The Council of the City of Medina met in regular session on Tuesday October 6, 1981 at 251
7:35 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, Thomas Crosby, William Reiser,
Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator,
JoEllen Burr; Public Works Director, Ronald Duran; Police Chief, Charles Hoover;

1. MINUTES OF SEPTEMBER 15, 1981
Donna Roehl stated that Planning and Zoning Item 10, page 243 should include adoption of
Resolution 81-46, approving construction of Larry Boisclair wind generator.
Page 244, Woodlake Sanitary landfill item was considered by the "Solid Waste Advisory Committee.
Motion by Reiser, seconded by Scherer to approve minutes of September 15, 1981, as amended.

Item 3, Medina Morningside Easements, page 246, delete"held in escrow" in text and motion
and add "paid to Mr. Keller when bond proceeds are available" in motion.

2. PUBBLIC WORKS DEPARTMENT
Minnegasco
Motion by Scherer, seconded by Crosby to adopt Resolution 81-49, allowing Minnegasco to bury
cable on Kilkenny Lane.

Hamel Sidewalk Special Assessments
Motion by Scherer, seconded by Crosby to adopt Resolution 81-50, approving the Hamel Side-
walk Special Assessment roll as presented with interest at 12 % for 10 years.

Unpaid Utilities
Council reviewed list of unpaid utility bills and asked that Donna Roehl contact Rolling
Green Country Club and request that someone from the organization attend the October 20th
council meeting to discuss their bill.
Motion by Lutz, seconded by Crosby to adopt Resolution 81-51, approving certification of
unpaid utility bills payable in 1982 with an 8% interest rate.

Heavy Equipment Operators School
Motion by Scherer, seconded by Lutz to authorize the attendance of Ron Duran, Robert Dressel
and James Dillman at a Heavy Equipment Operators School on October 26 and 27 at a fee of
$50.00 each.

3. POLICE DEPARTMENT
City of Loretto Contract
Chief Hoover reported that he had presented the Police Budget to the Loretto City Council
with a request for $14,000 from them for 1982. Loretto's Council then offered $12,000.
William Reiser stated that he would attend their November City Council meeting to discuss
the budget with them.
4. COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
Motion by Reiser, seconded by Scherer to hold a Public Hearing on Tuesday, November 3, 1981
at 8:00 P.M. to discuss reallocation of $8947 from Year VI Hamel Sewer Repair fund to Year VI
Hamel Water tower painting fund.
Motion declared carried
5. METROPOLITAN WASTE CONTROL
Motion by Reiser, seconded by Crosby to pay $2855 to Metro Waste Control in November which
will be reimbursed by them to Maple Plain in payment for unmetered sewage that has gore into
the Maple Plain Treatment plant from 1976 through 1981.

