SPECIAL MEETING
I. ROLL CALL
Members Present: Betsy Crowder,Jed Cyr,Mary Davey,Pete Siemens,Nonette

Members Absent: None.

II. CLOSED SESSION
At 5:35 P.M.,J. Cyr convened the Special Meeting and stated that the Board would adjourn
to Closed Session for the purpose of discussing Closed Session agenda Items 1,2,3,and 4.
The Board recessed to Closed Session at 5:35 P.M. and the Closed Session commenced at
5:36 P.M. The Board concluded the Closed Session at 7:29 P.M.
REGULAR MEETING
J. Cyr called the Regular meeting to order at 7:32 P.M. He noted that the Closed Session
would continue following the Regular meeting to continue consideration of Items No. I
and 4.

J. Cyr noted that it was customary to have the Flag Salute at the Board meeting

ADOPTION OF CONSENT CALENDAR
Motion:B. Crowder moved that the Board adopt the Consent Calendar,
including approval of minutes of the May 12 and May 23, 1999, regular
and special meetings; agenda item 4, Ratification of Approval and
Authorization for the President to Sign the First Amendment to the
Agreement Among the City of Mountain View, the Midpeninsula
Regional Open Space District and the County of Santa Clara on Behalf of
the Board of Directors ; agenda item 5, Approval of Retainer Agreement
With Environmental Science Associates and Authorization for Payment in
a Total Amount Not to Exceed$20,000;Approval of the Letter Agreement
for Environmental Planning Services With the Environmental Planning
Firm of Environmental Science Associates,• and Authorization for the
General Manager to Sign the Agreement on Behalf of the District and
Authorization of the Initial Payment for Services in the Amount Not to

BOARD BUSINESS
A. Agenda Item No. I -Appointment of Peace Officer Jeffrey B. Smith (Report
R-99-86 .
J. Escobar presented the staff report.
Motion: N. Hanko moved that the Board adopt Resolution No. 99-25,
Resolution Appointing Peace Officer Jeffrey B. Smith
Pursuant to Section 830.31(b) of the Penal Code of the State
of California to Enforce the Midpeninsula Regional Open

Space District Land Use Regulations and Those State and
Local Regulations Related to the Protection and Safe Use of
District Land. P. Siemens seconded the motion. The motion
passed 7 to 0.
J. Escobar introduced Carrie Sparks-Hart. He said she had been hired as a
Ranger about three month ago and was assigned to the Foothills area.
B. Agenda Item No. 2 - Award of Contract for Purisima Creek Trail Storm
Damage Repairs at Purisima Creek Redwoods Open Space Preserve;
Authorization for the General Manager to Enter Into Contract With Brazil's
Excavating of San Gregorio in the Amount of$115,445; and Authorization for
the General Manager to Approve Incremental Change Orders to Brazil's
Excavating for an Amount Not to Exceed an Additional $62,555 ($178,000
Total With Base Contract)for Supplementary Repairs to Purisima Creek Trail,
as Identified in the Engineering Geologist's Report Considered at Your March
10, 1999,Meeting (Report R-99-87).
J. Cahill reviewed staff s recommendations. He said removing the bridge has
no real effect on current usage. Regarding the stone, he thought the cost was
reasonable, and it included delivery. He talked about where the stone would
be used.
N. Hanko said she thought the project might be of interest to the Coastal
Advisory Committee and others who are interested in how the District
manages its property.
J. Cahill said the rock is mostly limestone and meets a CalTrans standard for
durability. He said he thought they would complete the project on schedule,
sometime in September.
Motion:B.Crowder moved that the Board authorize the General Manager to
enter into contract with Brazil's Excavating of San Gregorio in the amount of
$115,445 for the Purisima Creek Trail storm damage repairs at Purisima Creek
Redwoods Open Space Preserve,and authorize the General Manager to
approve incremental change orders to Brazil's Excavating for an amount not to
exceed an additional$62,555 ($178,000 total with base contract)for
supplementary repairs to Purisima Creek Trail,as identified in the engineering
geologist's report considered at their March 10, 1999,meeting. D.Little
seconded the motion. The motion passed 7 to 0.
C. Agenda Item No. 3 - Acceptance of Gift of the San Jose Water Company
Trail Easement as An Addition to Kennedy Limekiln Area of Sierra Azul
Open Space District; Determination That the Recommended Action is
Categorically Exempt From the California Environmental Quality Act;
Tentative Adoption of the Preliminary Use and Management Plan
Recommendations Contained in this Report, Including Naming the Trail
Meeting 99-15 Page 4
Easement as an Addition to Kennedy Limekiln Area of Sierra Azul Open
Space Preserve; and Indicate the Intention to Dedicate the Trail Easement as
Public Open Space (Report R-99-88).
D. Woods provided historical information and showed the area on a map. He
outlined staff s recommendations. He showed where Moody Trail was closed,
explaining that the reason the District doesn't encourage the use of the trail is
that people go through the closed section, and the easement is undeveloped.
He said staff will lay out the trail with the assistance of the County because it
starts and ends on the County boundary. When asked about the timetable, he
said they would have to work with the County, and their master plan was on
hold. However, it will be looked at in the District's planning exercise now.
The County is not encouraging any use of the property at this time.
D. Woods showed the possible location of a loop trail connecting to the lower
portion of the Priest Rock Trail and a planned trail along the perimeter of the
reservoir. He didn't know if the parking area was one of the ones where the
County would charge fees. He showed slides of the property, and said he
expected they would build the standard 1.6-foot trail.
M. Williams outlined the terms and conditions of the gift, stating they had
negotiated with San Jose Water for two years.
Motion:P. Siemens moved that the Board determine that the recommended
actions are categorically exempt from the California Environmental Quality
Act as set out in the staff report;adopt Resolution No. 99-26,Resolution
Accepting Gift of Easement Deed and Authorizing Execution of Certificate of
Acceptance With Respect Thereto(Sierra Azul Open Space Preserve-Lands
of San Jose Water Company);tentatively adopt the Preliminary Use and
Management Plan recommendations contained in the staff report, including
naming the trail easement as an addition to Kennedy Limekiln Area of Sierra
Azul Open Space Preserve; and indicate their intention to dedicate the trail
easement as public open space. B. Crowder seconded the motion. The motion
passed 7 to 0.
D. Agenda Item No. 7 - Approval of First Amendment to the Agreement for Option
and Purchase of the Lands of Arlie Land and Cattle Company to Extend the Date
of Exercise of Option From June 30, 1999 to July 15, 1999, and Extend the Close
of Escrow From July 16, 1999 to July 23, 1999 and Authorization for the Board
President and General Manager,-
anager Subiect to Approval of District Legal Counsel, to
Execute All Documents Necessary to Implement the Amendment, Including
Approval of Any Necessary Minor Corrections or Minor Grammatical or
Technical Changes to the Amendment Which do Not Involve Any Material
Change to Any Term Thereof (Report R-99-92).
C. Britton said no action was required as staff doesn't feel an extension is needed
at this time.

