HomeMy Public PortalAbout88-077 (05-17-88)RESOLUTION NO. gg-77 A RESOLUTION OF THE GITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE ENGINEER'S REPORT ON 'PHE LANDSCAPE MAINTENANCE DISTRICT, DECLARING I1'S INTENTION TO ORDER THE LEVYING OF ANNUAL ASSESSMENTS WITHIN SAID CITY PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972", AS AMENDED, (COMMENCING WITH STREETS AND HIGHWAPS CODE, SECTION 22500 ET SEQ.,): DESCRIBING T11E DISTRICT TO BE BENEFITED AND TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF: FIX]:NG THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO THE LEVY OF ASSESSMENTS FOR 7'LIE FISCAL YEAR 1988-89; AND FIXING THE TIME AND PLACE OF THE REGi1LAR MEETING TO HEAR PROTESTS AND OBJECTIONS TO THE ASSESSMENT OF THE ANNI7AL INSTALLMENT. (Landscape Maintenance District of the City of Lynwoad) WHEREAS, the Director of Public Works/City Engineer of the City of Lynwood did, on the 17th day of May, 1988, file with the City Clerk, as ordered by Resolution No. 88-44 of the City Council of the City of Lynwood, adopted April 5, 1988, a report relating to the service necessary to maintain and improve all parks and landscaped areas within public right-of-way and City--owned properties i.n the City of Lynwood, said written report being in compliance with Chapter 1, Section 22500 et seq., of the Streets and Highways Code of t/he--State of California. / / NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood that: SECTION 1. Said report by the Director of Public Works/ City Engineer is hereby approved and adopted as filed. SECTION 2. That the public interest and safety require and it is the intention of the City Council of the City of Lynwood to levy and collect assessments for fw,nishing the service necessary to maintain and improve all public landscaped areas comprising 29.5 acres of parkland, the Civic Center Complex, six baseball. diamonds, two fire stations, six water wells, 3 street islands, 0.63 acres of median islands and approximately 8,000 parkway trees in the City of Lynwood within the district described in Section 3 hereof and to be known a.s "Landscape Maintenance District of the City of Lynwood." Reference i.s hereby made to Diagram No. 1978-L and Specifications No. 1978-L on file in the Office of the City Cleric of said City and Plan No. 1978-L to be on file with the Director of Public Works/City Engineer. ' SECTION 3. Tiiat the exterior boundary of the district to be benefited therefrom and to be assessed to pay the costs and expenses thereof to be known as said assessment district is described as follocas: Those properties lying within the City limits of the City of Lynwood. Reference is hereby made to the Engineer's Report on file with the City Clerk. All publicly owned properties are assessment exempt. SECTION 4. That the said contemplated improvement shall be had and taken under the provisions of Division 15, Part 2 of the Streets and Highways Code, cited as the "Landscaping and. Lighting Act of 1972, as amended". SECTION 5. Notice is hereby given that June 7, 1988, at the hour of 7:30 p.m., in the Council Chambers of City Hall, 11330 Bullis Road, Lynwood, California, is the date, hour and place fixed for the hearing of protests and objections by the City Council.. Any, and all persons having any protest or objection to said proposed maintenance, the extent of said assessment, district, or the levy of the proposed assessment may appear before the City Council at said hearing and show cause why said maintenance should not be carried out and the proposed assessment and diagram confirmed, all in accordance with said Resolution of Intent and Report. Prior to the conclusion of the hearing „ any interested person may file a written protest with the City Clerk, or, having previously filed a protest, may file a written withdrawal of protest. A written protest shall state all grounds of objections. A protest by a property owner shall contain a description sufficient to identify the property owned by him. All interested persons shall be afforded the opportunity to hear and be heard. The City Council shall consider a.il oral statements and written protests or communications made or filed by any interested person. SECTION 6. Notice is further given that beginning in June, 1989, pursuant to Streets and Highways Code, Section 22565, the regular meeting to consider the annual installment shall be held on the date, hour and place of the first regular meeting in June as specified in any ordinance or resolution or order of the City Council fixing the time and place of its regular meeting.
