Mayor Merritt called the regular meeting of the City Council to order at 7:45 p.m. 2. The invocation was given by the Reverend Kenneth Grant, Westminster Presbyterian Church, 9642 E. Live Oak, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Gilbertson, Harker, Tyrell, Merritt ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Civil Engineering Assistant Linares, Traffic Engineer Envall. 5. APPROVAL OF MINUTES: Councilman Gilbertson moved to approve the minutes of the regular meeting of January 5, 1971, as printed. The motion was seconded by Councilman Harker and unanimously carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING (cont.) 7:30 p.m. Re. Consideration of General Plan. City Manager Koski advised that the matter of consideration of the General Plan was carried over from the previous meeting, with the public hearing still open, and that pursuant to the Council's direction, a resolution had been prepared for Council action pending final outcome of the deliberations. Mayor Merritt invited those present who wished to speak for or against the plan to come forward. Mrs. Char&es Morris, 9616 E. Longden, advised that her 1/2 acre lot was presently R -2, and inquired as to the future use of this property under the general plan. She was advised by Planning Director Dragicevich, that the plan indicated this area for low medium density, or between 7 and 15 dwelling units per acre, however that the plan is general in nature and does not in itself change the zoning. No one else came forward to speak. Councilman Briggs moved to close the Public Hearing, seconded by Councilman Gilbertson and unanimously carried. City Attorney Martin presented Resolution No. 71 -1070 entitled A. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING THE PROPOSED GENERAL PLAN, Councilman Harker moved to adopt, seconded by Councilman Gilbertson and unanimously carried. 7. ORDINANCE NO. 71 -317: 1st read. Re. Amendment to Temple City Municipal Code Relating. to Non - conforming Setbacks in R Zones. City Attorney Martin presented Ordinance No. 71 -317 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 9278.1 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO NON - CONFORMING STRUCTURES, for first reading by title only. Councilman Gilbertson moved to waive further reading, seconded by Councilman Harker and Unanimously carried. City Council Minutes, January 19, 1971 - Page 2 NEW BUSINESS: 8. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of January 6, 1971 A. ROSEMEAD BOULEVARD AT LONGDEN - Minor Signal Modification. Traffic Engineer Envall advised that the Traffic Commission recommended authorization to request the State Division of Highways to modify the present R53 -R sign (Left Turn on Left Arrow Only) to an R53 -UR (Left or U Turn on Left Arrow) for north and southbound traffic on Rosemead Boulevard 'xecuting a left turn onto Longden Avenue, with the State Division of Highways to assume the costs. Councilman Gilbertson moved to approve, seconded by Councilman Briggs and unanimously carried. B. GLICKMAN AVENUE, SOUTH OF BOGUE - additional Regulations. Traffic Engineer Envall advised that the Traffic Commission recommended restricting the new section of berm on the east side of Glickman, south of Bogue., with 60 feet of red curb marking, and placement of two sight posts on the east side of Glickman, to eliminate parking at this roadway constriction, and to alert northbound traffic. Councilman Gilbertson moved to approve, seconded by Councilman Harker and unanimously carried. C. LONGDEN AVENUE AT MUSCATEL - County Proposal for Signa.lization. Traffic Engineer Envall advised that the Traffic Commission recommended consideration of the intersection of Longden Avenue at Muscatel for signalization to provide for more orderly movement of traffic through the intersection. He advised that one warrant, the interruption of continuous traffic, was met, that three accidents had occurred within a three -year period, however the pedestrian warrant was lacking. Estimated cost for installation is $23,000, which would be jointly undertaken with the County of Los Angeles. A suggested alternative was the placement of a pre -timed signal with sub- stantial saving in overall cost. Council discussed the priorities that should be considered in relation to other intersections, such as Longden at Golden West, as well as the expense that would be incurred by the County at taxpayers expense in undertaking this project. Councilman Briggs moved to refer the matter to the 1971 -72 budget considerations. along with the priorities that may be established for the intersection of Longden at Golden West and /or other intersections. Councilman Gilbertson seconded the motion which carried unanimously. 