VIII. INFORMATIONAL REPORTS
P. Siemens said he had attended a meeting of the ad hoc committee which is part of the
Special Districts Association in Santa Clara County relative to joining LAFCO.
N. Hanko: 1. She thanked the Board members for their attendance at the Coastal Advisory
Committee meeting and urged them to continue to attend. She said she thought the
Committee was making progress in the discussion regarding eminent domain. There will
be a tour of District lands by the Advisory Committee on July 24, and on August 14 they
will be touring agricultural sites on the coast. The next meeting of the Advisory
Committee will be July 27 in Half Moon Bay. Dave Hansen will be speaking about how
the Sonoma County District acquires land without the use of eminent domain. Norm
Matteoni from the POST board will be speaking on eminent domain from a"lawyer for the
owner"standpoint. 2. She had photos of the George Seeger memorial.
B. Crowder: 1. She had pictures of the Dinesh Disai Ridge Trail kickoff event at her
house. She said the hike took about six weeks. 2. She and C. Britton attended Larry
Coons' farewell party at the Hayes Mansion in San Jose.
K. Nitz: 1. In June, he, C. Britton and G. Baillie attended the Special Districts Forum in
Hamilton County in Ohio. The next forum will be in Prince Georges County in Maryland,
and the following ones will be in Minnesota and British Columbia.
D. Little: 1. He had toured some of the preserves and had lunch on top of the monolith.
He was continuing to hike the District lands.
J. Cyr: 1. He referred to a letter from Liz Figueroa about writing to the Governor
encouraging support for Bay Area program items in the state budget. C. Britton said a
letter had been sent. 2. He also referred to a letter from Jim Cunneen commenting on AB
1498 which deals with funding for outdoor science education and conservation education.
P. Siemens: 1. He talked about the feral pigs on the property of the company he left,
noting that there are now probably ten times more pigs than there were when he left the
company seven years ago. The company has authorized a number of employees to carry
firearms on the property,and they have depredation permits from the state. He commented
that the District might have to arm rangers in the future to deal with the problem on District
lands. C. Britton said there was a report from a docent about a boar. He said the Board
might consider contracting with an individual to remove them. He said they would
probably want to work with other agencies to control the problem.
J.Cyr: 2. The volunteer recognition event will be held June 24.
C. Britton: 1. M. Davey had nominated him to be on a panel for the Stanford lands. 2.
He got a letter from Jim Sayer regarding a proposal for $9.5 million bonding. He said he
would go to San Francisco next week to lobby. He is interested because it might be
possible to replace some of the District's debt with interest-free bonds. 3. There will be a

going-away party for Annette Coleman who is leaving July 15. 4. Redwood harvesting has
started at the Arlie Land and Cattle property. Operations ceased on the day of the tour led
by D. Woods for potential donors. POST had $1 million pledged and received another $2
million as a result of the tour. 5. Audrey and he met with Bud McCrary, of Big Creek
Lumber Company. 6. The Park Bond Act passed out of the Assembly, and now goes to
the Senate. 7. He received notice of the 75th anniversary of Memorial Park on July 10. 8.
Ward Paine sent him a copy of Portola Valley's new challenge to raise money for land
acquisition. 9. State budget-- the legislature passed it to the Governor one day late. The
$350,000 for riding and hiking trails and $5 million for Arlie Land and Cattle Co. did not
make it into the budget. The $10 million for Bay Area programs did. He is working with
Assemblyman Cunneen and Senator Sher on that. 10. He and B. Crowder attended Larry
Coons' retirement party. They met Lloyd Wagstaff, the new general manager of the Santa
Clara County Open Space Authority. 1.1. He attended Lee Bowman's retirement party.
12. Special Districts Forum in Ohio. He talked about their program and how it differs from
the District's. 13. There was a memo in the FYIs regarding the conference on the Land and
Water Conservation Fund.

Schedule Special Meeting of the Board of Directors for the Purpose of

Discussion: B. Crowder noted that the response letter to Eva Blum could not be voted upon because
it was not agendized as a consent item. The Board determined that the letter could be
sent out without Board approval under the President's signature. C.Britton pointed out
that the words"april 1992"in the staff report for Agenda Item 5 should read"April
1993".
Vote: The motion passed 5 to 0.
V1. BOARD BUSINESS
A. Agenda Item 1 --Approval of Commercial License Agreement with the Lodge at Skylonda, Skyline
Area for Use of District Lands For Group Hikes;Determination that the Recommended Action is
Exempt from the California Environmental Quality Act;Adoption of Resolution Authorizing Acceptance
of Commercial License Agreement; Authorizing Officer to Execute Certificate of Acceptance of Grant
to District;Authorizing General Manager to Execute Any and All Other Documents Necessary or
Appropriate to Closing of the Transaction(La Honda Creek Open Space Preserve—Lands of Cosimo,
LLC
C. Britton provided background. K.Nitz asked what would occur if Skylonda constructed more units
than the 32 specified in the agreement. C. Britton replied that if that were to occur,the District would
prohibit them from using the land until a new agreement was negotiated.
P. Siemens asked if Skylonda had received permission to construct another 16 units, and C. Britton
replied that they had,but the permission was contingent upon,among other things,resolving this matter
with the District.
K.Nitz inquired as to which preserves Skylonda ordinarily accessed. C.Britton replied that they usually
transported visitors in a van to various preserves.
Motion: K.Nitz moved that the Board determine that the recommended action is exempt from the
California Environmental Quality Act; and Adopt Resolution 99-34,A Resolution of the
Board of Directors of the Midpeninsula Regional Open Space District Authorizing
Acceptance of Commercial License Agreement,Authorizing Officer to Execute
Certificate of Acceptance of Grant to District and Authorizing General Manager to
Execute Any and All Other Documents Necessary or Appropriate to Closing of the
Transaction(La Honda Creek Open Space Preserve—Lands of Cosimo,LLC) D.Little
seconded the motion. The motion passed 5 to 0.
B. Agenda Item 2-- Authorization to Solicit Bids for Drainage Improvements and Resurfacing of Parking
Lots at Los Trancos Russian Ridge,and Windy Hill Open Space Preserves;Determination That the
Project is Categorically Exempt from the California Environmental Quality Act(CEQA);Authorization
for Staff to Solicit Bids for Resurfacing and Installation of Drainage Improvements for Three Parking
Lots at Los Trancos, Russian Ridge,and Windy Hill Open Space Preserves
R.Anderson provided background to the Board. D. Little questioned the amount of rock that would be
laid. P. Siemens questioned whether other preserves, such as Fremont Older,might have higher priority
for resurfacing.
Motion: B. Crowder moved that the Board determine that the project is categorically exempt from
the California Environmental Quality Act(CEQA),and authorize staff to solicit bids for
resurfacing and installation of drainage improvements for three parking lots at Los
Trancos,Russian Ridge,and Windy Hill Open Space Preserves. D. Little seconded the

