RESOLUTION OPPOSING AMENDMENT
TO CONDO SERVICE ACT
WHEREAS, A-2121 and its companion bill, S-911, would amend the Condo
Service Act to require municipalities to reimburse private communities for the
costs of providing standby water to fire hydrants or provided the service within
such private communities; and
WHEREAS, since most private communities retain ownership of the streets in
their development, it is illegal for towns to use public, taxpayers' dollars to pay for
a service on a privately owned street; and
WHEREAS, this bill would impose new costs on the taxpayers in the vast
majority of municipalities all around the State, as it would supersede agreements
entered into between those municipalities and the developers of the condominium
units; and
WHEREAS, this new unfounded mandate would violate Article VIII, Section II,
paragraph 5 of the State Constitution, which limits the ability of the State to
impose new unfounded mandates on local governments.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Borough
Council of the Borough ofCarteret, oppose passage of A-2121/S-911.
BE IT FURTHER, RESOLVED, that copies of this Resolution be forwarded to
our State Legislators, Senator Joseph Vitale and Assemblymen John Wisniewski
and Joseph Vas, and to our neighboring municipalities, and to the New Jersey
League of Municipalities.
