AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN R-1 SINGLE FAMILY
RESIDENCE DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN
AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA,
APPROVED JUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana, as follows:
SECTION 1. As provided in Article 22, Section .011 and Article
48 of Ordinance No. 2325-1968 commonly known as the Zoning
Ordinance of the City of Richmond, Indiana the following des-
cribed real estate is allowed as a Special Use to -wit: Resi-
dential Development Unit Project to be located at Old U.S.
Highway 40, Northwest of Myron W. Hill .residence.
Being a part of the Northeast Quarter Section 2 Township
13 North Range 1 West, Northwest Quarter Section 1 Townes
ship 13 North Range l West, Southwest Quarter Section.36
Township 14 North Range 1 West, and.Southeast Quarter
Section 35 Township 14 North Range T West in the City 'of
Richmond and Wayne County, Indiana, Tand more particularly
described as follows:
Commencing at a stone at the Southwest -Corner of the
_NorthwestQuarter<,Section 1 Township f3 North Range l
West; thence North 89050.' West along an extension of the
South line' of the Northwest Quarter of said Section 1 a
distance ,Gf .1;6.50 feet; thence North: 0047' .East, parallel
to the West line of. said Section 1, ',a distance of 330.00
feet; thence -south 89050' East, parallel,to the South
line of the Northwest Quartet' of said Section 1, a dis-
tance of 4_ 5'0:feet; thence North 0047' East, parallel to
the West line.of said Section 1, a dis'tajnce of 2082.98
feet, all of; the foregoing bearings ;and distances being
in accordance with that shown on a plat of a'survey made
by John E. Beals land Surveyor No. ,1955, and dated

Subject to, an easement for a water line, five feet in
width, the: East line of which is defined in the foregoing
description as "the centerline of an existing 16" water
siphon. line"b
Subject to an easement for ingress and egress and for
utility maintenance and/or reconstruction, 45 feet in
width, the. East line of which is defined in the foregoing
description as "the centerline of an existing 16" water
siphon line".
Subject also t a highway right-of-way, 30 feet in width,
the North line of which is defined in the foregoing
description as the centerline of Old U.S. Highway No. 40.

SECTION 2. As a condition of the aforesaid Special Use and
as an additional restriction on said use, the following
requirements shall hereafter and at all times be met by the
owned, leasee, or any person, firm or corporation using
such real estate.

SEC %ION The Zoning 'Administrator of the City of ichmond,
Indiana is hereby authorized and directed, upon enactment and
publication'of this ordinance, to record and approve the
issuance of a permit for the establishment of the use herein
allowed.
SECTION 4. This ordinance shall be in full force and effect
from and after its passage, approval by the Mayor and publi-
cation as by law required.
