MINUTES
PRESENT:ALAN CONKLIN, CHAIR; NICK MUTO, VICE CHAIR; TOM YONCE, CLERK;
GEORGE WALKER; STAN BART; NATE PULLING
ABSENT:TAD VAUTRINOT
Alan Conklin called the meeting to order at 7 : 02 PM.
The Board met with Nancy Ho to interview her for a position on the
Water Advisory Board. Following discussion, the following motion was
made.
MOTION:Stan Hart moved that the Board appoint Nancy Ho to the Water
Advisory Board.
VOTE: 6-0-0, unanimous
Paul informed Nancy Ho that she will have to be sworn in at the Town
Clerk' s office.
Public Hearing: Definitive Plan. Applicant - Dorofei Klimshuk.
Location - Portanimicut Road. Present: Dorofei Klimshuk. This
Public Hearing was continued from 9/27/94 . Since that date, concerns
of the Planning Board, noted in the minutes of 9/27/94, have been
addressed.
Because the access area is fairly flat, the applicant requested a waiver
of the requirement of showing the profile of the access area.
Also the applicant requested that the Board waive the 40 ' frontage
requirement for Lot 2 .
Following discussion, the following motion was made.
MOTION:Tom Yonce moved that the Board grant the waivers requested by
Dorofei Klimshuk for property shown on the plan entitled:
Definitive Subdivision Plan of Land in Orleans, MA. Prepared
for Dorofei Klimshuk, Scale: 1" = 40 ' , Dated October 25,
1988, Revised: October 18, 1994, by Nickerson and Berger,
Inc, Owner: Jane T. Klimshuk. The waivers being, one, for
the frontage requirement on Lot 2 and, two, the profile
requirement of the Subdivision Rules and Regulations . The
second waiver was requested because the land appears to
require no grading.
VOTE: 6-0-0, unanimous
MOTION:Nick Muto moved that the Board vote to approve the plan entitled:
Definitive Subdivision Plan of Land in Orleans, MA. Prepared
for Dorofei Klimshuk, Scale: 1" = 40 ' , Dated October 25,
1988, Revised: October 18, 1994, by Nickerson and Berger,
Inc, Owner: Jane T. Klimshuk.
VOTE: 6-0-0, unanimous
Planner' s Report
Paul reported to the Board the current events of Planning Office.
Preliminary Plan: Applicant - Winifred Fitzgerald. Location - Tonset
Road. Present: Winifred Fitzgerald, Larry Wilcox of Ryder and Wilcox.
This Preliminary Plan, showing a Panhandle Lot, was filed at the
Planning Office on 8/23/94, and the deadline for action on said plan
was extended from 9/15/94 to 10/25/94 . The reason for the extension
was so that the applicant could apply to the Board of Appeals for a
variance for lack of frontage. The variance was granted.
There is an existing paved driveway to an existing dwelling on Lot
1 . Both Lots 1 + 2 will share a portion of that drive, so another
curb cut will not be necessary. The panhandle portion of Lot 1 will
be the access area.
Paul has reviewed the plan, and recommended that the Board approve
the above-mentioned Preliminary Plan.
After discussion, the following motion was made.
MOTION:Stan Hart moved that the Board vote to approve a Preliminary
Subdivision Plan prepared for Winifred Fitzgerald, located
in Orleans, MA, Scale 1" = 30 ' , dated July 22, 1994, prepared
by Ryder and Wilcox.
VOTE: 6-0-0, unanimous .
ANR Plan: Applicant - Frank A. Besse Trust. Location - 6A. Present:
Larry Wilcox, Ryder and Wilcox. This plan proposes to subdivide Parcel
1 from Parcel 2 in order to convey Parcel 1 to (adjacent) MDM Realty
Trust so that company may use the new parcel in their parking lot
expansion.
Tom Yonce asked how this plan qualifies as an ANR. Following
discussion, it was determined that the definition of "ANR" in the
Subdivision Rules and Regulations should be reviewed.
Paul has reviewed this plan, and has recommended that the Board approve
it.
MOTION:Nate Pulling moved that the Board approve the ANR Plan prepared
for Frank A. Besse Trust, Scale 1" = 30 ' , dated 9/21/94,
by Ryder and Wilcox.
VOTE: 6-0-0, unanimous .

ANR Plan: Applicants - Philip and Maryann Benton. Location - Twinings
Lane. Present: Larry Wilcox, Ryder and Wilcox. This plan proposed
to combine 3 lots into 1 . Paul has reviewed this plan, and it meets
the rules and regulations . He recommended approval.
MOTION:Nick Muto moved that the Board approve the ANR Plan located
in: Orleans, MA, being a combination of Lots 28 + 33, as
shown on L.C.P. 7347J, and Lot 82 as shown on L.C.P. 7347L,
prepared for Philip and Maryann Benton, by Ryder and Wilcox,
Inc, scale: 1" = 30 ' , dated October 24, 1994 .
VOTE: 6-0-0, unanimous .
ANR Plan: Applicants - Richard and Ann Simmons. Location - Tides
End Lane. Present: Jill Clark, Shofield Bros, Inc. Jill Clark
informed the Board that this ANR Plan will create Lot 2B, (not buildable)
which will be conveyed to the Orleans Conservation Trust.
Paul has reviewed the plan, and recommended approval.
MOTION:Tom Yonce moved that the Board vote to approve the ANR Plan
prepared for Richard J. and Ann C. Simmons, scale: 1" = 20 ' ,
dated August 27, 1994, revised October 20, 1994, prepared
by Schofield Brothers of N.E.
VOTE: 6-0-0, unanimous
Minutes
MOTION: Stan Hart moved to approve the minutes of 10/11/94 .
VOTE: 4-0-2, Nick Muto and George Walker abstained.