C. Agenda Item 3-- Approval of Application to the California Coastal Conservancy for Addition to Bear
Creek Redwoods Open Space Preserve;Adoption of Resolution Approving the Application to the
California Coastal Conservancy—San Francisco Bay Area Conservancy Program of the California
Coastal Conservancy for the 805-Acre POST Property Addition to Bear Creek Redwoods Open Space
Preserve
C. Britton presented the staff report,noting that the property has been appraised at$17 million,and, if
the grant is successful,the District will be able to acquire the property from POST for$5 million,with a
matching gift from POST of$5 million.
Motion: P. Siemens moved that the Board adopt Resolution 99-35,A Resolution of the Board of
Directors of the Midpeninsula Regional Open Space District Approving the Application
for Grant Funds from the San Francisco Bay Area Conservancy Program of the
California Coastal Conservancy for the Following Project:Addition to the Bear Creek
Redwoods Open Space Preserve(Peninsula Open Space Trust)Acquisition. K.Nitz
seconded the motion. The motion passed 5 to 0.
D. Agenda Item 4--Proposed Addition of Eastfield Ming Quong Property to Cathedral Oaks Area of
Sierra Azul Open Space Preserve; Determination that the Recommended Actions are Categorically
Exempt from the California Environmental Quality Act;Adoption of Resolution Authorizing Purchase of
the Eastfield Ming Quong Property,Tentative Adoption of Preliminary Use and Management Plan
Recommendations Including Naming the Property as an Addition to Cathedral Oaks Area of Sierra
Azul Open Space Preserve; Indication of Intention to Withhold Dedication of the Property as Public
Open Space at this Time
D. Woods presented the staff report,and showed slides of the property. M. Williams provided details on
the purchase agreement. K.Nitz pointed out that the acreage of the property on page three of the staff

Motion: P. Siemens moved that the Board adopt the Use and Management Plan Amendment to
approve a minor change in the location of the electric gate from its previously approved
location approximately 30 feet southwest of the original manual gate,to the location of
the original manual gate;authorize payment of the final invoice of$3,926.49,bringing
the total District expenditure for this project to$10,000,and waive the tentative adoption
of this project due to its minor nature and proceed with final adoption of this item.D.

VII. INFORMATIONAL REPORTS
J. Cyr reminded the Board that,to comply with the Brown Act,informational reports and discussions should
be related to District business,or for the purpose of clarifying a question,and should be kept brief.
P. Siemens noted that he,C. Britton, and M. Smith met with the LAFCO subcommittee and tentatively
approved a letter which will be sent to boards of various special districts requesting that they agendize the
issue of joining LAFCO.
K.Nitz reported that he had hiked the new Sausal Pond Trail at Windy Hill Open Space Preserve on Sunday,
and saw eight dogs,three of them off-leash. He commented on the beauty of the trail.
B.Crowder reported that: ]) She hiked Bear Creek accompanied by a reporter from the Country Almanac,
who took a picture of her hugging a redwood tree. 2)There will be an event in Portola Valley on Sunday,
September 12,to raise money for acquisition of open space, and she will be making a presentation on the
success of the District in its acquisition process. 3)She attended the Santa Clara County Planning
Commission meeting where Stanford presented its recommendations for use of its open space. 4)She met
with three members of the Coastal Advisory Committee in Pescadero.
J. Cyr announced that: 1)B.Crowder will be recognized at the meeting she mentioned in Portola Valley, and
offered congratulations. 2)The Staff Recognition Event will be held September 9. 3)He received an
invitation to the Deer Hollow Farm Recognition Event,sponsored by the City of Mountain View. 4)He
complimented M. Smith on his recent presentation in Pacifica.
C. Britton reported that: 1)The timber harvest request referred to in the"Comments on Mekler Timber
Harvest Plan" letter provided in the Board's FYI's has been withdrawn. 2) Due to the search and rescue
efforts in August,the Staff Recognition Event which was scheduled for August 19 had to be rescheduled to
September 9. He noted that Saratoga Springs,where the event is to be held,was gracious about the need to
reschedule and did not charge any additional fees. 3)The proposed Park Bond Act may go on the March 2000
ballot if signed by the Governor. 4)AB 1578 has been passed on to the Governor's desk,and the District has
written a letter urging him to sign it. 5)He asked K.Nitz to be prepared to be the alternate representative for
the Coastal Advisory Committee Meeting on September 14. 6)The District did not receive the$500,000
grant applied for through Santa Clara County Transportation Authority for Bear Creek Redwoods. 7)He
passed around a report prepared by the Eagle Scouts on their project at the backpack camp.
R.Anderson reported that he had attended the Los Altos Hills City Council meeting to comment on the Kerns
project. It was rejected on a 3 to 2 vote.

Authorization to Apply for Recreational Trails Program/Grant Funds for Construction of a Segment of
Bay Area Ridge Trail at Long Ridge Open Space Preserve

2. Adopt the attached resolution approving the application to the Recreational Trails Program for
$25,950 to construct a segment of the Bay Area Ridge Trail.
DISCUSSION
The Recreational Trails Program (RTP) is a federally funded program administered by the California
State Department of Parks and Recreation that provides funds for acquisition and development of
recreational trails and trail-related projects. The program was formerly known as the National Trails
Act Fund Program of 1991, but has been renamed and funded as part of the 1998 Transportation Equity
Act for the 21st Century. Under the new legislation, nationwide funding is increased to $40 million for
fiscal year 1999, and $50 million in each of the subsequent four years. Unlike the previous program,
these funds are no longer subject to annual appropriations, whereby the program was often under-
funded. The requirement for matching funds has also been changed, allowing the mandatory
contribution to be reduced from 50 percent to 20 percent.
California will receive approximately $1 million for fiscal year 1999 for motorized and non-motorized
trail projects, and the program will be administered by the California State Department of Parks and
Recreation. Priority will be given to projects that provide for diversified trail use within a recreational
trail corridor. The construction of a segment of Bay Area Ridge Trail at Long Ridge Open Space
Preserve should be an excellent candidate for the RTP because it will allow for safe and equal use of
the Ridge Trail along the Skyline corridor while providing a connection to other regional trails
including the Skyline-to-the-Sea Trail at Castle Rock State Park.
Project Description (see Exhibit A)
In 1994, the District obtained Land and Water Conservation grant funding to purchase the 116-acre
former Sempervirens Fund parcel located at the southeast end of Long Ridge Open Space Preserve (see
report R-95-77). This parcel was purchased in June 1995. The grant also funded the purchase of a
trail easement over a portion of the adjacent Paul property with the intent of linking the trails at Long

with the Skyline-to-the-Sea Trail at Castle Rock State Park. In May 1997, the District purchased the
entire Paul property (see report R-97-59). The proposed development of a trail linking District
preserves with the Skyline-to-the-Sea Trail remains a desirable connection.
The District is applying for a grant in the amount of$25,950 to construct an approximately 1.5 mile
segment of Bay Area Ridge Trail at the southeast corner of Long Ridge Open Space Preserve. This
amount is 80 percent of the total cost for the project, which is $32,440. The proposed alignment for
the four foot to six foot wide hiking and equestrian trail will begin where the Hickory Oaks Trail at
Long Ridge currently ends, south of gate LROI, and will travel southeasterly along the upper reaches of
the Oil Creek watershed. The generally south-facing slopes of the area are characterized by mixed
evergreen forest on the upper slopes, yielding to redwoods in the damp, lower parts of the canyon.
As the proposed alignment travels through the eastern half of the former Paul property, it reaches a
distinctive, grassy meadow that borders the Skyline Boulevard frontage, offering dramatic views of the
Oil Creek drainage, Butano Ridge, and the Pacific Ocean. Consistent with the topography, the trail
will continue to extend southeast past the Saratoga Summit Fire Station and eventually link with an
historic timber haul road that traverses the former Sempervirens Fund property. This proposed
connection will provide a continuous trail link between the Long Ridge trails and the Skyline-to-the-Sea
Trail, a hiking (and partial equestrian) route.
The existing segment of the Bay Area Ridge Trail, located on Saratoga Gap Open Space Preserve and
Upper Stevens Creek County Park, is heavily used by mountain bicyclists. Staff have fielded concerns
and responded to letters from preserve visitors about the bicycle traffic on that portion of the trail. The
proposed route would allow hikers and equestrians to avoid the faster bicycle traffic on the Bay Area
Ridge Trail east of Skyline Boulevard and allow for a more enjoyable use of the Ridge Trail within the
area.