6. MEDINA MORNINGSIDE SPECIAL ASSESSMENT PUBLIC HEARING 8:00 P.M.
Skip McCombs stated that construction bids had been awarded to Nodland and Associates, that
a pre -construction conference had been held, easements are being finalized and the PCA needs
to give final approval.
He reported that the amount per property to be assessed is $5608.33 beginning 1982 with any
payment received within 30 days to be interest free.
Richard Schieffer explained the appeal process whereby anyone wishing to appeal his assessment
must present his appeal in writing at this meeting after which it would go through District
Court for a decision.
Following are questions and comments:
Jerry Johnson, 2445 Morningside Rd.: Will there be inspectors on the job?
McCombs: Our firm will have an inspector, the Corps of Engineers will be inspecting. We
will be contacting individual homeowners regarding location-of„sewer stubs.
Doug Sorenson, 2645 Morningside Rd,: ill curbe be cement and how will damaged property
be restored? Also what about sewer backup into my house?
McCombs: Curb will be cement and replacement of damaged property will be sod if now is sod
and seeded if not now sod. Regarding the lifst station, it is located far enough from
homes so there should be no backup.
Donna Kramer, 2485 Bobolink Dr., When will sewer connection be required?
Mayor Anderson: In previous projects 2 years was the allowable time.
Mike Schmidt, 2582 Morningside Rd.; When will the system be complete and operating?
McCombs: It should be complete by the summer of 1982.
Doug Wacek, 2692 Bobolink Rd.: Will streets be closed and when will they be blacktopped?
McCombs: Plans are for Morningside Dr. entrance to remain open constantly with some of
the side streets closed for periods of time when it may be necessary to use another street.
Blacktopping will be done early summer of 1982.
Bill Reed, 2732 Morningside Dr.: What will be done if all streets are not constructed
this fall?
McCombs: Compaction tests will be done in the Spring for streets not completed this fall.
Jerry Johnson, 2445 Morningside Dr.: What if water services to homes are damaged?
McCombs: Contractor must repair if service is disrupted, valves will be repaired so that
areas of water can be shut off for periods of time and the entire area need not be without
water. City crews will be working with the contractor to put valves in working order.
Gerald Kurtz, 2712 Morningside Dr.: Will rusty water lines be replaced?
McCombs: Water pipes are not in the same trench as sewer but if pipes are found to be in
need of repair the suggestion will be made to the city to repair. This is not the respon-
sibility of the contractor.
Bill Reed, 2732 Morningside Dr.: Pipes should be repaired so that it will not be necessary
to dig up streets after they are blacktopped.
Curt Eastman, 2632 Bobolink Rd.: What is the design of the curbs?
McCombs: They will be slanted which is the most popular design in residential neighbor-
hoods.
Mr. Eastman: There will be problems with cars driving on private lawns.
Mayor Anderson: Would the engineer please investigate the cost of a change order for the
conventional type of curb?
Cal Headley, 2685 Bobolink Rd.: Will bathrooms be put in at the park?
Mayor Anderson: Not being planned at this time.
Motion by Lutz, seconded by Scherer to accept letter from William Severin, 2455 Morning-,,
side Dr., as part of Public Hearing record.

Richard Schieffer explained that Council would need to adopt a resolution setting interest
rate and number of years properties should be addressed.
Motion by Lutz, seconded by Reiser to adopt Resolution 81-52, accepting assessment roll for
Medina Morningside sewer, street, curb and gutter project with interest to be 122-% for a
period of 10 years.

7. MEDINA MONRINGSIDE WATER SYSTEM CHARGES
Richard Schieffer explained that bonds for purchase of water system had been sold to three
banks at 11% interest,payable in 7 years. He presented a schedule for payment by property
owners for a quarterly charge of approximately $60.00 payable in addition to the regular
water usage charges.
8. PLANNING AND ZONING DEPARTMENT
William Botnan Subdivision
JoEllen Hurr explained that Planning Commission minutes need some correction; that a motion
had been made to approve the subdivision of the Botnan property. She stated that the sub-
division is one of 67 acres from a 78 acre parcel, no park fee being required because parcels
are over 10 acres in size and that existing buildings meet setback requirements.
Richard Schieffer stated that a legal description of the road would be needed.
Motion by Scherer, seconded by Lutz to approve Botnan subdivision and direct staff to find
out from Hennepin County if a survey of the road had been done or could be done by them.

Don Mayer, Sign
JoEllen Hurr reported that she and Sign Administrator, Emil Jubert, had reviewed the Mayer
property for sign placement. She stated that some kind of informal approval could be given
unless the variance procedure were to be followed.
Motion by Reiser, seconded by Crosby to table the matter for study by the Attorney and to
inform Mr. Mayer that additional work could not be done until city approval is received.

Steve Muth
JoEllen Hurr explained that Mr. Muth has requested that the city take possession of the road
that was built from Arrowhead Dr. to the east. She stated that Ron Duran would like test
hole drilled so as to determine base of the road; that the traveled portion of the road is
17-22 ft.; ditches need some work and the cul de sac radius is 70 ft.
Steve Muth stated that the road was built to city specification and that he had waited until
engineer Lyle Swanson had inspected the road before he had paid the contractor.
Thomas Crosby stated that the road should meet specifications now if it is to be taken over
by the city.
Richard Schieffer stated that the developer should have sought the cities taking possession
of the road when it was built.
Paul Pearson stated that the development agreement states that the cul de sac should be
120 ft.
Motion by Scherer, seconded by Lutz to table the matter pending review by the Engineer,
Ron Duran and JoEllen Hurr.

