Members present: Robert Franklin, Donald Schieffer; Planning and Willis Kohnen. Motion by Donald DesLauriers, seconded by 21, 1976, as presented. Motion carried unanimously Mayor, Wayne Neddermeyer; Clerk, Donna Roehl; Councilmen, Arthur Theis, DesLauriers, William Reiser; Attorney Richard Zoning Administrator, Anne Dorweiler; Assessor Arthur Theis to approve the minutes of September 1. WILLIAM RUDOLPH Discussion of resignation of William Rudolph as Treasurer that had been accepted on September 21st. Motion by Wayne Neddermeyer, seconded by Robert Franklin to ask that Council reconsider motion of,September 21st. Motion carried unanimously Motion by Robert Franklin, seconded by Donald DesLauriers to decline accepting Mr. Rudolph's resignation and ask that he withdraw his letter of resignation. Motion carried unanimously 2. RANDY MAYER Motion by Robert Franklin, seconded by William Reiser to pay Randy Mayer one-half of 1976 clothing allowance for police or $37.50. Motion carried unanimously 3. STREET SWEEPER Donald DesLauriers reported that they had looked into a trade-in of the street sweeper on a sander and that $500 would be allowed on the sweeper. He suggested that it be kept as it would be worth the same amount next year and perhasps something else could be done with it. 4. KEY -WAY BUILDERS Motion by Robert Franklin, seconded by Arthur Theis to submit outstanding sewer and water bill of Key -Way builders to Hennepin County for placement on taxes along with previous certifications. Motion carried unanimously 5. FERN STREET HEARING ON ASSESSMENTS 8:10 P.M. John Cameron of McCombs -Knutson explained the procedure of the assessment, 500 assessable front feet without the State owned lots for an assessment of $141.60 per 60 foot lot. Eugne Dabrowski asked iahy:;0.0 State owned lots Were not assessed and Mr. Schieffer stated that the State does not pay such assessments but if property were sold, a like amount would be assessed against a private property owner. Mr. Dabrowski asked if any amount would be refunded at that time. Mr. Schieffer stated that refunds are not made but monies are kept for upkeep of the road. Charles Pangier asked why 14 lots were not assessed. Mr. Cameron stated that some of those lots were served by other streets. Mr. Pangier asked why the cut had been made so deep. Mr. Cameron said it was a 12% cut and should not have been more that 10%. Mr. Pangier reported that he had one tree destroyed and had reported it to the contractor. Mr. Cameron stated that he did not know that had happened and that Mr. Pangier should have reported it to them or the city. Mrs. Dabrowski asked if the assessments would be placed on taxes for just one year. Robert Franklin stated that it was at the descretion of the Council Motion by Donald DesLauriers, seconded by Robert Franklin to approve Resolution 76-40, regarding adoption of Fern Street Assessment Roll. Assessments to be divided over a 5 year period beginning January, 1977 at 7 and 3/4 % interest. Motion carried unanimously. 5 yes votes. 6. ROBERT SEARLES ��aa. Mr. Searles appeared on behalf of his candidacy for the state legislature and discussed t e State Aid for roads inadequacy, the Metro Council member selection and Hennepin County park land acquisition. Ala Mayor of Orono he related the concerns of Orono regarding a traffic problem in connection with the Vo Tech School and the sewage disposal problems that would need to be worked out. Robert Franklin asked what the status of their fire contract was with Long Lkke. Mr. Searles stated that he did not know but could secure the figures. 7. ANNE DORWEILER Medicine Lake Bus Co. Anne Dorweiler read memo and recommendations of Planning Commission regarding items that must be completed in connection with the Medicine Lake Bus Co. plans for an addition to their pres- ent garage in Hamel. Council reviewed site plans and discussed use and condition of Hamel Rd. and Pinto Dr., additional parking spaces needed and slope finishing requirements. Motion by Robert Franklin, seconded by Arthur Theis to approve site plan of Medicine Lake Bus Co. and because of nature of business grant a variance to require only 51 parking spaces and permit 3 off -curb cuts with following provisions according to amended site plans dated Oct.5, 1976. 