RESOLUTION N0. 87 -2689
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY APPROVING ZONE VARIANCE NO. 86 -818
RE: REAR YARD SETBACK FOR AN ATTACHED GARAGE
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE
AS FOLLOWS:
SECTION 1. Based upon a Public Hearing of an appeal of
Planning Commission Resolution PC86 -1301 denying a variance for
waiver of the required rear yard setback to construct a sub-
standard garage 20' x 21' at 9064 Olive Avenue, the City Council
finds:
1. That there are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of such property which
do not generally apply to other properties in the same
zone; and
2. The variance is necessary for the preservation and
enjoyment of a substantial property right possessed by
other property similarly situated, but which is denied
to the property in question; and
3. That the granting of the variance will not be materi-
ally detrimental to the public welfare or injurious to
the adjacent property; and
4. That there are special circumstances as provided in
Section 65906 of the California Government Code.
SECTION 2. Accordingly, said Zone Variance is granted
subject to the following conditions:
1. The construction shall substantially comply with the
plot plan on file, except as heretofore modified.
2. A two hour fire wall shall be installed on the south
side of the new garage.
3. The proposed garage shall be relocated easterly ap-
proximately 9 feet so as to leave a 20 foot pad in
front of the garage to provide a 20 foot setback from
the public right of way (Sultana Avenue).
4. The existing curb -cut on Olive (together with approxi-
mately 18 feet of driveway) shall be removed and
replaced with a standard curb, gutter, and sidewalk
prior to final inspection.
SECTION 3. The City Clerk shall certify to the adoption
of this Resolution.

regular meeting held on the 6th day of January, 1987, by the
following vote:
