RESOLUTION NO. 87 -2697
A RESOLUTION OF THE'CITY COUNCIL OF THE CITY OF
TEMPLE CITY APPROVING ZONE VARIANCE NO. 86 -818
RE: REAR YARD SETBACK FOR AN ATTACHED GARAGE
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE
AS FOLLOWS:
SECTION 1. Based upon a Public Hearing of an, appeal of
Planning Commission Resolution PC 86 -1301 denying a variance for
waiver of the required rear yard setback to construct a substand-
ard garage 20' x 21' at 9064 Olive Avenue, the City Council
finds:
1. That there are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of such property which
do not generally apply to other properties in the same
zone; and
2. The variance is necessary for the preservation and
enjoyment of a substantial property right possessed by
other property similarly situated, but which is denied
to the property in question; and
3. That the granting of the variance will not be mateYi-
ally detrimental to the public welfare or injurious to
the adjacent property; and
4. That there are special circumstances as provided in
Section 65906 of the California Government Code.
SECTION 2. Accordingly, said Zone Variance is granted
subject to the following conditions:'
1. The construction shall substantially comply with the
plot plan on file, except as heretofore modified.
2. A two hour fire wall shall be installed on the south
side of the new garage.
3. The proposed garage shall be relocated to provide a 15
foot setback from the public right of way (Sultana
Avenue).
4. The existing curb -cut on Olive shall be removed and
replaced with a standard curb, gutter, and sidewalk
prior to final inspection of the proposed garage.
SECTION 3. The City Clerk shall certify to the adoption
of this Resolution.
PASSED, APPROVED AND ADOPTED this 17th day of February
1987.

adopted by the City Council of the City of Temple City at a
regular meeting, held on the 17th day of February 1987, by the
following vote:
