JAMES DOHERTY POLLED 48 JULIUS 1 TTA EVAN S,C.HALLOCK 44 34 James Doherty and Julius Petta having received the largest number of votes cast, are hereby declared eligible to participate in the April. 5th election. Their names are to, be placed on the ballot, with the one receiving the highest number of votes to be declared, ALDERMAN —SUPERVISOR of the 6th Ward, By COMMON CO UNCIL : Irvin Clark dward Boh,jie Vernon Grant John Macon The regular monthly meeting of the Common Council was called to order by Mayor Mikulici. All aldermen were present: Bohne, Church, Cla rk, Grant, Johns, Joslin, Lawrence, Leith, Lovestead, Macon & Wiegand. A MOTION WAS MADE by Ald. Bohne and seconded by Aid. Jo:slin to dis- pense with the reading of last month's regular meeting minutes and accept them as published. Carried unanimously. COI MUNICATIONS: A letter from the League o Wisconsin Municipalities regarding Rec- reation and Inspectors meetings to be held in March and April was read to the council, A letter regarding the new position of Maintenance Superintendent was read to the council. The letter,: written by Mr. Richard C. Erickson a representative of Local No. J226, questioned the procedure used in fil- ling this position, by the city. A. lengthy discussion followed with Mr. Erickson,4 Mayor Mikuiich, Director Woodward, City Attorney Krueger and members of the council taking part. At the conclusion -of the discussion, A- MOTION WAS MADE by Ald. Church and seconded by Aid. Wiegand to deny the grievance and support the recommendation of the Wage & Salary Committee to submit this afrgq Qnt to arbitration. Cn roll call, carried unanimously. Mr. Erickson stated that Mr. Robert Oberbeck would represent the union on the arbitration board. A1d. con. chairman of the age & Salary Committee recommended that City Attorney Arueger represent the city on the arbitration board. Atty Krueger stated that he would serve as an unbiased member and would not support the city in the matter if the city was in error in the hiring. A MOTION WAS MADE by Ald. Bohne and seconded by Ald. Clark to submit the grievance to arbitration to see if the hiring was proper or if the union contract had been circumvented, with City Attorney Krueger representing the city. ON ROLL call, carried withA3d. Johns voting No. OLD BUSINESS This evening was slated for a public hearing for Sewer & Water inst-- alation on Highview Parkway from the present end of the system to Lots 1 & 2 of Block F. Highland View Addition. The engineer's report on this project was read with C.R. Musson, Wilbur Pecore, and James Tallier pre- sent for the hearing. Mr. Musson volunteered to furnish the la bor for this project at no cost to the city if the property owners would share the cost of the materials.. A MOTION WAS MADE by Aid. Grant and seconded by A1d Johns that Mr. Musson proceed with this project by furnishing the labor and the property owners sharing the cost of the materials. The Water Super- intendent is tb supervise the project. On rolls call, carried with Aid. Church, Lovestead and Macon opposing. Mr. Keith Heise appeared relative to sewer installation on Crescent St. A, MOTION WAS MADE by Aid. Bohne and seconded by ..old. Lawrence to. notify Mr. Heise and other interested parties of the next Water Utility meeting so that they may be in attendance. Carried unanimously. Ald. Wiegand brought up the matter of the separation of the storm sewers from the sanitary sewers. A MOTION WAS made by Ald. Wiegand and seconded by Ald. Clark that the Water. Utility be authorized contact con- sulting engineering firms relative to this matter and also to see about obtaining federal aid to help with the project. Carried unanimously. ANX 1-66 annexation of a portion of Pine Lake) This evening was slated for a public hearing and final action on this annexation. A letter was read from Attorney Albert J. Cirilii as attor- ney for the petitioning residents of the Town of Pine Lake favoring the annexation. The letter outlined reasons for the annexation. Mr. Donald Rolain, Clarence Hartmann of the Chamber of Commerce and Ald. Macon fav- ored the annexation. City Inspector Treu and Clarence Pecore opposed the annexation and outlined their reasons. F. Pecore wished to have his name removed from the petition, but was advised that his name would remain as it could not be removed once it was filed with the city clerk. Water Superintendent Kratcha stated that the cost of installing sewer & water on the highway would be roughly $92,000. At the conclusion of this dis— cussion,. A MOTION WAS MADE by Ald. Johns and seconded by Ald. Macon to adopt the annexation ordinance. On roll call,. 