman Bourcier that the Public Property proceed with repairs in the City Fall at a cost not to exceed $1,000.00. On roll call vote all aye. Motion carried. A map was presented to the Council by Alderman Lawrence concerning a land trade between the City and the county for the Industrial Park site. The Council had previously agreed to this trade. Alderman Lawrence stated since the past Council approved of the trade it was found that one more small parcel of land was involved in the trade and that was why he requested Council approval again including the additional parcel. A MOTION was be authorized to carried. aµ by Alderman Johns seconded by Alderman Petta that the Clerk the deeds for the land trade. On. roll call all aye. Motion Alderman Bourcier, Chairman of the Protection of Person and Property Committee stated the committee recommended the purchase of a used automobile for the Police Department .from Oneida Motor Sales for the price of $975.00. A MOTION was made by Alderman Bohne seconded by Alderman. Prosser to accept the committee recommendation of the Protection of Person and. Property Committee and purchase the vehicle from Oneida Motor Sales for 5975.00. On roll call vote all aye. Motion carried. Mayor Taylor brought up a proposal from. the Murphy Oil Company who wishes to locate a tank farm here in the city. There was a lengthy discussion on this matter with the Council and City Officials. The results being as follows: A MOTION by Alderman Lawrence seconded by Alderman Johns that City officials work with and encourage the Murphy Oil Company to locate here in Rhinelander. All aye. Motion, carried. A MOTION was made by Alderman Bourci^r seconded by Alderman Bohne to adjourn. INTENT AND PURPOSE OF ORDINANCE: DUTCH ELM DIS-I_?SE AND ELM BARK BEE LES DECLARtii) PUBLIC _'IUISANCES.Wherees the Common Council has deter mined that there are many elm trees growing on the public and private premises withinthe City of Rhinelander, the loss of which would substantially depreciate thevalue of public and private property, impair the use and enjoyment of the public and private premises and erode the tax base of the city and that the health and theT life of such trees is threatened by fatal disease, known as the Dutch elm disease, which is spread by the elm bark be ales SCOLYTUS multistriatus (Eichb.) or HYLURGOPINuS rufipes (Marsh.) the 0ouncil hereby declares its intention to control and prevent the spread of such disease and the insect pests and vectors which carry suchdisease and declares Dutch elm disease and elm bark beetles which carry- such disease to be a public nuisance. SECTION 1. PARKS AND RECREATION COMMITTEE TC ENFORCE ORDINANCE. The Parks and Recreation Comiittee shall carry out the provisions of this ordinance. It may employ a forester or designate a municipal employee to perform the duties of 'a forester rider ch. 27 of the Wisconsin Statutes and may authorize such forester to perform the duties and exercise thepowers nposed on the beard by this ordinance. SECTION 2. DEFINITIONS. As used in this ordinance clearly indicated by the context: a. "Public nuisance" means (1) Dutch elm discs vise (2) Elm bark be_t1es Scolytus Multistriatus (Eichb.) or HHylurropinus rufipes (Marsh.) (3) Any living or standing elm tree or part thereof infected with the Dutch elm disease fungus or in a weakened condition whichh:rbors any of the elm bark beetles, Scolytus multistratus (Eichb.) or Hylur;7opinus rufipes (Marsh.) (' ) Any dead elm tree or part thereof, including logs, branches, stumps, firewood or other elm material from which the bark has not been removed and burned or sprayed with an effective elm bark beetle destroyi concentr ate. A letter from the Wisconsin, Michigan Coaches Inc. requesting support of the council to continue their Interstate Transportation Authority in regard to their replacing the railroad transportation during the winter months was read to the Council. The result being as follows. A MOTION was made by Ald. Johns Seconded by Aid. Prosser to authorize the City Clerk to write a letter supporting Michigan Coaches request to continue their Interstate Authority . All aye Motion Carried. A MOTION Was made by Aid. Johns seconded by Aid. Bourcier to tabel a resolution submitted by the Bureau of Fish Management requesting the Citys support in bonding and Federal Grants program ( OARP ). All aye motion carried. OLD BUSINESS ORDINANCE 2-69 AN ORDINANCE TO CONTROL AND PREVENT THE SPREAD OF DUTCH ELM DISEASE AND PROVIDE FOR THE PROTECTION OF ELM TREES WITHIN THE CITY OF RHINELANDER, WISCONSIN. The Common Council of the city of Rhinelander do ordain as fo 0 S: SECTION 1. INTENT AND PT'RPOSE OF ORDINANCE: DUTCH ELM DISEASE AND BA -K BEETLES DECLARE.) PUBLIC NUISANCES. Whereas the common council has determined that there are many elm trees growing cn public and private premises within the city of Rhinelander, the loss of which would substantially depreciate the value of public and private property, impair the use and enjoyment of public and private premises and erode the tax base of the city and that the health and life of such trees is threatened by a fatal disease 1-nown as Dutch elm disease, which is spread by the elm bark beetles Scolytus multistriatus or Hylurgopinus rufi°:yes (Marsh.), the council hereby declares its intention to control and prevent the spread of such disease and the insect pests and vectors which carry such disease and declares Dutch elm disease and the elm bark beetles which carry such disease to be public nuisances. SECTION 1. PARKS & RECREATION COM=TTEE TO ENFORCE ORDINANCE.. The Parks and Recreation Committee shall carry out the provisions of this ordinance. It may employ a forester or designate a municipal employe to perform the duties of forester under ch. 27 of the Wisconsin statutes and may authorize such forester to perform the duties and excercise the powers imposed on the board by this ordinance. SECTION 2. DEFINITIONS. As used in this ordinance, unless otherwise clearly indicated by the context: a. "Public nuisance" means (1) Dutch elm disease. (2) Elm bark beetles Scolytus mult.striatus (Eichb.) or Hylurgopinus rufipes Marsh. (3) Any living or standing elm tree or part thereof infec with the Dutch elm disease fungus or in a weakened condition which harbors any of the elm bark beetles, Scolytus multistriatus (Eichb.) or Hylurgopinus rufipes (harsh.). (i) Any dead elm tree or part thereof, including logs, branches, stumps, firewood or other elm material from which the bark has not been removed and burned or sprayed with an effective elm bark beetle destroying concentrate.