Dockside
Richard Schieffer explained the rezoning resolution which amends the zoning map and designates
the area as Multi -family. He had also determined that a second public hearing for rezoning
was necessary.
,Robert Franklin stated that there is not 89,000 sq. ft. if road easements are subtracted.
Mr. Schieffer stated that he had used the original square footage determination and had
divided by the 10 lots.
Mr. Franklin asked if Council was ready to approve the project.
Thomas Anderson stated that in granting preliminary approval Council had more or less approved
the entire plan.
Mr. Franklin stated that dedication of Lakeshore Ave. is not shown on the plat.
Mr. Schieffer stated that language is shown on the plat and width is shown as 13.5 ft.
Mr. Franklin stated that no reference is made to Pioneer Creek Watershed Districts rec-
ommendations for diking.
Paul Pearson stated that there are plans for a trench and fabric filter control which is
superior to hay bale dikes which may deteriorate.
Discussion of sewer and water assessment procedure.
Mr. Franklin asked for clarification as to how units could be assessed multi -family when
some single family units will be built.
Mr. Schieffer stated that the property is zoned for multi -family and that the assessment
procedure was adopted by the City Council.
John Spaeth stated that the city is not giving him credit for installing his own sewer stubs
as they have done for others.
Mayor Anderson stated that the assessment,Fprocedure should remain ,as agreed upon because
Mr. Spaeth is not being reimbursed as Charles Pangier had been for installing his sewer
stubs.
Regarding the diking system Skip McCombs stated that the system is a trench system and not
an earthen dike.
Frank Hagen, Planner for Mr. Spaeth, reported that the system has been submitted to the
watershed district and work cannot begin until the plan has been approved by them.
Motion by Crosby, seconded by Scherer to adopt Resolution 81-53, rezoning of the Dockside
property to Multi -family and to include all minutes of Planning Commission and City Council
as part of approval.

Regarding final plat resolution Thomas Crosby stated that covenants would need to include
language that no privacy walls or fences would be allowed by individuals.
Motion by Crosby, seconded by Scherer to adopt Resolution 81-54, granting final approval
to Dockside plat.

Richard Schieffer reviewed variances as included in memo prepared by JoEllen Hurr.
Motion by Crosby, seconded by Scherer to adopt Resolution 81-55, granting variances to
Dockside project according to memo of Zoning Administrator.

Robert Franklin asked that minutes reflect that he is opposed to items 5 - 8 of the
variance resolution.
Hamel Sewer District
Discussion of expansion of the Hamel sewer district and Gerald Dykhoff's request that
Lots 1, 2 and 3 Block 1, Hunter farms be included in the district.
Skip McCombs stated that the Council has flexibility in setting the district.
Council agreed that a plan in 5 year increments should be drawn and that the Planning
Commission should review possible expansion areas for the district.
9. BILLS
Motion by Lutz, seconded by Reiser to pay the bills; Order Checks #9768-9835 in the
amount of $86,585.49 and Payroll Checks # 6395-6407 in the amount of $10,501.29.

10. WOODLAKE SANITARY LANDFILL
Discussion of the method the city could use if they wished to order closing of the Wood -
lake landfill.
Discussion of retaining the services of an attorney familiar with landfills and environ-
mental concerns.
Richard Schieffer suggested that he become involved and advise Council if another attorney
was needed.
11. MEDINA MORNINGSIDE SEWER ASSESSMENTS 2"
Motion by Lutz, seconded by Crosby to reconsider the Medina Morningside Special Assessment
roll by amending to include the page referring to the Fred Keller property and to readopt
the roll by the addition of $13,000 and assess against the Keller property.

12. BARNS
JoEllen Hurr asked that Council either reconsider previous action taken regarding barns
built by the Maliks and Rey Swanson or be prepared to uphold that action.
13. 1982 BUDGET AND MILL LEVY
Discussion of the fact that the maximum amount that could be levied by the city would be
$515,217 based on levy limitation law.
William Reiser stated that any excess funds the city might realize should be used for
upgrading and balcktopping of a road.
Motion by Crosby, seconded by Lutz to certify $513,650 for general city purposes including
payment of $22,200 for retirement of Municipal Building bonds based on the amount of assessed
valuation as of this date being $21,856,733, mill rate to be approximately 23.5.

14. MEDINA MORNINGSIDE SEWER CONSTRUCTION CONTRACTS
Mot=on by Lutz, seconded by Crosby to authorize signatures on the Medina Morningside
construction contracts based on information received from Linda Proehl of PCA.