1. Area between buildings to include right-angle parking on one side and parallel parking on other. 2. A11 parking spaces to be striped. 3. Stop signs and exit and entrance signs to be erected on Hamel Rd. 4. Bus Co. continue to use Hamel Rd. west and Pinto Dr. as access to property 5. Bussshall not be stored outdoors. 6. Drainage on east edge of building to be conducted by grass waterway 7. Cut -fill slopes on west edge be stabilized by seeding and west edge by sodding. 8. Bus Co. post bond of $10,000 for completion of blacktopping and landscaping, bond to be perpetual and work colikpleted by September 1, 1977. Motion carried unanimously Robert Bradley Land Division Discussion of Mr. Bradley dividing 50 acres into 4 parcels and whether or not road serving the property should be a village road. Motion by Robert Franklin, seconded by Arthur Theis to refer Bradley road situation to the Engineer and ask for a report on October 19th. Motion carried unanimously DENIS JORDAN LAND DIVISION Discussion of property Mr. Jordan wishes to divide and provide an easement for access to 5 acre parcel that would be landlocked. Donald DesLauriers inquired as to what Mr. Jordan intended to do with the remaining property. Discussion of condition of Chippewa Rd. Motion by Robert Franklin, seconded by Arthur Theis to table the matter and ask Mr. Jordan to attend a meeting and discuss his long range plans for the remainder of his property. Motion carried unanimously ZOning Administrator Office In City Hall Discussion of office furniture necessary to furnish an office for Anne Dorweiler to use at the City Hall. Anne stated that she would work 2 - 3 hours per day on Monday, Tuesday, and possibly Friday of each week and assured Council she would not be in office if there was no work to be done. Motion by Robert Franklin, seconded by Arthur Theis to autl.orize Anne Dorweiler to use office space in City Hall and to secure quotes on a desk, 2 chairs and a fileing cabinet. Motion carried unanimously 8. AUDITOR Motion by Robert Franklin, seconded by Arthur Theis to appoint Merrill Hanson as Auditor for the 1976 audit. Motion carried unanimously 9. BILLS Discussion of bills; Tom Loucks bill for work he has done on the Comprehensive Plan. Clerk reported that Mr. Loucks assured her that the work would be completed for $1000 as he had stated in his letter. 0 Motion by Robert Franklin, seconded by William Reiser to pay bills, except the bill of Tom Loucks for $ 118.86. Order checks #6280-6331 in the amount of $21,291.21 and payroll #4213-4239 in the amount of $4969.02. Motion carried unanimously 10. BUDGET Julius Dorweiler discussed with Council the Hamel Fire Department need of $16,500 to meet the 1977 budget. Medinna's share would be $11,815.65 and Corcoran's share $4684.35. Robert Franklin reported that Long Lake had requested approximately $8000; Maple Plain $1473; Loretto$15 per property or approximately $2360. This would mean the Fire Contract budget for 1977 would be approximately $23,800. Wayne Neddermeyer asked what had happened to the idea of Medina becoming owner of some of the Hamel fire fighting equipment. Mr. Dorweiler stated that if the 4 departments were to each receive a proportionate share of the budget they felt the equipment should remain the property of the Hamel Fire department until such time as they no longer operate as a volunteer unit. The following were suggested changes in the 1977 budget from the September 28th meeting: Now Change Engineer $1000 -$1500 Planning Consultant 1000 -1000 Fire Contracts 23,800 Recreation purchases 0 -2300 to be taken from park fund Tree inspecting 1000 +500 Police Salaries 42,800 -5110 PERA 5,145 - 605 PERA, Street Dept. & Clerk 1,600 +1600 Social Security " 1,700 +1700 Insurance, Street Dept. 2,000 +2000 Building, etc. 4,000 +4000 Workmen's Comp. 2,000 +2000 Total anticipated budget would now be $310,680. Motion by Robert Franklin, seconded by Arthur Theis to adjourn and hold a special meeting to finalize the budget on Monday, October 11, 1976 at 8:00 P.M.