6 to five against. Ald. Bohner Church, Clark, Grant, & Wiegand voting against. The motion was lost as a 2/3 vote is required to adopt an ordinance for annexation ANK 2-66 AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF RHINELANDER, WISCONSIN. The Common Council of the City of Rhinelander, "i.sconsin do ordain as follows: SECTION 1. Territory Annexed. In accordance with s. 66.021 of the Wisconsin Statutes of 1963, and the petition for direct annexation filed with the City Clerk on the llth day of February, 1966, signed by all of the owners of all of the real property in assessed value in the ter- ritory described as follows in the Town of Pelican, Oneida County, Wis- consin, said territory is annexed to the City of Rhinelander, Wisconsin; SS, (cont.) Commencing at the northwest corner of Section 7, Township 36 North,, Range 9 East. Thence N89° -40'E, 1025.68 feet to the place of beginning; thence N89°-40 'E to the center of the Pelican River; thence, southeasterly along the center of the Pelican River to its intersection with the south right of way line of S.T. H. #17 which is located 100 feet south of the centerline of S.T.H. #17; thence, southwesterly along the south right of way line of S.T.H.. #17 to its intersection with the west line of Sectioh 7, T36N, R9E;. thence, RZ°-3©'W, 204.36 feet; thence northeasterly along the arc of a 4874.7 foot radius curve, a distance of 300.57 feet, the chord of said curve bearing N75° -381E, 300.46 feet; thence, N77°-24 =E, 263.4 feet to the P.C. of a curve with a radius of 1809.88 feet; thence along the arc of the 1809.88 foot radius curve, a distance of 373.79 ._ feet to the P.T. of said curve, the chord of said curve bearingN71°-29'E, 373.12 feet; thence, N57° 121E, 152.,4 feet; thence,. I4° -04 .!f, 68.3 feet; thence, N1T0-26 'W, 32,) feet to the place of beginning. SECTION 2. Effect of Annexation. From: and after the date of this ordinance the territory described in Section 1 shall be a past of the City of Rhinelander,for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Rhinelander. SECTION 3. TEMPORARY ZONING CLASSIFICATION. (a) Upon recommendation of the Plan Commission the territory annexed to the City of Rhinelander by This ordinance is temporarily designated to be part of the ,following district of the City of Rhinelander for zoning purposes and sub- ject to all provisions of Chapter 19 of the Municipal Code of the City of Rhinelander entitled °'Zoning Code' relating to such district classific ations and to zoning in the City: COMMERCIAL DISTRICT. (b) The plan Commission is directed to prepare an amendment to the zoning ordinance set- ting forth permanent classifications and regulations for the zoning of the annexed area and to submit its recommendations to the council not later than May 30, 1966. SECTION 4. Ward Designation. The territory described in Section I of this ordinance is hereby made a part of the 7th Ward of the City of Rhinelander, subject to the ordinances,rules and regulations of the City governing wards. SECTION 5. Severabili , If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or uncon- stitutional provision or application. SECTION 6, Effective Date. This ordinance shall take effect upon passage and publication as provided by law. A. MOTION TO ADOPT this ordinance was made by Ald. Lovestead and sec- onded by Ald. Grant. On roll call, carried unanimously ORDINANCE 2-66 AN ORDINANCE TO REPEAL AND RECREATE. SECTION 5.12(2)(d) of the Municipal