It has been concluded that this project will not have a significant effect on the environment. It is
categorically exempt from CEQA (the California Environmental Quality Act)under Article 19, Section
15304 as follows:
Section 15304 exempts minor grading and clearing of vegetation in order to provide four-to six-foot
wide trails. Grades for the proposed trail will generally be less than 10% and drainage features will be
designed to minimize soil erosion.

GRANT FUNDS FROM THE RECREATIONAL TRAILS
PROGRAM - FISCAL YEAR 1999 -2000
WHEREAS, the Transportation Equity Act for the 21'Century provides funds to the State of
California for grants to state, local and non-profit organizations to acquire, develop
and/or maintain motorized and non-motorized trail purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility for the administration of the program within the State, setting up necessary
procedures governing project application under the program; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of application(s) before
submission of said application(s)to the State; and
WHEREAS, the applicant will enter into an agreement with the State of California to
complete the project(s);
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the
Midpeninsula Regional Open Space District hereby:
Approves the filing of an application for the Recreational Trails Program; and
Certifies that said applicant has or will have available prior to commencement of any work on
the project(s) included in this application sufficient funds to operate and maintain the
project(s); and
Appoints the General Manager as agent of the Midpeninsula Regional Open Space

2. Approve the attached assignment agreement and property management agreement between the
District and Peninsula Open Space Trust, authorize the Board President to execute these.
documents, and, subject to approval by the General Manager and General Counsel, to approve
minor revisions to these agreements which do not substantially change any material term of the
agreements.
DISCUSSION
At your February 18, 1998, meeting, you approved a management agreement with Peninsula Open
Space Trust (POST) for the Loma Prieta Ranch property located south of Loma Prieta and north of the
Soquel Demonstration State Forest (see report R-98-25). The management agreement was part of a
larger complex transaction involving the exchange of POST's Corte Madera property and the District's
surplus property at Teague Hill Open Space Preserve. Although the three-way transaction was never
completed due to complications associated with the Teague Hill property, the District has successfully
acquired the POST (Corte Madera) property, and, most recently, obtained an option to purchase the
Loma Prieta property.
The District has requested that POST take an assignment of the purchase agreement and option which
the seller granted to the District on or about August 10, 1999. When POST exercises the option, and
purchases the property, the District will take a leadership role in endeavoring to secure funds to repay
POST the full amount of the $1,000,000 purchase price within three years. Since the project is outside
of the District's boundary, the District will pursue annexation of the property to incorporate it into the
District and obtain grant funds to assist in its acquisition. In addition, the District will continue to
explore the possibility of selling or transferring ownership of the property to the State for inclusion in
the Forest of Nisene Marks State Park and/or the Soquel Demonstration State Forest. While the
property is owned by POST, the District will assume all management responsibilities under the terms of
the attached Property Management Agreement, which is similar to one you approved at your February
18, 1998, meeting.

The 493-acre Loma Prieta Ranch is located on the southwestern slope of Mt. Loma Prieta, in Santa
Cruz County. Spanning an area between Loma Prieta Road and Highlands Way, the heavily forested
property is a natural extension of the adjacent Soquel Demonstration State Forest (SDSF) and the Forest
of Nisene Marks State Park. The District's Sierra Azul Open Space Preserve and the planned San
Francisco Bay Area Ridge Trail are within one mile of the property. Acquisition of the property and
inclusion of the property in the Sierra Azul Open Space Preserve or the State Park provides the
potential for linking the Bay Area Ridge Trail with Santa Cruz County's Coastal Trail, which connects
with trails descending through the Forest of Nisene Marks State Park, and which will assist in
developing the District's system of trails.
The property is generally steep with elevations ranging from 1,600 feet near the south boundary to
2,800 feet near Loma Prieta Road. Two prominent features of the property include Rattlesnake Gulch
which bisects the site in the north-south direction, and a large, relatively level plateau at the 2,500-foot
elevation. Rattlesnake Gulch has a perennial creek that is the largest tributary to the headwaters of
Soquel Creek and home to the federally threatened Steelhead Trout. Lush riparian vegetation along the
creek includes a number of old growth fir and redwood trees. A timber harvest was last conducted in
1994. The upper portion of the property contains chaparral, oak woodland, and an attractive stand of
knobcone pine; the lower elevation has several acres of redwood forest. The array of vegetative zones
provides habitat for an unusually large variety of animals, including six California Special Status
Species and four locally rare species.
The northern portion of the property can be accessed from Loma Prieta Road on a gated, unsurfaced
road, consisting of a 400-foot easement, descending steeply from Loma Prieta Road to the property's
northern boundary. The road continues down a ridge to a series of relatively level terraces near the
center of the property. A second entrance to the southern portion of the property is from Highland
Way, which intersects Summit Road to the west and Eureka Canyon Road to the east. Until recently, a
massive landslide has prevented use of the road to the west of the property, leaving access to the lower
portion of the property from Eureka Canyon Road which ascends out of the community of Corralitos.
The property entrance has a large gate and berm designed to eliminate trespass problems which
occurred in the past.
The Forest of Nisene Marks State Park and SDSF both provide recreational trails with public parking
areas and interconnecting trail systems. The trail system provides two routes from Highlands Way to
the coast: one to Soquel Drive in Aptos and the other to the Town of Soquel. The Loma Prieta Ranch
trail from top to bottom easily connects to the public parking area and trailhead for SDSF, which is
located only a few hundred feet to the east of the property's entrance on Highland Way.
Improvements to the property are limited to the unsurfaced roads, gates, fencing, and a well. The well
is located near the center of the property and is capped and secure. Berms, gates, and fences have been
constructed to reduce an historical problem with illegal use by recreational gun enthusiasts, and four-

