HomeMy Public PortalAboutOrd. 0566r ORDINANCE N0. 566 AN ORDINAICE OF THE CITX OF LYN440OD ADOPTING A UIUIFORTd PLUT~3ID1G CODE, EXCEPT CERTAIN PORTIONS OF SAID CODE, S4HICH CODE PROVIDES FOR THE PRO- TECTION OF PUBLIC HEALTH AND SAFETY; REGULATES' PERMITS FOR THE INSTALLATION OR ALTERATION OF PLUMBING, GA5, AND DRAINAGE SYSTEMS, AND REGU- LATES AND DEFINES OTHER MATTERS PERTAINING THERETO, AND REPEALIArG ORDINANCE N0. 499 OF THE CITY OF LYNSa00D. The City Council of the City of Lynwood does ordain as follows: Section l: That a certain book, three copies of which are on file in the office of the City Clerk of the Gity of Lynwood, being marked and designated as "Uniform Plumbing Code, 1950 Edition, adopted by t~Testern Plumbing Officials Association at the 20th Annual Conference October, 1949", be and the same is hereby adopted as the plumbing code of the City of Lynwood, except that Chapter I and Chapter II and Sec- tion 303, Subsection (a) of said. code sha.11 be a portion of said code not hereby adopted. Section 2; The City Council does hereby find that said afore- mentioned code regulates the installation of plumbing and- similar work and that such regulations have been printed as a code in book form as aforesaid and hereby adopts said code by reference, (except Chapter I and Chapter IT and. Section 303, Subsection (a) as aforesaid) pursuant to the authority granted by Government Code 50022 of the State of California. Section 3; In lieu of Chapter I and Chapter II of said Plumbing Code, the following administrative provisions a.re adopted: a. To provide for the administration and enforcement of this ordinance, the office of Plumbing Official is hereby created. The Building Official of the City of Lynwood and his assistant or deputies shall be deemed- the Plumbing Official of the City of Lynwood and where- ever in said code reference is made to the Plumbing Official or hie assistants the same shall be deemed to apply to the Building Official, and his assistants and deputies. b. The Plumbing Official shall maintain public office hours -1- to efficiently administer the provisions of said code and the amend.- ments thereto and_ shall perform the following duties and have the following powers: (1) Require submission of, examine and check plane and specifications, drawings, descriptions, and/or dia.grama necessary to show clearly the character, kind and extent of plumbing 4vork covered by appli- cations for a permit and upon approval thereof shall issue the permit applied for. (2) Collect a.ll fees for permits issued ae provid_ed by this code, issue receipts therefor in duplicate, the duplicate copy of which shall be maintained as a record of his office. (3) Inspect all plumbing and drainage work authorized by .any permit to assure compliance with provisions of this Code or amendments thereto, approving or con- demning said work in whole or in part as conditions require. (4) Issue a Certificate of Approval for any work approved by him. (5) Condemn and re,~ect all work done or being done or materials used or being used which do not in all respects comply with tree provisions of this Gode and amendments thereto. (6) Order changes in workmanship and/or materials essential to obtain compliance with all provisions of this Code. ("]) Investigate any construction or work regulated. by this code and issue such notices and orders as pro- vided in Section 4 hereof. (8) Keep a complete record of all the essential trans- actions of his office. (9) Transfer all fees collected by him to the proper authority provided by law to receive such funds. (10) Maintain an official register of all persons, firms, or corporations lawfully entitled to carry on or engage in the business of plumbing. Section 4: The Plumbing Official, his assistants and deputies, shall carry the official badge or credentials of his office and upon reasonable demand shall present the same. The Plumbing Official, his assistants and deputies, shall have the right during usual business hours to enter upon and inspect any and all premises and buildings in the performance of their duties. -2- Section 5: Whenever brought to the attention of the depart- ment having Jurisdiction that any unsanitary conditions exist or that any construction or work regulated by this Code is dangerous, unsafe, unsanitary or a menace to life, health, 'or property or ie in violation of this Code, the said department may request an investigation by the Plumbing Official, who upon determining such information to be fact, shall order any person, firm, or corporation using or maintaining any such condition or responsible for the use or maintenance thereof to discontinue the use of or maintenance thereof or to repair, alter, change, remove or demolish same as he may consider necessary for the proper protection of life, health or property and in the case of any gas pipe or piping may order any person, firm or corporation supplying gas to such pipe or piping to discontinue supplying gas thereto until such gas pipe or piping is made safe to life, health or property. Every such order shall be in writing, addressed to the oomer, agent or person responsible for the premises in which such condition exists and shall specify the date or time when such order shall be com- plied. with, which time shall allow a reasonable period in which such order can be complied with by the person, firm, or corporation receiving such order but shall never exceed the maximum period for which such construction can be safely used or maintained in the Judgment of the Plumbing Official. Refusal, failure or neglect to comply with any such notice or order shall be considered a violation of this Code. Section 5: It shall be unlawful for any person, firm or corporation to carry on or engage in the business of plumbing in the City of Lynwood unless such person, firm or corporation is duly licensed to carry on the business of a plumbing contractor by the State of Cali- fornia and ha.s obtained a business license to do business in the City of Lynwood as provided. by the ordinances of the City of Lynwood. Section 7: No person shall do any plumbing work or labor at the trade of plumbing unless employed by or engaged by a person, firm or corporation meeting the requirements of Section ~ hereof, aubJect to the further exceptions provided in Sectio~i 302 and Section 303 of said Uniform Plumbing Code. -3- Section $: Section 303, Subsection (a.) of said Uniform Plumbing Code shall read ae follows: "No permit shall be issued to any person, firm, or corporation to do or cause to be done any con- struction or work regulated by said Plumbing Code except to a person, firm, or corporation qualified to do business as a plumbing contractor in the City of Lynwood, pursuant to Section 5, or authorized to do plumbing work pursuant to Section 6 hereof, subject to the exceptions provided in Subsections (b) and (e) of Section 303 of said Code". Section ,9: The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for,. or an approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance of a permit upon plans and specifications shall not prevent the Plumbing Official from thereafter requiring the cor- rection of errors in said plans and specifications or from preventing construction operations being carried on thereunder when in violation of this Code or of any other ordinance of the City. Every permit issued by the Plumbing Official under the pro- visions of this Code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within 60 days from the date of such permit, or if the work authorized. by such permit is suspended or abandoned at any time after the work is commenced for a period of 60 days. Before such work can be recommenced, a new permit shall be first obtained so to do. Section '10: Section 305 of said Uniform Plumbing Code shall be amended by adding to "Schedule of Feea" a,s follows: • For ground sprinkling systems and fire protective sprinkling systems, minimum fee, one to five outlets $y 2.00 Additional outlets: Ground, each .05 Fire protective, each .10 -J~'- i . Section 11: Any person, firm, or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed X500.00 or by imprisonment in the City or County Jail for not to exceed 6 months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this Code occurs or continues shall be deemed to consu iahable asp herein offense, and upon conviction thereof shall be p provided. of Lynwood is Section 12: Ordinance No. X99 of the City hereby repealed.. .Section 13: The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause the same to be published once in the Lynwood Press, a newspaper of general circulation printed and circulated in the City of Lynvrood., First read at a regular meeting of the City Council of said City held on the 15th day of May, 1951, and finally adopted and. ordered published at a regular meeting of said Council held on the 6th day of June, 1951, by the following vote: Councilmen Bruner, Daetweiler, Sneddon and AYES: Willard.