9. LOWER AZUSA ROAD: ALESSANDRO TO EL MONTE AVENUE - Resolution No. 71 -1071 Requesting State Allocation of Federal Aid - Secondary Urban Extension Funds, for Improvement of Lower Azusa Road. City Manager Koski advised that the County Road Department had again prepared a report to include Lower Azusa Road as a Federal Aid- Secondary Urban Extension project for transmittal to the State Division of Highways which had been denied last year. All projects to be considered for eligibility in 1972 -73 must be submitted for approval by March 1, 1971. He advised that the improvement of the project under the program would lower the cost to Temple City in the amount of $379,000, Councilman Tyrell moved to adopt Resolution No. 71 -1071 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, J0INING THE COUNTY OF LOS ANGELES AND CITY OF EL MONTE IN REQUESTING A STATE AL-LOCA TION OF FEDERAL -AID SECONDARY URBAN EXTENSION FUNDS FOR THE IMPROVEMENT OF LOWER AZUSA ROAD BETWEEN ALESSANDRO AND EL MONTE ROAD, seconded by Councilman Briggs, and unanimously carried. NOTICE OF COMPLETION - STREET IMPROVEMENTS (Curb, gutter and driveway approaches pursuant to Chapter 27 of Streets and Highways Code) (Sully Miller Contractors). A. KAUFFMAN AVENUE, east and west sides, Garibaldi to Longden. B. GARIBALDI AVENUE, north side, Temple City Blvd. to Camellia. C. GARIBALDI AVENUE, north side, Kauffman Ave. to Golden West. City Manager Koski presented a letter from Krelle & Lewis, Engineers of Work, recommending acceptance of completed work on the projects, above listed. Councilman Briggs moved to accept the work of Sully Miller Contracting Company under agreement dated October 16, 1970, and Purchase Order No. 137, as recommended by Krelle & Lewis, Engineers, to authorize filing of Notice of Completion, and retention of 10% ($2,070) for 35 -day lien period. The motion was seconded by Councilman Harker and unanimously carried. 11. SET PUBLIC HEARINGS - ASSESSMENTS (Curb, gutter and driveway approaches pursuant to Chapter 27 of Streets and Highways Code) A. KAUFFMAN AVENUE, east side, Garibaldi to Longden. 8. KAUFFMAN AVENUE, west side, Garibaldi to Longden. C. GARIBALDI AVENUE, north side, Temple City Blvd. to Camellia. D. GARIBALDI AVENUE, north side, Kauffman Ave. to Golden West. Councilman Tyrell moved to set Public Hearing for assessments, Kauffman Avenue, east and west sides, Garibaldi to Longden; and Garibaldi Avenue, north side, Temple City Boulevard to Camellia, and Garibaldi Avenue, north side, Kauffman Avenue to Golden West, for Tuesday, February 2, 1971, at 7:30 p.m. in the Council Chambers of the City Hall. The motion was seconded by Councilman Gilbertson and unanimously carried. 12. AGREEMENT: 1970 STORM DRAIN BOND ISSUE - LOS ANGELES COUNTY FLOOD CONTROL DISTRICT ENGINEERING AGREEMENT WITH CITY OF TEMPLE CITY. City Manager Koski advised that pursuant to approval of Propos- ition A at the General Election held on Tuesday, November 3, 1970, which authorized a $252 million bond issue to finance storm drain improvements within the County, that an agreement was now in order to delineate the responsibilities of the Flood Control District and the City in accomplishing the work. He advised that the primary function of the City would be to provide the design of the structures, preparation of plans, and provide supporting data for inclusion in the specifications; that the District would reimburse the City from bond funds for costs incurred for accomplishing the design work. He then presented an agreement submitted by the Los Angeles County Flood Control District, by and between that agency and the City of Temple City, for the preparation of design on the 1970 Storm Drain Projects 8050, 9606 and 9607. Councilman Gilbertson moved to approve the agreement as outlined by the City Manager and described by memorandum dated January 15, 1971, and to authorize the Mayor and City Clerk to sign, seconded by Councilman Harker and unanimously carried. 