HomeMy Public PortalAbout20231129090749408A regular meeting of the Common Council of the City of Rhinelander was held in the council chambers of the City Hall on October 9th at 7:30 P.M. The meeting was called to order by the Mayor. On roll call, all members were reported present with the exception of Alderman Rosenkranz. Motion was made by Alderman Bohne and seconded by Alderman Locke that we dispense with the reading of the minutes of the last meeting and that they stand approved. Motion was carried. James Gaber, John Balcaulis, Cyril Hyke and John petty made application for a license to serve fermented malt beterages and intoxicating liquors. Upon recommendation of the license committee a motion was made by Alderman Kunach and seconded by Alderman Joslin that recommendation be approved. Motion carried. Mr. Robert Olsen made application for a combination class "B" license - location . 25 North Brown Street. The license committee recommended that license be granted and a motion was made by Alderman Kunach and seconded by Alderman Bohne that license be granted upon surrender of license issued for the same location. On roll call motion was carried. An ordinance for the rezoning of property recently annexed from the Town of Pelican to the City of Rhinelander to commercial district was read for the first time. A motio0 was made by Alderman Locke and seconded by Alderman Sawyer that a public hearing be held on same at the next meeting of the council to be held. on November 13th. Motion carried. Motion was carried.. AN ORDINANCE TO CREATE SECTION 10.1068 (10) OF THE PENAL CODE OF THE CITY OF RHINELANDER, WISCONSIN. THE COMMON COUNCIL OF THE CITY OF RHINELANDER, ONEIDA COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS: That all existing ordinances, codes or portions thereof in conflict herewith are hereby repealed and Section 10.1068 (10) is created to read as follows: i©.1068 (1O) SPECIAL RESTRICTIONS FOR PARKING ON FREDERICK STREET: The operator of a motor vehicle shall not park said vehicle on any day at any ti +»e within the following described area: On the South side of Frederick Street between ite intersections with Alban Street and Anderson Street. Motion was made by Alderman Bohne and seconded by Alderman Locke that ordinance be adopted. Motion carried. Ttle planning commission recommended that the request of George Reuchert, operator of a grocery store on Brown Street, to extend his present parking south, removing curb and gutter, be denied and that in the future the commission will be opposed to angle parking on streets less than 80 feet wide. The matter was discussed with some opposition being shown and it was moved by Alderman Locke and seconded by Alderman Sawyer that it be laid over for further study. Motion carried. The planning commission recommended that the downtown ornamental ligntin bulbs be changed from 15,000 lumen to 20,000 lumen at an additional cost to the city of approximately $300.©0 per year. There was some discussion and it was moved by Alderman Bohne and seconde by Alderman Joslin that recommendation be approved. On roll call motion was carried 8 to 2 with l absent. This being the date set for a public hearing on the vacation of a portion of an alley over and across a part of Lot 11, Block 20, Original Plat of the City of Rhinelander, the following order of vacation was presented: STATE OF WISCONSIN ) O IDA COUNTY .CITY OF RHINELANDER ) ORDER OF VACATION In the Matter of: Vacation of a Portion of that certain Alley over and across a part of Lot 11,. Block 20, Original Plat of the Village (Now city) of Rhinelander, according to the recorded plat. THE MATTER above having come on to be heard at a regular meeting of the Common Council of the City of Rhinelander, held at the City Hall in said City, on the 9th day of October, 1961, at 7:30 P.M., and it appearing that upon the presentation of a document denominated "Multiple Agreement Relative to Alley Vacation, Easements, Grants, etc,", constituting also an application by the parties executing said Agreement for vacation of a portion of an alley in the corporate limits of the City of Rhinelander, as hereinafter set out, pursuant to Section 66.296, Wisconsin Statutes; and upon the filing of said instrument and ppplication, the Common Council caused written notice thereof to be given and published aS required by law, pursuant to resolution and order of the Common Council herein, duly entered at a regular meeting thereof held at the City Hall in the City of Rhinelander on the 14th day of August 1961 commencing at 7:30 P.M.; that Notice of Lis Pendens has been filed and a certified copy made a part of these proceedings; that due proof of service and publication has been filed; and it appearing the various recitals in said application and agreement are true, and all requirements of law have been complied with; and the following having appeared in favor of said application and agreement First National Bank and the following having appeared in opposition thereto None and it appearing to the Common Council that it is for the best interest and public welfare and safety that such vacation be approved subject to the conditions and provisions therein contained; and upon said application, agreement, records and files herein, the THE COMMON COUNCIL OF THE CITY OF RHINELANDER DOES HEREBY ORDER that there is hereby vacated and discontinued that portion of a certain alley exiwting in the City of Rhinelander, described as follows. The East 90 feet of the North 10 feet of Lot 11, Block 20 of the Original Plat of the Village -(Now..city) of Rhinelander, according to the recorded Plat thereof such vacation and discontinuance to be effective upon the following conditions: 1. That the First national Bank of Rhinelander, lsconsin, execute and deliver to the City of Rhinelander, a quit claim deed covering the north 12 feet, except the west 5 feet thereof, of: Lot 10, Block 20, of the Original Plat of the Village (Now city) of Rhinelander, the sage to be used as and for a public alley and in event of abandonment or discontinance, title thereto shall revert to the said First National Bank of Rhinelander, or its successors and assigns; 2, That the said First National Bank of Rhinelander execute and deliver to the City of Rhinelander, a 12 foot easement over and across the south 12 feet, except the west 5 feet thereof, of said Lot 10, Block 20 of the Original Plat of the Village (now city) of Rhine.la_nder, according to the recorded. plat, 3. That the Faid First National Bank of Rhinelander further execute an easement across the west 20 feet of .the East 145 feet of said Lot 10, Block 20 of the Original Plat of the Village (now city) of Rhinelander, according to the recorded plat, lying between the area covered by the quit claim deed under #1 above and the 12 foot easement covered under #2 above, both of such easements to terminate if and when the uses thereof have been discontinued and abandoned; 4. That the areas covered under #1 and #2 above are to be blacktopped at the expense of the said First National Bank, without further responsibility for maintenance �r upkeep by the said First National Bank;,upon condition the City ofRhinelander, by proper action, ordinance or proceedings, provide single ingress and egress over and across the easements granted or conveyed under #1, #2 and #3 above, and that the City Clerk of the City of Rhinelander cause to be recorded in the office of the, Register of Deeds a certified copy of this order, to which shall be annexed a copy of the Multiple Agreement and Application, as well as a copy of the map or drawing showing the alley vacated and discontinued, and the easements granted or conveyed; and upon the execution and delivery by the First National Bank, to the City of Rhinelander of the quit clan deed and easements identified under ,#1, #2 and #3 above, that the vacation herewin become automatically effective and that the portion of the alley so vacated be vested in the said First rional Bank of Rhinelander as abutting property owner of the portion vacated and discontinued, pursuant to said application and agreement between the abutting owners and the persons executing said Application and Agreement. It was moved by Alderman Sharkey and seconded by Alderman Kabel that order of vacation be adopted and that we accept cult claim deed and easements a,s per agreement. On roll call motion was carried. Motion was made by Alderman Sharkey and seconded by Alderman Locke that the city attcrne • be requested to prepare an ordinance providing that use of such' easements and alleyWaye shrall orov ae that ntrf..nce be made only op the ease ��ent to be conveyed covering the south e ' except W5 of Lot lo, Bock 40 and that the alley covered by quit claim deed being the N 12' except W 5' of Lot lc, Block 20 shall be the exit to Stevens Street and providing that no parking be allowed on any portion of alleyway to be vacated. VOtion carried. Mr. Frank Olkowski made application for a license to operate a trailer court at 132 East Curran Street from October 28, 1961 to Oct. 28, 1962. Alderman Kunach suggested that license expiration date be changed to June 30th, 1962 to conform with other licenses which expire on June 30th of each year,with the license fee to be pro -rated. It was moved by Alderman Kunach and seconded by Alderman Sawyer that license be granted : for period Oct. 28th, 1961 to June 30th, 1962 with license fee to be pro --rated. On roll call motion was carried. The purchasing committee reported that 3 bids had been received on salt to be used on city streets with all coikpanies bidding the same price, carloadd. lots $14.30 per ton and truckloadlots $15.10 per ton, bidders being International Salt Co., Cutler Magner Company and Morton Salt Company. The purchasing committee recommended that the bid of International. Salt Company be accepted and tc purchase in carload lots. They also reported that 3 bids had been n submitted for the city coal supply, Rhinelander Bldrs. Supply Company $14.60 per ton, Macdonald Lbr. & Coal Company 514.50 per ton and Sweo Transfer Company $14.65 per ton. They recommended that the lowest bid of Macdonald Lumber and Coal Company be accepted. Motion was made by Alderman Kabel and seconded by Alderman Sawyer that recommendation be approved and bid of Macdonald Lumber and Coal Company be accepted. On roll call motion was carried. A question arose as to what committee should handle the purchasing, in this case whether the salt used by the public works department should be purchased by the purchasing committee or the Board of Public Works. There was considerable discussion during which time Alderman Kabel advised that the purchasing committee might as well be abolished if it has no authority to make recommendations on purchasing. The Board of public Works recommended that the bid of Cutler Magner Company be accepted 111e -truckload lots. A motion was made by Alderman Bohne •and seconded by Alderman Joslin that the recommendation of the Board of public