CITY OF MCCALL, VALLEY COUNTY, IDAHO 1,153.3 SQ. FT. ("CITY PROPERTY") TO BE UNDERUTILIZED; DECLARING THE INTENTION OF THE CITY COUNCIL TO EXCHANGE THE CITY PROPERTY FOR A PORTION OF AN ABANDONED RAILROAD RIGHT OF WAY OWNED BY THE McCALL-DONNELLY SCHOOL DISTRICT #421 LOCATED NE 1 /4 S W 1 /4 S W 1 /4, SECTION 9, T. 18 N., R. 3 E., B.M. CITY OF MCCALL, VALLEY COUNTY, IDAHO 1,945.6 SQ. FT. ("SCHOOL DISTRICT PROPERTY"), AND THAT SUCH EXCHANGE IS IN THE BEST INTERESTS OF THE CITY OF McCALL; DIRECTING THE CITY CLERK TO PUBLISH A SUMMARY OF THE ACTION TAKEN ON THIS RESOLUTION BY THE CITY COUNCIL IN THE OFFICIAL NEWSPAPER OF THE CITY OF McCALL; FIXING A TIME IN WHICH PROTESTS AGAINST THE PROPOSED EXCHANGE MAY BE FILED IN THE OFFICE OF THE CITY CLERK; FIXING A TIME WHEN SUCH PROTESTS SHALL BE HEARD AND CONSIDERED BY THE CITY COUNCIL; AND DIRECTING NOTICE THEREOF TO BE GIVEN. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO: WHEREAS, the City of McCall owns property located at NW1/4 NW1/4, Section 16, T. 18 N., R. 3 E., B.M. City Of Mccall, Valley County, Idaho 1,153.3 SQ. FT. ("City Property") that is a portion of an abandoned railroad right-of-way. A schematic of that property is attached hereto as Exhibit A; and WHEREAS, the City of McCall has general authority to manage real property owned by it in ways which the judgment of the City Council deems to be in the public interest; and WHEREAS, the McCall -Donnelly School District #421 owns property located at NE1/4 SW1/4 SW1/4, Section 9, T. 18 N., R. 3 E., B.M. City Of Mccall, Valley County, Idaho 1,945.6 SQ. FT. ("School District Property") that is a portion of an abandoned railroad right-of-way. A schematic of that property is attached hereto as Exhibit B; and WHEREAS, the City Property and the School District Property have equivalent values; and WHEREAS, the City of McCall intends to exchange the City Property for the School District Property as a straight through exchange without any additional consideration; and WHEREAS, the City Council has the power to sell, exchange or convey, by good and sufficient deed or other appropriate instrument in writing, any real property owned by the city which is underutilized or which is not used for public purposes; and Page 1 of 2 Resolution 17-23 Authorizing Exchange of Real Property with School District November 30, 2017 WHEREAS, Idaho Code §50-1401, et seq, provides the method by which real property shall be shall be sold, exchanged or conveyed; and WHEREAS, it is in the best interests of the City of McCall to exchange the City Property for the School District Property because the exchange allows the City of McCall to align a road and pathway. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO: 1. Declaration of Underutilization. The City Council declares the City Property to be underutilized. 2. Declaration of Intent to Exchange. The City Council declares its intention to exchange the City Property for the School District Property as a straight through exchange without any additional consideration. 3. Declaration of Best Interest. The proposed exchange of real property is in the best interests of the City of McCall. 4. Publication of Summary. The City Clerk is hereby directed to give notice of the action taken by the Council including the passage of this Resolution, of the time within which protests against the proposed exchange of properties may be filed, the date when such protests will be heard and considered by the City Council, and the method by which the City proposes to exchange the City Property for the School District Property, and said notice shall therein refer to this Resolution on file in her office for further information in regard thereto. Said notice shall be published in the official newspaper of the City of McCall. The Clerk shall cause the publication to be made at least fourteen (14) days before December, 14, which is the date set for the expiration of the filing of protests. She shall file in her office proof of publication of said notice. 5. Public Hearing. Protests against the proposed exchange of the City Property for the School District Property may be filed in the office of the City Clerk in writing on or before Thursday, the 28 day of December, 2017, at 5:00 p.m. At 6:00 p.m. on said day in the Council Chambers of City Hall, 216 Park St, McCall, ID 83638, such protests shall be heard and considered by the City Council.
