AN ORDINANCE AUTHORIZING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT IN A R-2 SINGLE-FAMILY RESIDENTIAL DISTRICT•OF ORDINANCE NO. 2325-1968 COMMONLY ItN M AS THE ZONING ORDINANCE OF THE CITY OF RIaftND, INDIANA APPRMED NNE 3, 1968. WHEREAS, on the 15th day of December 1969, the Common Council of the City of Richmond, Indiana enacted Ordinance No. 2440-1969 which said ordin- ance provided in Section 2 thereof that: "As a condition of the aforesaid Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any other person, firm or cor- poration using such real estate: 1. Sections 45.021 through 45.040 of Ordinance No. 2325-1968." WHEREAS, Article 45.00 of the Ordinance No. 2325-1968 commonly known as the Zoning Ordinance of the City of Richmond, Indiana., which is a part of the conditions outlined in Section 2 of the Ordinance No. 2440- 1969 provides that the plan for the development of said property be approved as a part of the ordinance thereof. WHEREAS, it is now necessary to alter said plans of Ordinance No. 2440-1969 which have theretofore'been submitted and approved pursuant to said Ordinance No. 2440-1969. WHEREAS, it is found necessary to alter that part of the aforementioned plan designated to be developed as a single-family residential.area, and change said plan for the development as multi -family residential us- age and the area of this proposed alteration is contained within the entire tract more specifically described as follows, to wit: Being a part of the Southeast Quarter of Section 20, Township 14 North, Range 1 West, in the City of Richmond, Wayne County, Indiana and being more particularly des- cribed as follows: Beginning at a point in the north line of said quarter 755 feet west of the northeast corner of said quarter, and running thence west,'along said north line, 889.39 feet; thence south, parallel to the east line of said quarter, 874.66 feet; thence north 89 degrees and 59 minutes east 1196.39 feet; thence north 200 feet; thence north 89 degrees and 59 minutes east 208 feet; thence south 200 feet; thence north 89 degrees and 59 minutes east 240 feet to the east line of said quarter; thence north, along said east line, 448.17 feet; thence west, parallel to the north line of said quarter, 755 feet; thence north, parallel to the east line of said quarter, 426 feet to the place of beginning, containing an area of twenty-four and sixty-seven hundredths (24.67) acres. SUBJECT to a sixteen (16) foot right-of-way along the south line of said tract extending west, from U.S. 27 to the tract owned by Richmond Water Works as described in deed record 263, Page 80. NOW THEREFORE BE IT ORDAINED BY THE COM COUNCIL of the City of Richmond, Indiana that Ordinance No. 2440-1969 be amended and the above mentioned plan which is a part of Section 2 of said ordinance be altered from Single -Family Residential development of that portion of the plan which is designated Single -Family Residential to Multi -Family Resi- dential development. This ordinance shall be in full force and effect from and after its passage, approval by the Mayor and publications as by law required.
