A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD OVERRULING PROTESTING AND ORDERING THE
LE V""PING OF ANNUAL ASSESSMENTS FOR 'PHE E%ISTING
LYNWOOD E,IGHTING ASSESSMENT DISTRICT NO. 88-A,
F'OR. FISCAL YEAR 1988-89.
WHEREAS, the City Council of the City of Lynwood did on
the 5th day of April, 1988, adopt its Resolution No. 88-45
proposing the annual assessment for the Lighting Assessment District
and directing the Director of Public Worlcs/City Engineer to prepare
a report in connection therewith, and
WHEREAS, the Director of Public Works/Ci.ty Engineer did on
the 17th day of May, 1988, submit a report in relation to said
District pursuant to the provisions of the "Landscape and Lighting
Act of 19'x2" {Part 2 of D.i.vision 15 of the Streets and Highways Code
of the State of Cali-fcrnial, and
k'HEREAS, the City Council did on the 17th day of May,
1988, adopt Resolutions No. 88-74 and 88-75 approving the
Engineer's Report herein mentioned and declaring its intention to
levy and collect, assessments within said District and fixing the
time and place for a hearing on the matter of sa.i.d District.
WHEREAS, evidence has been received as to the publication
and posting of notice of said hearing in the time, form and manner
required by law;
NOW, THEREFORE, the City Council of the City of Lynwood
DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE as follows:
Section 1. Each and all of the recitals set forth
hereinabove are true and correct.
Section 2. The protests submitted, if any, do not
represent property owners owning more than 50 percent of the area of
assessable lands within said district, and said protests are hereby
overruled.
Section 3. The Lynwood Lighting Assessment for the fiscal
year 1988-89 shall be $1.06 and $1.88 per foot of front footage for
residentially and commercially zoned properties respectively.
Section 4. The City Clerk is hereby authorized and
directed to forthcai.th file a certified copy of said diagram and
assessment with the County Auditor.
Section ~. The City Clerk is hereby further authorized
and directed to file a statement as described in the Government Code
Section 54900 and following with the County Assessor immediately
after the adoption of this resolution.
Section 6. This resolution shall take effect immediately
upon its adoption.