Code of the City of Rhinelander providing for the destruction of municipal utility records. TI -E, COMMON COUNCIL OF THE CITY OF RHINELANDER DO ORDAIN AS FOLLOWS.: That all existing ordinances, code or portions thereof in conflict herewith are hereby repealed and more specifically Section 5.I2(2)(d) is repealed and recreated to read as follows: 5.12(2)(d) Other utility records in accordance with the "Regulations to Govern the Preservation of Records of Electric, Gas and Water Utilities,° 1961 issue published by the National Association of Railroad IA lities Com- missioners. A MOTION TO ADOPT this ordinance was made by Ald. Johns and seconded by -Ald. Grant. On roll call, carried unanimously. ORDINANCE 3.66 AN ORDINANCE TO CREATE AND CODIFY A. PART OF THE GENERAL ORDINANCES OF THE CITY OF RHINELANDER, WISCONSIN. WHEREAS, it is deemed expedient and necessary that a part of the general ordinances of the City of Rhinelander be created, codified and ar- ranged in appropriate chapter, sections and subsections; that omissions be supplied, -defects be amended and a new ordinance enacted and that the same be published in pamphlet form to make the whole thereof plain, concise, intelligible and convenient; and WHEREAS, on February 14, 1966, the Common Council authorized the preparation of a part of the code of general ordinances for the City; and OLD E NESS (cont.) WIEREAS, a copy of such code has been on file and open for public inspection in the office of the City Clerk for not less than 2 weeks, as required by Section 66.035 of the Wisconsin Statutes, and notice thereof was given by publication on February 22, 1966. NOW THEREFORE, THE COMMON COUNCIL OF Ti- GITY CF RHINELAND- D© 'RDA I N AS FOLLOWS; Section 12, That the portion or part of the code of ordinances in pamphlet form entitled "Chapter 19, Zoning Code and Official Map: Regulations" a copy of which is on file in the office of the City Clark for public insp— ection, shall be and is. hereby adopted as a general ordinance in and for the City of Rhinelander, Wisconsin, up to and including the l5th day of April, 1966., n Section 2, This, ordinance shall take effect the day after passage and publication as, provided by law. Section. ,3_„3.. That the portion or part of the code of ordinances adopted herewith shall be assigned proper section and subsection numbers when adapted into the code in January 1967. iNDue to the fact that a companion ordinance, 5-66A required the pub— lication of the zoning map, A MOTION WAS MADE by :old. Grant and seconded by Ald. Clark to amend this ordinance to read April, 1966. Carried unani— mously. A MOTION TO ADOPT this ordinance as amended was made by Al and seconded by Aid. Grant. Carried unanimously. Since Ordinance 5-66 would be replaced by Ordinance 5-66A, A al TION WAS MADE by Ald. Lawrence and seconded by Ald. Leith to table 5-66. Carried unanimously. A MOTION WAS MADE by Ald, Leith and seconded by .Ald. Lawrence to hold a. public hearing for final action on Ordinance 5-66A during the April meeting. Carried unanimously. NEi BUSINESS Mr. Arno Teschendorf, representing the Rhinelander Division, St., Regis Paper Co, appeared relative to the purchase, from the city, of 12 lots near the Wisconsin River, north of the Davenport St. bridge* A report from City Assessor Honrath placed a value of $8,000 on this property. A MOTION WAS MADE by Ald. Macon and seconded by Aid. Lawrence to offer this land to St. Regis for $8,000, with the understanding that the street portions are to be vacated. On roll call, carried unanimously. RESOLUTION BE IT RESOLVED BY THE COMMON COUNCIL. OF THE CITY OF RHINELAND ER WIS— N, e stead. THAT WHEREAS, pursuant to the petition of the City of Rhinelander for installation of signals at the Phillip Street grade crossing of the Chicago and North Western. Railway Company tracks west of the Wisconsin River, the Public Service Commission of Wisconsin on February 15, 1966 ordered the Chicago and North Western Railway Company to install and maintain at said crossing two autocratic signals not later than