HomeMy Public PortalAbout121 Affidavit of PublicationAFFIDAVIT OF PUBLICATION ORDINANCE NO. 121 An Ordinance Amending Chapter IV of the Building, Platting and Zoning Code, Section H Relat- ing to the Number of Members on the Planning Commission The Village Council of the Vil- lage of Medina Does Ordain: That the Building, Platting and Zoning Code, Section H designat- ed Planning Commission Section I be amended to read as follows: Section I, Appointment and Or- ganization. A zoning and planning commis- sion is hereby established and vested with such administrative authority as is hereinafter pro- vided and provided by the laws of the State of Minnesota. The commission shall consist of nine (9) citizen free -holders who have been residents and taxpayers of the Village of Medina for the last five (5) years. Each member shall have the right to vote on all mat- ters before the commission. The nine citizen members shall be ap- pointed by the Village Council. The commission shall serve with- out compensation other than such compensation as its members may receive for other services per- formed for the Village of Medina. Each citizen member shall be appointed for a term of three (3) years. The citizens who are mem- bers of the commission on the effective date of this ordinance shall continue to be and act as members of the commission until the expiration of the term of which they were originally ap- pointed. Any citizen may be re- moved by two-thirds (%) vote of the Village Council. The Clerk of the Village Council shall act as Secretary of the commission and the Village Attorney shall act as Legal Counsel for the commis- sion. Van Sloun, being duly sworn, on oath says he is and during all the times herein stated has been the General Manager - printer of the newspaper known as The Wayzata ,North Shore Minnetonka Herald and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in news- paper format and in coltimn ! and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each. week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the com- munity which it purports to: serve and does not wholly duplicate any other publication and is not made up entirely of_ patents, plate matter and; advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. (5) Said newspaper purports to serve the City of Wayzata, in the County of Hennepin, and it has its known office of issue in the City of Wayzata, in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in his employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the General Manager of said newspaper and sworn to before a notary public stating that the news- paper is a legal newspaper. He further states on oath that the printed Ordinance No. 121 hereto attached as a part hereof was cut from the columns of said newspaper, and was printed and published therein in the English language, once each week, for 1 successive weeks; that it was first so published on_Thursday the 2_9 day of June 19 67 and was thereafter printed and published on every to and including the day of , 19 and that the following is a printed copy of the lower case alphabet from A to Z, both inclusive, and is hereby acknowledged as being the size and kind of type used in the composition and publication of said notice, to -wit: abcdefg Subscribed and sworn tbefore me this 29 day of 19 67.