wheel drive vehicles. These barriers are located at both the Highland Way and Loma Prieta Road
entrances. A nearby resident and Deputy of the Santa Cruz Sheriffs Office has contracted with Pelican
Timber Company in the past to assist in surveillance of the site and the problems are now negligible.
The illegal target shooting activity resulted in contaminating two small areas near Rattlesnake Gulch,
but these were successfully cleaned up in 1994 with the proceeds of a redwood timber harvest.
USE AND MANAGEMENT PLAN
Planning Considerations
The property is located within 400 feet of the District Sphere of Influence boundary and is in the
unincorporated area of Santa Cruz County. Open space use of the property is consistent with the
County's General Plan, and a regional trail connecting Sierra Azul Open Space Preserve, SDSF, and
Forest of Nisene Marks State Park is proposed in the District's Regional Open Space Study. The
District will pursue annexation of the property into the District's boundary and possible inclusion of the
property into either the Sierra Azul Open Space Preserve or the Forest of Nisene Marks State Park. At
a minimum, the District will benefit from the eventual ownership by either itself or the State because
open space or park use of the property will protect the resources of both the preserve and the park as
well as provide the opportunity to establish a critically important regional trail connection to both.
Once the acquisition is complete, this trail can occur without further land acquisitions, although it will
be greatly enhanced if the District is successful in acquiring the one remaining private property situated
between Loma Prieta Ranch and the existing open space preserve.
Preliminary Use and Management Plan (Approved February 18 1998)
The preliminary use and management plan will take effect upon acquisition of the property by POST,
and remain effective until a Comprehensive Use and Management Plan is updated for the preserve.
Future land use decisions, including plans for increased public access, will follow further
environmental assessments to ensure land use decisions are consistent with ecological values.
Public Access: Property to remain closed to the public until a more detailed management plan can be
developed for the site.
Patrol: Regularly patrol the property; investigate cooperative agreements with other agencies, or
contract assistance in augmenting District patrol efforts.
Roads: Maintain primary access road from Loma Prieta Road to Highland Way.
Signs: Install signs where appropriate to prohibit access to the property.
Site Safety Inspection: Inspect the property to determine if there are hazards that need to be mitigated.

CEQA COMPLIANCE
Project Description
The project consists of assigning a purchase agreement and option to Peninsula Open Space Trust
(POST) for the acquisition of a 493-acre property on the southwest facing slopes of Mt. Loma Prieta
for open space purposes. POST will hold the land up to three years as open space while the District
works with POST to seek funding to ultimately incorporate the property into the Forest of Nisene
Marks State Park or the Sierra Azul Open Space Preserve. While under POST's ownership the District
will manage the property under the terms of a management agreement which keeps the land in a natural
condition, and closed to the public until such time as a management plan can be developed for the site
and the District determines to open it for such use.
C E A Determination
The District concludes this project will not have a significant effect on the environment. It is
categorically exempt from CEQA (California Environmental Quality Act) under Article 19, Sections
15316, 15317, 15325 and 15061 of the CEQA Guidelines.
Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural
condition and the management plan proposes to keep the area in a natural condition. The management
agreement between POST and the District ensures the property will be kept in a natural condition.
Section 15317 exempts the acceptance of fee interests in order to maintain the open space character of
an area. Assignment of the purchase agreement to POST will ensure the protection of the open space
character of the property until the District or State accepts fee interest in the property, at which time
they will ensure permanent open space protection of the property.
Section 15325 exempts transfers of ownership of interests in land in order to preserve open space.
POST's ownership of the property and eventual transfer of ownership of interests in the property to the
District or State will ensure the property will be preserved as open space.
The assignment of the purchase agreement to POST and property management agreement qualifies
under all three sections and is also exempt under section 15061, as there is no possibility the actions
may have a significant effect on the environment.

DISCUSSION
The Peninsula Open Space Trust (POST) property is located along Hicks Road and adjacent to
the Mt. Umunhum Area of Sierra Azul Open Space Preserve. POST acquired the 99.47-acre
property in 1994 when it exercised the District's option with the understanding that, when
funds were available, the District would acquire the property from POST. In January 1995,
the District agreed to manage the property in conjunction with ongoing management of the
surrounding preserve. POST has requested the District to complete the acquisition project and
funds are now available.
DESCRIPTION (see attached mala)
The POST property is located southwest of Guadalupe Reservoir and adjacent to both the
Almaden Quicksilver County Park and the Mt. Umunhum Area of the Sierra Azul Open Space
Preserve. Situated on the south side of Hicks Road, a county scenic road, the property is an
important part of a scenic corridor that stretches from the District's former Rancho Guadalupe
property to Almaden Reservoir. The property is highly visible from nearby trails on both the
County park and open space preserve. This acquisition is most important in terms of
protecting valuable scenic resources and wildlife habitat.

The irregular-shaped property is bounded by District land to the east and west, Almaden
Quicksilver County Park to the north, and private property to the south. The terrain is mostly
steep and rugged with slopes descending west to Hicks Creek and north to Hicks Road. The
landscape is densely wooded with a broadleaf evergreen forest of oak, bay, and madrone,
while the exposed sides of the ridge support a chaparral community. The uppermost portion of
the property adjacent to District land has gentle to moderate slopes and is densely wooded.
Reynolds Road, a public street, bisects the property for approximately one mile in the north-
south direction. It is a paved public road that serves the preserve and a limited number of
residents living near Hicks Creek and the hillside north of Mount El Sombroso. Dumping of
litter, late night roadside parties, and occasional camping along the road is an ongoing
problem.
There are a number of overgrown roads and trails within the property. A more prominent trail
originates at Reynolds Road approximately one-half mile from Hicks Road and traverses the
property towards the eastern boundary. This trail leads to a few clearings which are heavily
littered and apparently used by illegal campers. There is evidence of other trails entering from
the southeast corner of the property.
Historical mining activities have occurred in Hicks Road region and have disrupted the natural
landscape. One mining site has been located near the center of property where there are
remains of tailings associated with historic excavations. The mine was used for quarrying
limestone and one of the kilns may have been located near the intersection of Reynolds Road
and Hicks Road. Many of these mines and limestone pits are located in Santa Clara Valley
and are not associated with hazardous materials or regulated by the Regional Water Quality
Board.
USE AND MANAGEMENT PLAN
Planning, Considerations
The property is located within the unincorporated area of the County of Santa Clara and zoned
HS (Hillside), requiring a 20 to 160-acre minimum lot size based upon a slope density

dwelling units. Residential development would be facilitated by easy access provided on
Reynolds Road.
Preliminary Use and Management Recommendations
The Preliminary Use and Management Plan will take effect at the close of escrow and remain
effective until the plan is amended or a Comprehensive Use and Management Plan is prepared.
The property will be maintained in a natural condition and no changes to land use are

PrQ.ject Description
The project consists of the acquisition of a 99.47-acre parcel of land as an addition to the Mt.
Umunhum Area of Sierra Azul Open Space Preserve and the concurrent adoption of a
Preliminary Use and Management Plan for the addition. Ultimately, the property will be
included in the Comprehensive Use and Management Plan for the Sierra Azul Open Space
Preserve. The land will be preserved as open space, and maintained in a natural condition.
CEQA Determination
The District concludes that this project will not have a significant effect on the environment.
It is categorically exempt from CEQA (the California Environmental Quality Act) under
Article 19, Sections 15316, 15317, 15325, and 15061 as follows:
Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural
condition and the management plan proposes to keep the area in a natural condition. The use
and management plan specifies the land will not be developed and will remain in a natural
condition.
Section 15317 exempts the acceptance of fee interests in order to maintain the open space
character of an area. The District will acquire fee interest and maintain the open space
character of the area. No development is proposed as part of this project.

Section 15325 exempts transfers of ownership of interests in land in order to preserve open
space. This acquisition will transfer ownership of the property to the District and ensure it
will be preserved as public open space by incorporating it into the Sierra Azul Open Space
Preserve.
This acquisition qualifies under three sections. The actions proposed in the Preliminary Use
and Management Plan are also exempt under section 15061, as there is no possibility the
actions may have a significant effect on the environment.
TERMS & CONDITIONS
The purchase price of the 99.47 acre POST (North) property is $950,000 which is payable in cash
at the close of escrow. The purchase price is based upon a fair market value appraisal of the
property commissioned by the District. The property is composed of three legally subdivided
building sites ranging in size from 24 to 43 acres. POST acquired the North property in January
of 1995. At that time, the District entered into a Management Agreement with POST to manage
this property as part of the Mt. Umunhum area of Sierra Azul Open Space Preserve. POST has
indicated that the proceeds from this sale will be used to help acquire other high priority open
space lands in this vicinity.

