AFFIDAVIT OF PUBLICATION

J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated has
been the vice president and printer of the newspaper known as The Wayzata -Plymouth Sun
and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in
the English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least
once each week. (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements. (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-class
matter in its local post -office. (5) Said newspaper purports to serve the City of Wayzata and
the Village of Plymouth in the County of Hennepin and it has its known office of issue in the
City of Wayzata in said county, established and open during its regular business hours for the
gathering of news, sale of advertisements and sale of subscriptions and maintained by the
managing officer or persons in its employ and subject to his direction and control during all
such regular business hours and devoted exclusively during such regular business hours to the
business of the newspaper and business related thereto. (6) Said newspaper files a copy of each
issue immediately with the State Historical Society. (7) Said newspaper has complied with all
the foregoing conditions for at least two years preceding the day or dates of publication mentioned
below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1,
1969 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating that
the newspaper is a legal newspaper.
He further states on oath that the printed Ordinance No. 140
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for one successive weeks;
that it was first so published on Thum the 16th day of Her , 1972
and was thereafter printed and published on every - - to and including
the day of 19 and that the following is a printed copy
of the lower case alphabet from A to Z, both inclusive, and is hereby acknowledged as being
the size and kind of type used in the composition and publication of said notice, to -wit:

ORDINANCE NO. 140
AN ORDINANCE REGULATING TIIE
BURNING AND INCINERATING OR
REFUSE IN THE VILLAGE OF MEI)I-
NA, MINNESOTA.
The Village Council of the Village of
Medina does hereby amend Chapter V of
the 1965 Code of Ordinances of the Village
of Medina by adding a section as follows:
Section 545 — Burning of Refuse
Section 545:00. Definitions. As used
herein. the following terms shall have
the meanings ascribed to them by this
section.
,ai "Open burning' shall mean the
burning of any matter where by the
resultant combustion products are
emitted directly to the open atmos-
phere without passing through an ade-
quate stack. duct or chimney.
i b , "Refuse" shall mean and include
garbage. trash. rubbish. household
wastes. trade wastes. salvageable
material and agricultural wastes.
c, "Refuse originating from a
dwelling unit" shall mean and include
household rubbish such as paper prod-
ucts and other combustible materials,
leaves and other natural matter ema-
nating from a dwelling unit. but not in-
cluding garbage and other putrescible
wastes.
,d: "Salvage Operation" shall mean
any business. trade industry or other
activity conducted in whole or in part
for the purpose of salvaging or reclaim-
ing metals or chemicals or other prod-
ucts or materials.
Section 545:05. Open Burning. No per-
son shall dispose of refuse by open
burning, or cause. suffer. allow or
permit open burning of refuse except as
hereinafter permitted. No person shall
conduct. cause or permit the conduct of
a salvage operation by open burning.
Section 545,10. Exceptions. The fol-
lowing exceptions from the open burn-
ing prohibition shall be permitted:
,a: When approved by a representa-
tive of the Minnesota Pollution Control
Agency and by the local fire chief or
other person designated by the Village
Council and approved by the Pollution
Control Agency, to perform such
duties:
2, Fires set for purposes of fire-
fighting instruction.
i2 , Fires set for purposes of thaw-
ing ground or heating for construc-
tion work or underground utility re-
pair
,3: Fires set for control of Dutch
Elm disease.
,b, When approved by the local fire
chief or other person designated by the
Village Council and approved by the Pol-
lution Control .Agency to perform such
duties:
I Fires set for elimination of a
fire hazard that cannot be abated by
other practicable means.
,2 Fires set for forest or game
management in accordance with
practices recommended by the Min-
nesota Department of Natural Re-
sources. the Minnesota Department
of Agriculture or the United States
Forest Service.
i3: Fires set for burning of trees.
brush. grass and other vegetable
matter in the clearing of land. right-
of-way maintenance or agricultural
crop burning. provided, however.
that. unless an exception is granted
by the approving authority. such
fires shall not be set so that prevail-
ing winds carry the smoke toward
and within 1.000 feet of any public
road or any occupied residence on
anther's property.
cFires set for disposal of refuse from
a dwelling unit on premises of that dwell-
ing unit. in areas of fewer than 100 dwell-
ing units per square mile. which areas
shall he determined by resolution by the
Village Council with the approval of the
Minnesota Pollution Control Agency.
,d: Nothing herein shall be construed
as preventing the normal use of furnaces.
stoves or other heating devices used to
warm residences. outbuildings or com-
mercial structures. or the normal use of
fireplaces or other devices for outdoor
cooking.
e , Exemption to conduct open burning
under provisions of this ordinance does
not excuse a person from the consequenc-
es. damages or injuries which may result
therefrom.
Sc: tier Commercial Incinera-
tors. Na person shall operate an incinera-
tor partly or wholly for profit within the
Village.
Section 545:20. Penalties. Any person vio-
lating any provision of Section 545 shall be
guilty of a misdemeanor.
This ordinance shall be effective upon
publication.