13. AGREEMENT: STORM DRAIN DESIGN - KRELLE & LEWIS, ENGINEERS, AND CITY OF TEMPLE CITY. Re, Preparation of construction plans and specifications as contained in County Flood Control District and City of Temple City Agreement. City Manager Koski advised that 18 inquiries and proposals had been received by the City requesting consideration for providing engineering services related to design and construction of storm drain projects included in the 1970 Storm Drain Bond Issue report. Council Minutes, January 19, 1971 - Page 4 He advised that in order to establish an appropriate adminis- trative policy for evaluating the proposals and selecting the engineering firm for recommendation, the manual entitled "Con- sulting Engineering: A Guide for the Engagement of Engineering Services" prepared by the American Society of Civil Engineers, was used as a general procedural guide for determination. Based on the criteria established, and personal knowledge of engineering capabilities of Krelle and Lewis, Inc., who had provided similar engineering services to the City under the 1964 Storm Drain Bond Issue, this firm was recommended for primary consideration for accomplishing engineering services necessary to complete the work in accordance with basic fee schedule contained in the agreement with the Los Angeles County Flood Control District, less 5% to be retained by the City for administrative costs. Following Council discussion, it was moved by Councilman Tyrell, seconded by Councilman Briggs and unanimously carried, to approve the agreement by and between Krelle & Lewis, Inc., and the City of Temple City, for engineering services to include the design, preparation of plans and supporting data for construction of 1970 Storm Drain Projects 9607 and 8050, and to authorize the Mayor and City Clerk to sign. The motion was seconded by Councilman Briggs and unanimously carried. Following the award of contract for engineering services for Projects 9607 and 8050 of 1970 Storm Drain Bond Issue, to Krelle & Lewis, Inc., Council discussed consideration of authorizing the Los Angeles County Road Department to perform engineering ser- vices for Project 9606, also in accordance with Agreement by and between the County Flood Control District and City of Temple City. Councilman Gilbertson moved to authorize the Los Angeles County Road Department to serve as Engineers for Project 9606 of the 1970 Storm Drain Bond Issue, seconded by Councilman Harker and unanimously carried. 14. RESOLUTION No. 71 -1072: Authorizing members of City Council to file statement re. adoption of City Charter. Councilman Tyrell moved to adopt Resolution No. 71 -1072 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE A WRITTEN ARGUMENT FOR A CITY MEASURE, Councilman Harker seconded the motion and it carried unanimously. 15. RESOLUTION No. 71 -1073: Re. Canvass of Special Municipal Election to be held on Tuesday, March 9, 1971, to be made by City Clerk. Councilman Tyrell moved to adopt Resolution No. 71 -1073 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING THE CANVASS OF THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 9th DAY OF MARCH, 1971, TO BE MADE BY THE CITY CLERK OF THE CITY OF TEMPLE CITY, Councilman Harker seconded the motion and it carried unanimously. 16. RESOLUTION No. 71 -1074: WARRANTS & DEMANDS; Demand Nos. 3414 thru 3479, in the amount of $131,390.34. Councilman Harker moved to adopt Resolution No. 71 -1074 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $131,390.34, DEMAND NOS. 3414 THRU 3479, seconded by Councilman Gilbertson and unanimously carried. 17. COMMUNICATIONS: A. Resolutions and ordinances received from other cities, as listed in memorandum dated January 15, 1971, were received and filed. B. City Manager Koski presented the Quarterly Report (October 1970 - January 1971) from the Chamber of Commerce. City Manager Koski presented a request from Camellia Lions Club to park "Horseless Carriage" in front of Temple City Park during days of Camellia Festival, and to conduct fund- raising activities in conformance with City and Festival Committee regulations. Councilman Briggs moved to approve seconded by Councilman Harker and unanimously carried. 18. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: John Ballard, 9611, E. Blackley, Temple City, inquired if ordinance re. signs for phosphate content in detergents was in effect. He was advised that it was now in effect and being enforced. He was also advised that a two hour extension of time had been granted to Standard Oil, daily, for core hole drilling purposes, and that Temple City was not in the Federal Flood Insurance program. 