RESOLUTION NO. 17-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY
COUNTY, IDAHO, RATIFYING THE CANVASS RESULTS OF THE MUNICIPAL
ELECTION HELD ON NOVEMBER 7, 2017, FOR THE PURPOSE OF FILLING FOUR YEAR
TERMS FOR THREE OPEN CITY COUNCIL SEATS FROM SEVEN CANDIDATES; AND
OF FILLING A TWO YEAR TERM FOR ONE OPEN CITY COUNCIL SEAT FROM ONE
CANDIDATE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a municipal election was duly held on November 7, 2017, for the purpose of filling
four year terms for two open City Council seats from three candidates for the City of McCall; and
WHEREAS, the judges and clerks of the election have conducted the election and made their
return in the manner provided by law; and
WHEREAS, the City Council now desires to ratify the County Commissioner's canvass of the
votes and to declare the results of the election.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
McCALL, VALLEY COUNTY, IDAHO, as follows:
Section 1: ELECTION
The municipal election of November 7, 2017, was duly and regularly called, noticed, held, and
conducted, the votes cast, received and canvassed, and the returns thereof made in the time, form,
and manner required by law and by the ordinances, resolutions, and proceedings taken by the City.
Section 2: NOTICE OF ELECTION
Notice of the municipal election was duly and legally given prior to said election by the publication
of appropriate notice in the official newspaper of the City prior to the election, the first publication
being not less than twelve (12) days prior to the election, followed by additional notice being
published at not less than five (5) days prior to the date of the election.
Section 3: POLLS
The polls of the municipal election were opened at 8:00 o'clock A.M. on November 7, 2017, and
remained open continuously until closed at the hour of 8:00 o'clock P.M., at the polling place
designated by the County Clerk.
Section 4: QUALIFIED ELECTORS
Only persons who were, on November 7, 2017, qualified electors of the City, within the meaning
of Article 6, Section 2, Idaho Constitution, and Section 50-413, Idaho Code, eighteen (18) years
of age or older, citizens of the United States and of the State of Idaho and who had been bona fide
residents of the City for at least thirty (30) days preceding the election, duly registered to vote

therein, were permitted to vote at the municipal election, and no person qualified to vote at said
election was refused the right to vote.
Section 5: BALLOTS
The ballots used at the municipal election were in the form prescribed by law. A Sample Ballot
was duly and legally printed twenty-nine (29) days prior to said election. A Sample Ballot was
duly and legally published in the official newspaper of the City prior to the election, the first
publication being not less than twelve (12) days prior to the election, followed by additional
Sample Ballot being published at not less than five (5) days prior to the date of the election.
Section 6: CANVASS
After the polls were closed, the election officials immediately proceeded to count the ballots cast
at the election. The counting continued without adjournment until completed and the result
declared. The election judge and clerks thereupon certified the returns of the election to the County
Clerk, who presented the results to the County Commissioners on November 13, 2017. The Valley
County Commissioners, acting as a Board of Canvassers of Election, have examined the returns
of the election and have canvassed the returns and declared the results of the election.
For the four year terms for three open City Council seats:
The total number of votes cast at said election for Gail Bray:
Total votes cast 1767
For Gail Bray 46 2.60%
Total Ballots (people voted) 650 7.08%
The total number of votes cast at said election for: Robert S. Giles
Total votes cast 1767
For Robert S. Giles 411 23.26%
Total Ballots (people voted) 650 63.23%
The total number of votes cast at said election for Jared Hendee:
Total votes cast: 1767
For Jared Hendee 170 9.62%
Total Ballots (people voted) 650 26.15%
The total number of votes cast at said election for Melanie L. Holmes:
Total votes cast 1767
For Melanie L. Holmes 418 23.66%

For the two year term for one open City Council seat:
The total number of votes cast at said election for Colby Nielsen:

For Colby Nielsen 519 100%

Section 7: DECLARATION OF RESULTS
Upon canvass, it was found that the results for the four year terms for three open City
Council seats are:
Gail Bray Not Elected
Robert S. Giles Elected
Jared Hendee Not Elected
Melanie L. Holmes Elected
Robert Lyons Not Elected
Wayne March Not Elected
Thomas Sowers Elected
In accordance with the provisions of Idaho State Law, said Gail Bray is hereby declared to be Not
Elected to the position of City Council Member in accordance with Idaho State Law.

In accordance with the provisions of Idaho State Law, said Robert S. Giles is hereby declared to
be Elected to the position of City Council Member in accordance with Idaho State Law.
In accordance with the provisions of Idaho State Law, said Jared Hendee is hereby declared to be
Not Elected to the position of City Council Member in accordance with Idaho State Law.
In accordance with the provisions of Idaho State Law, said Melanie L. Holmes is hereby declared
to be Elected to the position of City Council Member in accordance with Idaho State Law.
In accordance with the provisions of Idaho State Law, said Robert Lyons is hereby declared to be
Not Elected to the position of City Council Member in accordance with Idaho State Law.
In accordance with the provisions of Idaho State Law, said Wayne March s is hereby declared to
be Not Elected to the position of City Council Member in accordance with Idaho State Law.
In accordance with the provisions of Idaho State Law, said Thomas Sowers is hereby declared to
be Elected to the position of City Council Member in accordance with Idaho State Law.
Upon canvass, it was found that the results for the two year term for one open City Council
seat is:
Colby Nielsen Elected
In accordance with the provisions of Idaho State Law, said Colby Nielsen is hereby declared to be
Elected to the position of City Council Member in accordance with Idaho State Law.
Section 8: OFFICERS AUTHORIZED
The officers of the City are hereby authorized and directed to take all action necessary or
appropriate to effectuate the provisions of this Resolution.
Section 9: RATIFICATION
The Council met following the election at the meeting place of the City Council, at 216 East Park
Street, McCall, Idaho, for the purpose of ratifying the canvass results of the election. Thereupon,
the results were entered in the minutes of the Council and proclaimed as final. The City hereby
ratifies all actions taken by the County in connection with the election, the publication of notice
thereof, the preparation and printing of ballots and sample ballots used at the election, and all other
matters connected therewith, are hereby in all respects ratified, approved, and confirmed.
PASSED and approved by the City Council of the City of McCall this 30 day of November, 2017.
