HomeMy Public PortalAboutOrd. 0567ORDINANCE N0. 567 AN ORDINANCE PROVIDING FOR THE REGISTRATION OF FELONS The City Council of the City of Lynwood does ordain as follows: Section 1: REGISTRATION OF FELONS. Any person who subsequent to January 1st, 191, has been or hereafter is convicted of an offense punishable as a.felony in the State of California, or who has been or 4Th0 is hereafter convicted of any offense in any place other than the State of California, which offense having been committed in the State of California would have been punish- able as a felony; and any person who subsequent to January 1, 191 has been or hereafter is convicted in the State of California or elseti~ahere of tine violation of any law whether the same is or is not punishable as a felony relating to or regulating the posses- sion, distribution, furnishing or use of any habit-forming drug, regulating or prohi'oiting the carrying, possession or ownership of any concealed weapon or deadly weapon, or any weapon capable of being concealed, who comes into the City from any point outside of said City; and every such person oaho at the time this ordinance becomes effective is residing or is present within said City shall report to the Chief of Police of said City within forty-eight (4~8) hours after his arrival within the boundaries of said City, and. shall furnish to such Chief of Police in a written statement signed by such person, the true name of such person and each other name or alias by which such person is or has been known; a full and complete description of himself; the name of each crime of which he has been convicted; together with the name of the place where each such crime was committed; the name under which. he wa.s convicted; and each in- stance and the date thereof; the name, if any, and the location of each prison, reformatory, ,Jail or other penal institution in which he U,ras confined or to which he was sentenced; the location and address of his residence, stopping place, living quarters or place -1- of abode in the City; if more than one residence, stopping place, or place of abode, that fact must be stated and the location and address of each given; and such other and further information as may be required by the Chief of Police for the ,ourpose of aiding and assisting in .carrying into effect the provisions and intent of tYiis ordinance. Section 2: CHANGE OF ADDRESS. In the event that any person specified in the preceding section shall change any such glace of residence, stopping place, or living quarters to any new or different place or places within said City other than any place last shown, in such report to said Chief of Police, he shall with- in twenty-four (24) hours after making such change, notify said Chief of Police in a t~aritten and signed statement of such change of address, and. shall furnish in such written statement to said Chief of Police his new address, and each one thereof. It shall be unlavaful for any person required by any pro- vision of this Code to furnish any such report, to furnish in such report any false or fictitious address, or any address other than a true address or intended address, or to furnish in making any such report any false, untrue, or misleading information or state- went relating to any information required by any provision of this Ordinance to be made or furnished. Section 3: CONVICTS, PHOTOGRAPHING AND r^INGERPRINTING. Each convicted person, at the time of registering and furnishing the information required by Sections 1 and 2, shall be photographed and fingerprinted by the Chief of Police, who shall cause such photo- graphs and fingerprints to be made a part of the record provided for by Section 4~. Section ~: RECORDS CONr^IDENTIAL. The statements, photographs and_ fingerprints hereinbefore provided for shall at all times be kept by the Chief of Police in a. file separate and apart -2- from other files and records maintained and kept by the Police Department, and shall not be open to inspection by the public, or by any person other than a regular member of the Police Department. Any such photograph, or duplicates thereof, may be exhibited to persons other than police officers of the City for the purpose of assisting in identifying perpetrators of any crime. Copies of said statements, photographs and fingerprints may be transmitted- to the sheriff of any county of the State of California, to the head of any organized police department of any municipality in said state, or to the head of any department of the State of California engaged in the enforcement of any criminal law of this state, or to the head of any federal law-enforcement agency, or to any sheriff or chief of police of a municipality, or to the head of any other law-enforce- went agency of any state in a.ny state or territory outside of the State of California, when request is made in writing by such sheriff or other head of a lav.-enforcement agency asking for the record of a certain person named therein, or for the record of a person whose photograph or fingerprints reasonably correspond with photographs or fingerprints submitted with such request, and- stating that such record is deemed necessary for the use of such law enforcement offi- cer or agency in or concerning the investigation of any crime, or any person who is accused of committing a. crime, or any crime which is reported to have been committed, and further stating that the record. will be used only for such purpose. Section 5: Nothing contained herein shall prevent the Chief of Police from furnishing to the Sheriff of any County, the Chief of Police of any municipality, or the head of any other law enforcing agency which maintains any system of registration of convicted persons, copies of the statements required to be filed under the provisions hereof, together with photographs and finger prints of persons making such statements when and if such Sheriff, Chief of Police, or other head of a law enforcing agency furnishes -3- to the Chief of Police of this City copies of statements, photo- grapns and fingerprints procured by him, and it is hereby made the duty of such Chief of Police to arrange for the exchange of such information. Section 6: FALSE STATEP4ET7TS. No person required by any provision of Sections 1 and 2 to furnish a statement, shall in such statement give any false or fictitious address or any address other than a true address or intended address, or furnish in the making of any such report any false, untrue or misleading information or statement, relating to a.ny information required by any of the pro- visions thereof to be made or furnished. Section 7: The provisions of this ordinance shall not apply to a.ny person whose conviction is or has been set aside in a manner provided by law. Section 8: Any person, firm or corporation violating any of 'the provisions of this ordinance sha.11 be deemed guilty of a misdemeanor a.nd upon conviction thereof shall be punishable by a fine of not to exceed five hundred dollars (500.00) or imprison- ment in the City Jail of the City of Lynwood or the County Jail of Los Angeles County, State of California, for a period of time not to exceed six months, or by both such fine and imprisonment. Each such person, firm or corporation shall .be deemed guilty of a separate offense for every day during any portion of which violation of any provision of this ordinance is committed, continued, or permitted by such person, firm, or corporation, and shall be punishable therefor as provided by this ordinance. Section 9: The City Clerk of said City shall certify to the passage of this ordinance and cause the same to be published once in the Lynwood Press, a weekly newspaper of general circulation published and circulated in said City of Lynwood.. -~- First read at a regular meeting of the City Council of said City held on the 6th day of June, 1951, and finally adopted and ordered published at a regular meeting of said Council held on the 19th day of June,~1951, by the following vote: AYES: COUNCILMEN BRUNER, DAET'vdEILER, MOFFITT, SNEDDON, WILLARD.