19. MATTERS FROM CITY OFFICIALS: A. Authorization of Expenses for Special Municipal Election. Councilman Tyrell moved to authorize expenditure of funds in the amount of $7,990 for special municipal election to be held on Tuesday, March 9, 1971, to appropriate. the additional funds from the General Fund and to amend the Adopted Budget accordingly. Councilman Gilbertson seconded the motion and it carried unanimously. B. California Contract Cities - Legislative Conference - Jan uary 20 -21, 1971. Councilman Briggs moved to authorize the attendance of Mayor Merritt, Mayor Pro Tem Gilbertson and City Manager Koski at California Contract Cities Legislative Conference to be held in Sacramento, January 20 -21, 1971, seconded by Councilman Tyrell and unanimously carried. C. Authorization to attend City Manager's Conference - San Jose - February 24 -26, 1971. City Manager Koski presented a request to attend the Spring Meeting of the City Manager's Department, League of California Cities, to be held in San Jose, February 24 -26, 1971. Councilman Harker moved to approve and to authorize the necessary expenditures, seconded by Councilman Gilbertson and unanimously carried. D. City Manager Koski advised that the Planning Commission was meeting jointly with the Parks and Recreation Commission this evening to discuss recreation elements in Planning. E. City Manager Koski advised that the Planning Commission was reviewing the matter relating to billboards with the City Attorney immediately following the Council meeting. F. Proposal for Commercial Development Services - Kirchner, Moore and Company. City Manager Koski advised that the firm of Kirchner, Moore and Company had presented a proposal offering their services as financial consultants and outlining a program by which they would provide a feasibility study for commercial development. G. Councilman Tyrell advised that the matter of banning throw away newspaper and other advertising matter had recently been upheld in Thousand Oaks, and suggested that an ordinance be drawn up to prohibit distribution of advertising matter in the City. City Attorney Martin was instructed to draft an ordinance for consideration by the Council at their next regular meeting. Council Minutes, January 19, 1971 - Page 6 H. PARKING COMMISSION RECOMMENDATIONS - Meeting of Jan. 19, 1971. City Manager Koski presented a request from the Merchant's Association to place children's pet zoo, kiddie ride and astro- bounce in Lot 5, from January 25 through January 31, 1971, and Lot 83 from Feb- r.u.ary 1 through February 7, 1971, as outlined in recommendation from Parking Commission dated January 19, 1971. Councilman Briggs moved to approve as requested, subject to insurance requirements, seconded by Mayor Merritt and unanimously carried. Councilman Gilbertson expressed appreciation to the City staff for assistance in compiling information and presentation of materials needed in connection with opposing adoption of a report by the Los Angeles County Division, League of California Cities, recommending regional government. J. Councilman Gilbertson reported that he will speak to the Temple City Coordinating Council on Monday, January 25, 1971, making a presentation re. the proposed Charter for the City. K. Councilman Tyrell suggested that the members of the Council review the list of "Recent Cases Relating to Municipal Law - October 1, 1969 to November 1, 1970" prepared by the City Attorney, and select those subjects which are felt to be most in need of corrective legislation, following which it would be appropriate for the City Attorney to prepare these items for consideration by the Legislature. L. Development of Business District - Proposed Overlay Zone. Councilman Gilbertson advised that an effort should be made immediately to. secure __vacant ..properties in the downtown business area which may be developed in a manner which would not generally benefit the City. Councilman Tyrell considered that the purchase of property by the City was inappropriate and would be beyond the capacity of the budget, and suggested that action be taken relative to providing an overlay zone, which would prohibit development in the downtown business district, except as approved by the City Council. On motion of Councilman Tyrell, seconded by Councilman Gilbertson and unanimously carried, the matter was referred to the Planning staff for consideration as to possible new commercial zone in downtown business district, and what it would contain, and consult with the Chamber of Commerce and Planning Commission and to report back to the Council at their next meeting as to feasibility of preparation of an interim ordinance, to hold the business area until a permanent ordinance can be adopted. 20. ADJOURNMENT: Councilman Harker moved to adjourn to a study session, seconded by Councilman Gilbertson and unanimously carried, and the meeting was adjourned at 8:55 p.m. The next regular meeting of the City Council will be held on Tuesday, February 2, 1971, at 7:30 p.m. in the Council Chambers of the City Hall.