one, year from the date of said order and ordered further that in the interim prior to the completion of the signal installation the City of Rhinelander shall at its own ex— pense install and maintain two arterial stop signs at the main line cros— sing which shall be removed when the installation of the automatic signals is completed. NOW THEREFORE BE IT RESOLVED BY THE COI 20N COUNCIL OF THE GITY OF RI-IINELANDER, WISCONSIN, that two arterial stop signs be installed at the main line crossing of the Chicago & North Western Railway Company tracks with Phillip Street in the City of Rhinelander requiring traffic in both directions to stop before crossing said tracks, and BE IT FURTHER RESOLVED that said arterial stop signs be removed when the installation of the automatic signals by the Chicago and North Western Railway Company` is properly completed. A. MOTION TO ADOPT this resolution was made by Aid. Bohne and seconded by Ald. Joslin. On roll call, carried unanimously. A. resolutioh providing for the vacation of all lands lying within Block 34, Assessors Replat of the second addition as platted or deeded to the city for alley purposes, excepting the 20 foot wide alley running from Oneida Avenue to Baird Avenue and adjacent to and north of the C & NU Railway right of way line,, was presented to the council. A MOTION WAS MADE by Aid. Johns and seconded by Ald. Leith to hold a public hearing for final action on this resolution at the May meeting. Carried unanimously. ORDINANCE 6-66 providing that all city employees, including department heads, reside in the city was presented to the council. A MOTION WAS MADE by Ald. Macon and seconded by Ald. Grant to hold a public hearing for final action on this ordinance at the 51 meeting. Carried unanimously. COMIISS, ION & BOARD REPORTS PUBLIC Recommended the purchase of a Caterpillar Loader from Brebner Machinery at a cost of $15,936 with the agreement that $8,000 will be paid this year from. Account #6461 and the balance due to be paid in Jan- uary 1967. A MOTION FOR THIS PURCHASE under the listed terms was made by Add. Bohne and seconded by Aid. Grant. On roll call, carried unanimously. PLANNING Recommended the "purchase of property, owned by J.E. Crofoot, to extend Hemlock St. to Rib St. at a cost of $1,500. A MOTION WAS MADE by Ald. Leith and seconded by Ald. Maconto make this purchase. On roll call carried unanimously. 1ORKS WATER. Recommended a reduction from $4,200 to $2100 in the water 8t sewer assessment at the new nursing home on Boyce Dr. as the owners are to install a sewage ejector or lift station, whichever is needed. A MOTION IN FAVOR of the reduction was made by Add. Wiegand and seconded by A1d. Clark. On roll call, carried unanimously. COMMITTEE_ REPORTS PROTECTION OF PERSONS & PROPERTY Recommended approval of the application. by Norman Johnson for a Class "BB* Fermented Malt Beverage & Intoxicating Liquor license upon the surrender} of the license now held b.y Mrs. Mabel Hansen at 127 W. Rives. A MOTION TO ADOPT THIS recommendation was made by Add. Bohne and seconded by Ald. Lawrence. On roll call, carried unanimously, Recommended approval of the applications for Operators Licenses made by Norman Johnson and William Kussman. A MOTION TO ADOPT this recoa mendation was made by Ald. Clark and seconded by A1d. Lovestead. On roll call, carried unanimously. Recommended the purchase of two new Motorolaradios for use by the ambulance service at a cost of $1,806,00. A MOTION TO MAKE the purchase was made by A1d. Johns and seconded by Add. Clark. On roll call, carried unanimously. Recommended payment of $1.00 to the Ambulance Committee by the Public Property Committee. for the purchase of miscellaneous ambula nce supplies which were not sold to the new operators. A MOTION FOR THIS payment was made by Add. Johns and seconded by Ald. Clark. On roll call, carried unanimously. Recommended a payment of $10.00 to Mr. Wallace Ritchie for amb— ulance calls answered. A MOTION FOR THE PAYMENr was made by Ald. Love stead and seconded by A1d. Lawrence. On roll