PLANNING BOARD
4/26/94
MINUTES
PRESENT:RICHARD PHILBRICK, CHAIR; ALAN CONKLIN, VICE CHAIR; TOM YONCE,

Informal discussion with Attorney Chris Miner regarding property own
by Mrs. Margaret Allard, Quanset Road, Map 8, Parcel 1636. Attorney
Miner met with the Board in order to obtain a preliminary reading of
the Board' s position with respect to subdividing the above-mentioned
parcel into two lots pursuant to Orleans Zoning Bylaw Section 164-22 (5) .
Panhandle Lots .
This lot consists of 4 . 15 acres with 192 ' of frontage, and Mrs . Allard
wishes to divide the one lot into two. It is likely that the applicant
would propose to divide the property in a way that would create one
panhandle lot with 42 ' of frontage, and another lot which would have
150 ' of frontage. Approximately 2/3 of this entire lot is located
in the Rural Business District.
After some discussion it was the consensus of the Board that, if the
panhandle subdivision were to be submitted and approved, the lots should
be restricted to one dwelling each.

Continued hearing John O. Tovrov, Blue Rock Road, Assessor' s Map 29,
Parcel 2382-1 This hearing is continued from 3/22/94 . The Town
Planner noted that there had been some outstanding concerns regarding
this plan. One pertained to the turn-around area. This area was
addressed in a revised Plan and Profile dated 3/15/94, prepared by
Peter Soule. Mr. Soule noted that this turn-around area would be
cleared of trees and brush and hardened.
Another concern pertained to the adequacy of the leaching drainage
system. Paul had visited the site with engineer Stephen Haas, and
Mr. Haas indicated that the proposed drainage system would accommodate
drainage.
The third concern pertained to the adequacy of the lot to accommodate
a reserve site for an on-site disposal system. A variance from the
Board of Health regulations to eliminate a reserve area may be required.
The Board of Health has scheduled discussion on this subject the first
week in May. Paul Halkiotis recommended that the hearing be continued
until the Planning Board receives comments from the Board of Health.

The Board discussed the adequacy of the access way, Blue Rock Road,
and it was decided that the Board will plan to go out on a site inspection
to that road on 5/4/94 .
Near-by resident, Arch Johnston, said that Blue Rock Road is ideal
the way it is, and that it is adequate to serve the proposed lots .
Vince 011ivier, there on behalf of the Orleans Conservation Trust,
said that the number of bedrooms in the potential houses should be
considered when determining if Blue Rock Road provided adequate access .
Mr. 011ivier also said that there may be an endangered species in
Duck Pond, and if there is, then he will ask for an environmental review.
After further discussion, it was the consensus of the Board to continue
this hearing until 6/14/94 at 7 : 15 PM, in order to allow time for the
Board of Health to communicate with the Planning Board.

Planner' s Report
Paul Halkiotis told the Board that the Public Hearing for the
Conservation, Recreation and Open Space Plan will be held on 5/12/94
at 7 : 00 PM in Orleans Town Hall, Meeting Room A.

Public Hearing - Scenic Roads Act - Fisher Way and Barley Neck Road,
Bill Marsh, Applicant. Clerk Tom Yonce read the legal ad, which
appeared in both the 4/8/94 and 4/15/94 issues of The Cape Codder,
and the Public Hearing was opened.
This tree hearing was for 2 5" DBH cedar trees that have already been
cut down. These trees were mistakenly cut down last fall. They were
removed to improve clear site distance, an issue that the Town Planner
had raised last fall when discussing the subdivision with Mr. Marsh.
Tree Warden, Richard Gould told the Board that he would have recommended
that these trees be cut down. Mr. Gould also noted that there is no
curb-cut application necessary when building a subdivision. Curb-cut
applications come with a list of scenic roads - subdivision approvals
do not; therefore, the subdivision applicant is not informed as to
whether or not a road is scenic. He suggested that applicants of
subdivisions be issued a list of scenic roads .
MOTION: Nick Muto moved to authorize the removal of 2 5" cedar trees
from the corner of Fisher Way and Barley Neck Road. Tom Yonce seconded
the motion.
VOTE: 5-0-0, unanimous .