The Board of Directors of Midpeninsula Regional Open Space District does resolve as follows:
Section On . The Board of Directors of Midpeninsula, Regional Open Space District does hereby
accept the offer contained in that certain Purchase Agreement between Peninsula Open Space Trust and
Midpeninsula Regional Open Space District, a copy of which is attached hereto and by reference made
a part hereof, and authorizes the President or appropriate officers to execute the Agreement on behalf
of the District.
Section Two. The President of the Board of Directors or other appropriate officer is authorized to
execute a Certificate of Acceptance on behalf of the District.
Section Three. The General Manager of the District shall cause to be given appropriate notice of
acceptance to the seller. The General Manager is further authorized to execute any and all other
documents in escrow necessary or appropriate to the closing of the transaction.
Section Fou . The General Manager of the District is authorized to expend up to $5,000 to cover the
cost of title insurance, escrow fees, and other miscellaneous costs related to this transaction.
Section Fiv . It is intended, reasonably expected, and hereby authorized that the District's general fund
will be reimbursed in the amount of$950,000.00 from the proceeds of the next long-term District note
issue. This Section of this Resolution is adopted by the Board of Directors of Midpeninsula Regional
Open Space District solely for purposes of establishing compliance with the requirements of Section
1.103-18 of the Treasury Regulations. The reimbursement of this payment expenditure is consistent
with the District's budgetary and financial circumstances. There are no funds or sources of moneys of
the District that have been, or are reasonably expected to be, reserved or allocated on a long-term
basis, or otherwise set aside to pay the costs of this open space land acquisition project which are to be
paid or reimbursed out of proceeds of indebtedness to be issued by the District. The Board of Directors
hereby declares the District's official intent to use proceeds of indebtedness to reimburse itself for this
open space land acquisition project expenditure.

DISCUSSION
The Habitat Conservation Fund (HCF) provides $2 million annually to the California
Department of Parks and Recreation for a statewide grant program. This program provides
50% matching grants to local agencies so they may acquire, restore, or enhance wildlife
habitat, or make available trails and programs that bring urban residents into park and wildlife
areas. The application deadline for this funding cycle is October 1, 1999, and project selection
will occur by the end of January 2000. The District is considering submitting two applications
for this funding cycle.
Funds are available for projects in six categories. Four of the six categories are funded each
year on a rotational basis. The first four categories listed below (in bold print) are eligible for
$500,000 each in fiscal year 1999-2000. More than one project application can be submitted
but a project can only be submitted in one of the four eligible categories, even though it may
qualify for more than one.

The project must start within three years of the date the grant funds are appropriated in the
State budget. Acquisition grants can be matched only by non-State money or property made
available as part of the acquisition project.

program, as summarized below.

Soquel Creek Headwaters Acquisition Project
The District is applying to the Habitat Conservation Fund Program in the Anadromous
Salmonids/Trout Habitat Category for a $500,000 matching grant for the Soquel Creek
Headwaters Acquisition (Loma Prieta Ranch) Project. The project consists of acquiring an
undeveloped 493-acre property located on the steep southwestern slopes of Mt. Loma Prieta in
Santa Cruz County. It contains the largest tributary in the headwaters of Soquel Creek. The
creek's redwood-shaded pools, runs, and riffles are important spawning and rearing habitat for
federally threatened Steelhead Trout. The year-round flow of cold, unpolluted water also
benefits the Steelhead and other native fish living downstream in Soquel Creek. This grant
application is based primarily on the importance of Loma Prieta Ranch in protecting this
headwaters creek as steelhead spawning habitat.
The project will also protect an area of exceptional biological diversity. The steep terrain
supports a variety of plant communities, ranging from hot, dry "true" chaparral and knobcone
pine forest at the higher elevations to cool, shady riparian and redwood forests at the bottom.
Animals on the property are equally diverse. Our wildlife consultant found a total of 32
species of mammals, 71 species of birds, 9 species of amphibian and 13 species of reptile, as
well as 25 orders of insects. The property is also prime deer/mountain lion habitat, and home
to six California Special Status Species and four locally rare species.
In addition to these outstanding resource values, Loma Prieta Ranch offers excellent
recreational benefits. Located in the heart of over 26,000 acres of protected lands, the area
feels wild and remote, even though it is relatively close to urban centers in San Jose and Santa
Cruz. The road through the property could become a critical link in a regional trail route from
the Sierra Azul ridgeline to the sea. It will help link the Bay Area Ridge Trail with Santa Cruz
County's Coastal Trail through the Soquel Creek Demonstration Forest and Forest of Nisene
Marks State Park.
In a separate action at your September 22, 1999, meeting, you are considering an assignment
of a purchase agreement to Peninsula Open Space Trust (POST) for the Loma Prieta Ranch
property, and an agreement for the District to manage the property for up to three years while
grant funding is investigated. As part of the agreement with POST, the District will keep the
site closed to the public. The District will maintain the existing roads, patrol regularly, and
investigate cooperative management agreements with other agencies.
Mills Creek Oren Space Preserve Acquisition Project
The District is applying to the Habitat Conservation Fund Program in the Rare, Threatened,
Endangered or Fully Protected Species Category for a $150,000 matching grant for the Mills
Creek Open Space Preserve Acquisition Project. The project consists of acquiring a portion of
the 280-acre Russian Convent of Our Lady of Vladimir, Inc. property located south of the
intersection of Skyline Boulevard and State Highway 92 in San Mateo County. The
acquisition is a result of the Settlement and General Release Agreement approved by the Board
of Directors on April 8, 1998 (see report R-98-89).
The project is located adjacent to Skyline Boulevard and overlooking Burleigh Murray Ranch
State Park, and consists of the acquisition and creation of the 165-acre Mills Creek Open
Space Preserve and an 87-acre open space easement. The property extends west from Skyline
Boulevard and includes a portion of a prominent 1,54- foot hilltop and ridgeline which forms
the headwaters of Mills Creek. The top of the hill and ridge have moderate to gentle slopes
that give way to very steep north, west, and south-facing sideslopes. Two tributaries of Mills
Creek encircle the ridge with the north tributary entering the property at the mid-point along
the northern boundary.
The grant application is based on the importance of protecting habitat or headwaters of habitat
used by species with special status listed by the State of California, the Federal Endangered
Species lists, and California Department of Fish and Game. The special status species for
which conservation of the habitat on this property is intended include: Townsend's western
big-eared bat, San Francisco dusky footed woodrat, Yuma myotis, summer steelhead trout,
loggerhead shrike, golden eagle, Cooper's hawk, sharp-shinned hawk, Swainson's hawk,
northern harrier, white-tailed kite, Yellow warbler, California red-legged frog, San Francisco
garter snake, and Monterey pine. The lands also provide important deer and mountain lion
habitat. These species were found and reported in a 1997 wildlife survey conducted by the
District, and an inventory prepared for the 1998 Draft Environmental Impact Report for the
Russian Convent.
The approximate 87-acre open space easement lies east of the District's fee parcel and south of
the proposed Convent development. It is bounded by the Convent property to the north, the
proposed 165-acre District property to the west, lands of Peninsula Open Space Trust to the
south and private properties to the east. The intent of the easement is to preserve the valuable
wildlife habitat, viewshed, and watershed as much as possible. Wildlife species are similar to
those found on the adjacent 165-acre property described above. Summer Steelhead Trout were
found near the open space easement in the southern tributary of Mills Creek and are likely to
be on the property during the winter and spring when there is more water in the creek.
CEOA COMPLIANCE
At this same meeting, the Board of Directors is considering approval of a categorical
exemption for the assignment of a purchase agreement to Peninsula Open Space Trust for the
Loma Prieta Ranch property and a management agreement whereby the District agrees to
manage the property for POST. The project provides for the eventual acquisition of the
property by the District or transfer of the property to the State of California for inclusion into
the Forest of Nisene Marks State Park.
The acquisition of the Mills Creek Open Space Preserve and an adjacent open space easement
was previously determined to be categorically exempt by the Board of Directors on June 24,
1998, as part of the approval of the Subsequent Settlement Agreement Documents and Related
Implementing Agreements for the Proposed Acquisition of the Russian Convent of Our Lady
Of Vladimir, Inc. Property (see report R-98-89).