call, carried unanimously. • Recommended the installation of parallel parking only signs on Coon St. from Newell St. to the city limit. A MOTION TO ADOPT this recom- mendation was made by Aid. Bohne and seconded by Aid. Grant. Carried unanimously. PUBLIC PROPERTY Redommended that a deed be given the Wisconsin Conservation Department for city owned property now $ea:sda,3pytdde7dtgartment, In return,. the Conservation Department will pay an assessment in excess of $4,000 for Sewer & Water extensions, A MOTION TO ADOPT this recommendation was made by Ald. Bohne and seconded by A1d. Clark. On roll call, carried unanimously, A. short discussion followed relative to the O'Konski. TV station being located in the area. A MOTION WAS MADE. by Add. Leith and seconded by AA1d. Bohne, that Mayor Mikulich contact Mr. O'Konski to see if he would be initerested in reinstating his offer on the Memorial Building. Carried unanimously. CLAIMS Recommended payment of city hills totaling $16,494.20 Water Utility bills totaling $6,493.21, A MOTION FOR PAYMENT of the claims was made by Aid. Clark and seconded by 43d. DATE OF ATION: March. 1966 Yas ELECTION REPORT April 5, 1966 We, the members of the Common Council of the City of Rhinelander, having been duly assembled in the council chambers of the said city, this llth day of April, 1966 for the purpose of canvassing the votes of the several wards for the different offices of the last municipal election held on the 5th day of April 1966, having duly canvassed said vote do hereby make and file this our statement of said election. FOR MAYOR, there were 2,018 votes cast, of which S.Ha,rris Lewis received 1,376 and Rudolph Mikulich received 642. S. HARRIS LEIS having received the highest number of votes cast is hereby elected mayor for the ensuing two years. FOR CITY ATTORNEY., John Kruege received 1,794 votes. JOHN W. KRUEGER the ensuing two years.. FOR BOARD OF EDUCATION there were 6,137 votes cast Robert Kaulum Kenneth Pazdernik the only candidate in the race, hereby elected City Attorney for (including the Towns of Harrison as follows: 1,504 I.E. Nik Nevin. 7601 F.T. Ratliff William P. Taylor- 1,262 & Pelican) 1,144 1,467 ROBERT KA .L , F.T. RATLIFF & WILLIAM P. TAYLOR having received the highest number of votes cast, are hereby elected to three year terms on the Elementary Board of Education. Mr. Kaulum replaces Mr. Oscar W. Johnson, who did not run for re-election. S ALDERMEN -SUPERVISORS 8 WARDS ] WAD there were 343 votes cast as follows: Clarence Pecor 181 & Ray W. Joslin 162. CLARENCE PECOR having received the largest number of votes cast, is hereby elected Alderman -Supervisor of the 1st Ward for the ensuing two year period. 2nd WARD there were 307 votes cast as follows: Richard Johns 168 and Irvin Clark 139. RICHARD JOHNS having received the largest number of votes cast, is hereby elected Alderman -Supervisor of the 2nd Ward for the ensuing two year, period. 3rd WARD there were 184 votes cast for the only candidate in John F. Kunach. JOHN. F. KUNACH is hereby elected Alderman-Supery 3rd Ward for the ensuing two year period. he race, or of the 4th Ward there were 353 votes cast as follows: Edward Bohne 226 and Jack H. Tromp 127. EDWARD BOHNE having received the largest number of votes cast, is hereby elected Alderman -Supervisor of the 4th Ward for the ensuing two year period. - 5th WARD there were 221 votes cast for the only candidate in the race, Vernon P. Grant. VERNON P. GRANT is hereby elected Alderman -Supervisor of the 5th Ward for the ensuing two year period. 6th WARD.there ere. 266 votes cast as follows: Julius J. Petta 150 & Jaynes Doherty 116. JULILS J. PETTA.having received the largest number of votes cast, is hereby elected Alderman -Supervisor of the 6th Ward for the ensuing two year period. 7th Ward there were 189 votes cast for the only candidate in the race, Ray G. Church. RAY G. CHURCH is hereby elected Aldermen -Supervisor of the 7th Ward for the ensuing two year period. 8th Ward there were 211 votes cast for the only candidate in the race, Thorr~xas E.
