HomeMy Public PortalAboutResolution 87-26891 1 RESOLUTION N0. 87 -2689 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING ZONE VARIANCE NO. 86 -818 RE: REAR YARD SETBACK FOR AN ATTACHED GARAGE THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon a Public Hearing of an appeal of Planning Commission Resolution PC86 -1301 denying a variance for waiver of the required rear yard setback to construct a sub- standard garage 20' x 21' at 9064 Olive Avenue, the City Council finds: 1. That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone; and 2. The variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated, but which is denied to the property in question; and 3. That the granting of the variance will not be materi- ally detrimental to the public welfare or injurious to the adjacent property; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code. SECTION 2. Accordingly, said Zone Variance is granted subject to the following conditions: 1. The construction shall substantially comply with the plot plan on file, except as heretofore modified. 2. A two hour fire wall shall be installed on the south side of the new garage. 3. The proposed garage shall be relocated easterly ap- proximately 9 feet so as to leave a 20 foot pad in front of the garage to provide a 20 foot setback from the public right of way (Sultana Avenue). 4. The existing curb -cut on Olive (together with approxi- mately 18 feet of driveway) shall be removed and replaced with a standard curb, gutter, and sidewalk prior to final inspection. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. 1987.