works be approved and bid of Cutler Magner Company be accepted in truckload lots. On roll call motion was carried 6 to 4 with 1 absent. A motion was made by Alderman Sharkey and seconded by' Alderman Kabel that the city attorney be requested to investigate the matter and submit his findings to the council defining the duties of the purchasing committee and proper procedure to be followed in purchasing. Motion carried. The police and fire committee recommended that Douglas Joslin, a member of the police department, be authorized to attend the annual institute on Delinquency control for Wisconsin law enforcement officers in. Madison October 17th to 20th. The police and fire committee request ed`perrnission to call for bids on a new squad car as the car to be traded in is now 2 years old. It was moved by Alderman Kabel and seconded by Alderman Sawyer that the police and fire committee be authorized to advertise for bids. Motion was carried. A request was made for the transfer of 82,006.16 to the city nurse's account from the contingent fund for the payment of the city's share of the secretary for the city and county nurses. It was moved by Alderman Kabel and seconded by Alderman Kunach that request be granted. On roll call motion was carried unanimously/ The Mayor announced the transfer of Alderman Chandler from the water Dept. committee to the finance committee and Alderman Rosenkranz from the finance committee to the water Dept. committee. Motion was made by Alderman Kabel and seconded by Alderman Locke that transfer be approved. Motion carried. The Board of Public Works recommended that a refund of $85.79 be made to the Congregational church for excessive special assessments on pavement, curb and gutter, sidewalk and sewer on their property on Larch Street. It was moved by Alderman Kabel and seconded by Alderman Chandler that recommendation be approved and refund made. On roll call motion was carried unanimously. The Board of Public Works recommended that a partial payment amounting to $8,183.68 be made to Lassig Ready Mix for curb and gutter and sidewalk construction. Motion was made by Alderman Locke and seconded by Alderman Bohne that recommendation be approved and payment made. On roll call motion, was carried unanimously. The Board of public works requested perrilesion to advertise for bids for a new car for the inspection department with the trade-in of a 1950 Pontiac and a 1955 International panel truck. After some discussion it was moved by Alderman Sharkey and seconded by Alderman Church that request be granted and authorization given to advertise for bids. Motion carried. 1111, uorii,' Q. The 810.00 monthly parking fee established by the trailer ordinance was referred back to the trailer committee for further study and recommend- ation at the public hearing on the ordinance on September 12th. A report was made by the committee and they recommended a fee of $10.00 per month for trailers parked outside of a trailer court and $8.00 per month for trailers parked in a, trailer court. There was considerable discussion with Mr. nikowski, operator of.a trailer court inthe city, objecting to the $8.00 per month fee advising that it would put him out of business. It was moved by Alderman Sharkey and seconded by Alderman Kabel that the monthly parking fee be fixed at $10.00 for trailers outside of a trailer court and 8,8.03 per month for trailers in a trailer court. On roll call motion was carried unanimously. Motion was made by Alderman Locke and seconded by Alderman Chandler that the city attorney be requested to prepare a new trailer ordinance to be presented at the next meeting of the council. Motion carried. The planning comission recommended that deeds be accepted from the RUHS for street right-of-ways. Motion was made by Alderman Sawyer and seconded by Alderman, Bohne that deeds be accepted. Motion carried. Alderman Kunach, chairman of the wage and salary committee, reported that they were planning on granting a 3% salary increase to city employees and requested that the finance committee take this into consideration when preparing their budget. Alderman Sawyer reported on the urisat} sfa,c' ary drainage canditions in the RUNS area and it was reported that this had been reported to the RUHS board of Education for their investigation and possible solution to the matter. Aldermen Bohne proposed the donation of exonses of the farewell party for the Rhineland 00.00 to help defray the r National Guards. It was moved by Alderman Bohne and seconded by Alderman Church that a contribution of $100.0© be made to the Lions Club who are sponsoring the party. On roll call motion was carried unanimously. The memorial building committee reported that the State of Wisco Hein Adjutant General's Dept. were going toterminate their lease with the city for the use of the memorialbuilding on Dec. 31, 1961 but no official notice has been received by the city. The committee reported that they wish to retain the shoproom and the committee recommends that this be granted. The following claims were presented for payment: City bills totaling $10,668.03 covering voucher 2167 through voucher #2234, Parks and recreation bills totaling $339.52 covering voucher #2235 through voucher #2246 and Water Utility bills totaling $3,974.58 covering voucher #408 through voucher #430• It was moved by Alderman Bohne and seconded by Alderman J n, that claims be allowed and that the city clerk be authorized to make payment. unroll call motion was carried unanimously.
