Lake Street Wayzata, Minnesota State of Minnesota County of Hennepin Jt SS. J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The Wayzata -Plymouth Sun and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. (5) Said newspaper purports to serve the City of Wayzata and the Village of Plymouth in the County of Hennepin and it has its known office of issue in the City of Wayzata in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with al.l the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1969 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper. He further states on oath that the printed Ordinance No • 138 hereto attached as a part hereof was cut from the columns of said newspaper, and was printed and published therein in the English language, once each week, for one successive weeks; that it was first so published on Thttre the 3°th day of SeFt , 19 yl and was thereafter printed and published on every to and including the day of , 19 and that the following is a printed copy of the lower case alphabet from A to Z, both inclusive, and is hereby acknowledged as being the size and kind of type used in the .composition and publication of said notice, to -wit: abcdefghij klmnopgrstuvwxyz abedefghijklmnopgrstuvwxvz ' Subscribed and sworn to before me this 30th day of 0Pt 19L_ (Official Publication) ORDINANCE NO. 138 AN ORDINANCE AMENDING SECTION 1000 OF THE MEDINA VILLAGE CODE RELATING TO LICENSES — INTOXICATING LIQUOR THE VILLAGE COUNCIL OF THE VIL- LAGE OF MEDINA DOES ORDAIN: That Section 1000 of Chapter X of the Medina Village Code be amended to read as follows: Section 1000:05. License Required. ' Subdivision 1. No person. except whole- salers or manufacturers to the extent authorized under state license, shall di- rectly or indirectly deal in. sell or keep for sale anv intoxicating liquor without first having received a license to do so as provided in this ordinance. Licenses shall be of four kinds: "on sale". "off sale". "club licenses", and "Sunday sale". Subdivision 2. "0n sale' licenses shall permit "on sales" of liquor only. Subdivision 3. "Off sale" licenses shall permit "off sales" of liquor only. Subdivision 4. Special licenses shall be issued only to duly incorporated clubs which have been in existence for 20 years. Subdivision 5. "Sunday sale" licenses shall be granted only to hotels or restau- rants as the same are defined in Minneso- ta Statutes. Laws of 1967, Chapter 19, Sec- tion 1, which hotels or restaurants have facilities for serving not less than 30 guests at one time. Said "Sunday sale" licenses shall permit the sale and con- sumption of intoxicating liquors on the licensed premises only and between the hours of 12:00 noon and 12:00 midnight on Sundays in conjunction with the serving of food, but no liquor shall be served on Sun- days other than to persons whoare seated at tables in those types of hotels or res- taurants which qualify for the "Sunday sale" license as hereinabove provided for. Section 1000:10 Application for Li- cense. Subdivision 1. Every application for a license to sell liquor shall be verified and filed with the village clerk. It shall state the name of the applicant, his age. repre- sentations as to his character, with such reference as may be required, his citizen- ship. whether the application is for "on sales' or "off sales", the business in connection with which the proposed li- cense will operate and its location, wheth- er applicant is owner and operator of the business, how long he has been in that business at that place, and such other in- formation as the Council may require from time to time. In addition to contain- ing such information. each application for a license shall be in the form prescribed by the liquor control commissioner. No person shall make a false statement in an application. Subdivision 2. Each application for a license shall be accompanied by a surety bond, liability insurance policy, or in lieu thereof, cash or United States Govern- ment bonds of equivalent market value as provided in Minnesota Statutes 1945. Sec. 340.12, except that the liability insurance policy provided for in Laws 1945, ch. 313. and embodied in the fourth paragraph of Sec. 340.12 shall not be acceptable. Such surety bond or other security shall be in the sum of $3,000.00 for an applicant for an on -sale license and $1,000.00 for an ap- plicant for an off -sale license. A surety bond shall accompany each application for a "Sunday sale" license: however. such bond requirement may be met by either a separate bond or by the inclusion thereof in an existing or contempora- neously submitted "on sale" bond when accompanied by a proper endorsement, certificate, or other evidence of such in- clusion. Subdivision 3. The security offered under Subdivision 2 shall be approved by the Village Council and in the case of ap- plicants for off -sale licenses by the state liquor control commissioner. Surety bonds and liability insurance policies shall be approved as to form by the vil- lage attorney. The operation of such off - sale, on -sale, or Sunday -sale liquor busi- ness without having on file at all times with the municipality an effective bond. insurance policy or other security as re- quired in Subdivision 2 shall be grounds for immediate revocation of the license. Section 1000:15. License Fees. Subdivision 1. Each application for a license shall be accompanied by a receipt from the village treasurer for payment in full of the required fee for the license. All fees shall be paid into the general fund of the municipality. Upon rejection of anv application for a license, the treasurer shall refund the amount paid. Subdivision 2. All licenses shall expire on the last day of June of each year. Each license shall be issued for n period of one year except that if a portion of the license year has elapsed when the application is made, a license may be issued for the remainder of the year for a pro rata fee.
