Meeting called to o_der by Vice _resident, Al Taylor. Roll call, all Councilmen present except Mr. Howard. Minutes of regular meeting Sept. 14th and a special meeting, Sept. 22 were read and approved as read. The following resolution was presented: RESOLUTION ORDERING CONSTRUCTION OF SNIT.=.RY SENER ETEEREAS, this being the time and date for hearing any objections to the construction of a sanitary sewer on Grant St.. from Oneida 2_venue east to Lot 2, Block 29, Second .addition: 41 on sa i purpose e AS, all known property owners owning property abutting verzent have been notified of this hearing, for the ceiving objections to laid improvement: W RERE�:.S , the only objection to said improvement was a objection received from Mrs. Len Markham, representing 30 feet frontage on said improvement: The Common. Council having dult taken such objection into consideration, hereby resolves: ten THAT, the City proceed with the construction of said sanitary sewer, and that the costs incurred by the city for labor, materials, equipment and incidentals, be assessed against the abutting property on an equal front foot basis, with due allowance for credits to corner lots, to be payable in four equal annual installments, with interest on the unpaid balances at the rate of five per cent per annum, except that any property owner may pay the balance of his assessment at any time, plus accrued. interest. Moved by Councilmen Craig, seconded by Councilman Reardon that the resolution be adopted as read. Motion carried, all councilmen present voting aye. Mr. Hruschke and other members of tie School Board were present the matt r was discussed at length. Motion ;as made by Councilman Taylor, seconded by Councilman Reardon that the final action on the petition be postponed until October 26th, for further consideration. Motion carried. Motion was made by Councilman Craig, seconded by Councilman Taylor that the City Manager be authorized to get preliminary plans and estimates of cost for a garbage incfenerator from Greeley and Hansen. Motion carried. That the petition is by an elector of School District Number One of the Torn of Pelican. and not an elector of the Town of Pelican and is accordingly insufficient, unauthorized and inadequate. w. That said petition is hot verified or under, oath, and is accordingly insuffici.,ent. 3. That the notice of such hearing was not served on the Clerk of the City of Rhinelander as required by Statute 4.- That regardless end without waiving any of the above `defects thst the petition should be denied for the following additional reasons: a. That the facilities of School District Number One of the Town of Pelican are adequate and sufficient to competently handle all students in its district, and tha t its valuation is apparently in excess of three hundred thousand dollars. b. That such consolidation et this time even if tearranted is impracticable, unfair and unreasonable, since it purports to affect substantial changes during the present school year ' relative to which budget requirements have been submitted, approved by the Council, and placed in the tax roll and contracts incurred based upon school re- quirements as -of a date long prior to the proposed consolidation. c. That approval of such annexation would encourage similar acts by adjacent municipalities which would not only unreasonably and inequitable ' impose substantial tax burdens on the City of Rhinelander, but would apparently result in the overcrowding of present school 'aciliti.es. The Common Council of the City of Rhinelander, 'Tis in, do ordain as follows: SECTION 1: That the increasing delinquency in payaent of annual ntenance charges for ' lots in Forest Home Cemetery, owned by City of Rhinelander, pith the definite loss in revenue, more especi ,lly in the future, ma- es it iTeeerative to set up perpetual -11 lots now sold or that may be sold in the future. SECTIC'N 2: Commencing July 1st, 1943, there shall be ccl ected e annually on all lots privately owned and on h perpetual care has not already been established, a sum of two and one-half cents per square foot, exclusive of walks and driveways, in addition to the'regular annual m:ein.tenance charges, for the purpose of setting up perpetual care on said lots or portions of lots. Said annual perpetual care charge to'continue for a period of ten years, or until a sum' of twenty-five cents per square foot has been paid. At the end of se id ten years or after the sari of twenty-five cents per square foot'has been paid, no further charges either for perpetual care ore annual na inte aence shall be assessed. SECTION 5: After the perpetual care ch_ir e has been paid fornfive years, or the sum of twelve and one-half cents per square foot, the current annual maintenance charge shall be reduced one-half for the ensuing five years or until the total amount of the perpetual care charge has been paid. This reduction in annual maintenance charges after five ye ars , shall apply only on those lots or portions of lots, where the previous annual me ntenence cher es have been paid to date. SECTION 4: 'hen the City sellsthe unoccupied portion of any lot that has been delinquent in annual m : intenance charges for five years or more, as provided by law, from the sale price of said unoccupied portion a sure equal tc twenty-five cents rer square for the occupied portion of said lot shall be turned. into the perpetual care fund for the perpetual care of the occupied por If the sum received from the sale of the unoccupied portion is sufficient to equal twenty-five cents per square foot for the occupied portion, then all the proceeds of the sale shall be t into the perpetual care fund, and perpetual care be set up for the occupied portion on Said lot.