DISCUSSION
Section 1.90 of the Board's Rules of Procedure and Section 6.2(d)of the Personnel Policies and Procedures
Manual both state that if a paid holiday falls on a Saturday,the holiday shall be observed on the preceding
Friday,and if a paid holiday falls on Sunday,the holiday shall be observed on the following Monday.
This year,the Christmas Eve holiday falls on a Friday and the Christmas Day holiday falls on a Saturday.
District policies dictate that the Christmas Day holiday should therefore be observed on Friday,but they are
silent as to when the Christmas Eve holiday,which otherwise would be observed on Friday,should be
observed if the Christmas Day holiday is observed on Friday. Although not specifically addressed in District
policies and procedures,the ordinary practice would be to push the Christmas Eve holiday back to Thursday,
December 23.
At your November 12, 1997 meeting,you approved the closure of the administrative office each year during
the week containing the Christmas Eve and Christmas Day designated District holidays(see report R-97-151).
Under the existing holiday structure and closure practices,the Christmas Day holiday would be observed on
Friday,December 24,the Christmas Eve holiday would be observed on Thursday,December 23, and the
administrative office closure days would be Monday,Tuesday, and Wednesday, December 20,21, and 22.
Furthermore, since the New Year's Day holiday falls on Saturday, January 1, it will be observed on Friday,
December 31.

In order to provide a more continuous and practical holiday closure experience,the recommended schedule for
this year's Christmas holidays is to observe the Christmas Eve holiday on Friday,December 24,and the
Christmas Day holiday on Monday, December 27. The year-end administrative office closure week would
occur during the week of December 27 through December 31. December 27 would be the designated
Christmas Day holiday,and December 31 would be the designated New Year's Day holiday,since the actual
holiday falls on a Saturday. Tuesday, Wednesday,and Thursday, December 28,29,and 30, would be the
administrative office closure days.
The revised holiday schedule and administrative office closure would apply only to the administrative office
staff. Bargaining unit employees would adhere to the designated holiday schedule in Section 11.IA. of the
Memorandum of Agreement with SEIU Local 715,which designates December 23 as the Christmas Eve
holiday and December 24 as the Christmas Day holiday. Supervising rangers would adhere to the existing
non-bargaining unit holiday schedule,observing Christmas Eve on December 23 and Christmas Day on
December 24. Area Superintendents would observe the same holiday schedule as the administrative office
staff(the proposed December 24 Christmas Eve holiday and December 27 Christmas Day holiday),although
they do not participate in the administrative office closure.
As in past years,administrative office employees would be able to use accrued leave time to take the
December 28,29,and 30 closure days off,or, if desired,they could choose to work any or all of the three

After finalizing specifications, staff solicited competitive bids from chipper dealers. Bid packets
were sent directly to two dealers and a notice was placed in the San Jose Mercury News. The
following two bids were received:
1) Cal-Line Equipment $24,262.07 (including tax)
2) Bandit Industries $26,852.72 (including tax)
Cal-Line Equipment's bid met the District's specifications and was the lowest responsive bidder.
Cal-Line was the low bidder on a past chipper bid for the District. Staff has found Cal-Line
Equipment to be a qualified and responsible chipper dealer.
The approved fiscal year 1999-2000 budget includes $20,000 for the purchase of this chipper.
Because of new improvements that enhance the safety and functionality of chipper equipment,
staff anticipated bids of approximately $24,000. The additional amount required will be made
available by foregoing lower priority equipment purchases planned for this year.

SUMMARIES OF SIGNIFICANT INCIDENTS
Aug.2: An intoxicated and possibly mentally disturbed person was found at the intersection of
Alpine Rd. and Skyline Blvd. Earlier he had made unauthorized entry (unlocked back door)
to the Nature Center and used the phone. San Mateo sheriff's deputy responded. The
individual was released to a family member. D. Sanguinetti, L. Hyman.
Aug. 6 & The remains of a large beer party and bonfire were discovered on Aug. 6 and again on Aug.
Aug. 18: 18 at Purisima OSP. These were similar to a party that had been discovered in late July.
San Mateo Sheriff's Office has been asked to increase patrols on weekend nights. L.
Paterson, F. Olson, J. Menk.
Aug, 7: A Stevens Creek County Park ranger requested mutual aid assistance for two uncooperative
visitors. K. Carlson responded and aided the ranger in gaining identification.
Aug, 14: An abandoned vehicle in Sierra Azul was reported to K. Miller. He determined the vehicle
was stolen and California Highway Patrol was requested. CHP handled the recovery.
Aug, 18: One of the largest search efforts ever conducted on District land was initiated at Skyline
Ridge OSP on August 18, 1999. Ground search teams and dog teams from seven California
counties participated in the search for an overdue 68-year-old male hiker. San Mateo county
Sheriffs Office/Office of Emergency Services (OES) coordinated the effort. A helicopter
from East Bay Regional Park District and fixed-wing aircraft from SMSO and San Joaquin
counties carried on aerial searches. A scuba diving team searched Alpine and Horseshoe
lakes. The Skyline Ranger Office was used as the Incident Command Center.
The search was conducted over four `operational periods' of twelve hours each. Incident
Command teams rotated each operational period. The search area covered most of the South
Skyline Area and Portola State Park. District staff from Foothills and Skyline participated in
the search by filling key roles, such as search team liaisons and in the incident command
structure. A main office staff person was assigned as public information officer.
A more intense grid-search technique was begun, and the hiker, a San Jose resident and
frequent Skyline preserves visitor, was found deceased at 10:38 a.m. on August 20, 1999.
He was found under an oak tree just off the Ridge Trail, near the vista point. He was
approximately one mile from his vehicle. The cause of death appeared to be natural.
Aug, 22: A fatal vehicle accident occurred on Hicks Road that resulted in a fire. It burned five acres
of Sierra Azul OSP. K. Carlson and J. Smith were first on scene. CDF and San Jose Fire
responded. T. Randall and K. Miller also were assigned to the incident.
Aug, 29: Two cyclists were cited for riding cross-country through the burn area at Russian Ridge.
There has been an increase of off-trail riding in the burn area. W. Phillips.
Vandalism Incidents:
Aug, 1: One lock was cut and a door kicked open at the airbase in Sierra Azul.
Aug. 7: Several epithets directed at rangers were scratched into a Grabtown Trail closure barricade at
Purisima Creek OSP. They included 120 to kill a ranger" and "I hate rangers - waste of tax
$." The barricade has been in place for two years. It is uncertain when the vandalism took
place. L. Paterson.
Aug, 7: T. Randall found the remains of a small campfire next to a gate in Sierra Azul. The fire
hazard and fire lane signs had been removed. The signs were replaced.
Aug, 17: A regulation sign at Windy Hill OSP was scratched and pitted, possibly shot with pellets.
Aug, 17: Two District docents discovered a 10' x 15' area of graffiti on the sandstone formation in El
Corte de Madera OSP. Most of the damage was removed with a wire brush. B. Malone.

