HomeMy Public PortalAboutResolution 86-2684RESOLUTION NO. 86 -2684 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING MODIFICA- TION OF CONDITIONAL USE PERMIT 76 -496 THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon a Public Hearing and appeal for a Modification of Conditional Use Permit. 76 -496 to allow a drive - thru facility to an existing fast food restaurant, City Council finds: A. The site for the proposed use is adequate in size, shape and topography, and circumstances, and B. The site has sufficient access to streets and high- ways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use, and C. The proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare. SECTION 2. Accordingly, said Modification of Conditional Use Permit is granted subject to the following conditions: A. A detailed landscaping and irrigation plan must be reviewed and approved by the Planning Department prior to issuance of building permits for the proposed drive -thru addition. B. No drive -thru operations shall be permitted between the hours of 10:00 P.M. and 7:00 A.M. C. The drive -thru addition shall be architecturally compatible with the existing structure (i.e. materials and colors) and subject to the review and approval by the Planning Department. D. Permits shall be obtained from the Public Works De- partment for the proposed work in the public right -of- way. E. A short section of double centerline and directional arrows shall be painted adjacent to the driveway approach serving Las Tunas Drive per the approval of the Public Works Coordinator. F. All signage shall conform to City of Temple City requirements. G. All necessary building permits shall be obtained prior to construction of the drive -thru addition and instal- lation of signs. H. That there be a right -turn only sign provided at the exit onto Las Tunas Drive. I. The applicant shall, within 30 days, file with the Planning Department a signed and notarized Affidavit of Acceptance indicating that the applicant has read, understands, and agrees to the terms related to the granting of this Conditional Use Permit. SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