As you know,the Midpeninsula Regional Open Space District often applies for grants in order to leverage its
property tax revenue and maximize the effectiveness of the public's investment in open space projects. In the past,you have
kindly supported these grant applications,and I thank you for that support. Once again,we are applying for funding,and
once again we would like to ask you to take a few moments to send a letter of support. I'd like to assure you that such letters
are indeed of great value in the grant application process, and can make the difference in whether or not a grant application is
successful.
The District is currently applying for a$29,950 Recreational Trails Program(RTP)grant in order to construct a 1.5-
mile segment of the Bay Area Ridge Trail at its Long Ridge Open Space Preserve.This grant program was formerly known as
the National Trails Act Fund Program of 1991,but has been renamed and funded as part of the 1998 Transportation Equity
Act for the 2 1"Century(TEA-21). Since the"new"program funds are no longer subject to annual appropriations which often
resulted in dire under-funding of the program,we have before us a great opportunity to provide the public with a new regional
trail connection.
Construction of this trail will provide a hiking-and equestrian-only alternative to an existing,parallel Ridge Trail
segment.District patrol staff and visitors have frequently expressed concern with the high level of mountain bike usage on
the existing segment. Provision of this new,parallel alignment along the Skyline corridor will allow hikers and
equestrians the opportunity to avoid these multiple-use issues, and have a safer and more enjoyable visit, while providing
a connection to other regional public lands and trails. This effectively meets one of the key criteria of the RTP, that of
providing for diversified trail use within a recreational trail corridor. This will be an exceptional trail,meandering through
mixed evergreen forest on the upper slopes, to redwoods in the damp, lower areas of the canyon, and offering dramatic
views of Butano Ridge and the Pacific Ocean from a grassy meadow bordering the Skyline Boulevard frontage.This new
link from District lands in the South Skyline area to the Skyline-to-the-Sea Trail and State park lands will greatly enhance
visitors' experience and opportunities.

unpolluted water also benefits the Steelhead,Pacific Sculpin,Three-spined Stickleback, and Pacific Lamprey living in
Soquel Creek. These factors make this acquisition suitable for grant funds in the Anadromous salmonids/trout habitat
category. The steep terrain supports a variety of plant communities,ranging from undisturbed "true" chaparral and
knobcone pine at the higher elevations to riparian and redwood forests at the lower. Animals here are equally diverse, and
include 32 species of mammals, 71 species of birds, 9 species of amphibian, and 13 species of reptile, as well as 25 orders
of insects. The land is prime deer/mountain lion habitat and home to several California Species of Special Concern.
In addition to these outstanding resource values, Loma Prieta Ranch offers excellent recreational benefits. The
road through the property could become a critical link in a route from the summit of Mt. Loma Prieta to the sea. It will
help link the Bay Area Ridge Trail with Santa Cruz County's Coastal Trail. Less than a mile north of the property is the
District's Sierra Azul Open Space Preserve, and to the south is Soquel Demonstration State Forest and Forest of Nisene
Marks State Park. Together these public lands total over 26,000 acres.

RE: Power of Eminent Domain
On November 12, 1998 I. and others from the Coastside, addressed the board.
We expressed our desire for an Open Space District to protect the area; but our
ardent opposition to the Power of Eminent Domain. In most arenas of honest
disagreement there is a small window of time in which to reach a win-win
agreement. During the break, at that meeting, several Board Members asked if I
would put into writing my verbal assurances of support for MROSD if MROSD
would only drop the Power of Eminent Domain.
In the intervening time, three events have occurred at the meetings of MROSD's
Coastal Advisory Committee:
• A presentation by David Hansen on July 27 demonstrating that MROSD
would be far more effective if it adopted Sonoma's status as not having the
Power of Eminent Domain
• A presentation by Norman Matteoni, Esq., demonstrating that a "policy"
provided no protection from the Power of Eminent Domain
• And at the last meeting Director Hanko's comments that she would support
the dropping of the Power of Eminent Domain.
It therefore seems appropriate that 1, and others who are currently circulating
petitions, express our support for the annexation of the Coastside by
MROSD if it will act to make the dropping of the Power of Eminent
Domain a reality!
I would request that the Board place on the agenda of its next meeting a
Resolution authorizing a request of the State legislator for "friendly" legislation,
supported by all parties with standing, to amend the Public Resuorces Code
{Sec 5500-5595} eliminating MROSD's Power of Eminent Domain. [5563.5
demonstrates an understanding of the process by MROSD]

GOVERNOR DAVIS SIGNS BILL PLACING $2.1 BILLION
PARK BOND ON MARCH 2000 BALLOT
LOS ANGELES—Taking a historic step to restore that which is irreplaceable,Governor Gray Davis
today signed legislation,AD 18 by Assembly Speaker Antonio Vill2raigosa(D-Los Angeles)and
Aminbly Speaker pro Temport Fred Keeley(D-Boulder Creek),authorizing the Villaraigosa-
Keeley Safe Neighborhood Parks,Clean Water and Coastal Protection Bond Act of 2000 to be placed
on the March 2000 ballot.
"Since the beginning of our state parks system in 1964,California's public parks and open spaces have
stood as an outward symbol of our State's soaring soul and spirit. From the redwood forests of the
North to the coastal bluffs of the South,these are special places of grandeur and glory that belong to
us,the people of California, for all time to come,"Governor Davis said as he signed the bill in Will
Rogers Park in Pacific Palisades.
"For far too long, however,we have neglected these magnificent mileposts of California's natural
heritage. That ends today. On this day,we take historic steps to restore that which is irreplaceable-"
The$2.1 billion general obligation park bond, if approved by the voters,will provide California's first
opportunity in more than a decade to invest in local and state parks, clean water and coastal beaches.
The Bond Act also will provide funding to build and rehabilitate recreational, social and cultural
centers that serve youth, seniors and families in urban centers.
Among other things,the Bond Act will provide:
$544.7 million for rehabilitation and improvements to the state parks system
$826-5 million for grants to local agencies for urban parks,trails and recreational facilities
$45-8 million for river,parkway and land conservation
$277.5 million for acquisition of wildlife habitat and open space land
$220 million for protection of coastal areas,watersheds and wetlands
