I wish to make a public records request of your agency for the following records: Any email between anyone at Urban Design Kilday Studios and William Thrasher for the Town of Gulf Stream. Following are some items which were discussed and which further information was requested: 1) Regarding the amount of window opening on the east elevation, attached is a pdf demonstrating the area calculations for determining the total window opening area on the elevation. 2) Regarding the use of a terra cotta colored flat roof tile with dark hunter green shutters for a Georgian style home: Terra cotta color roof tiles have been used in Georgian style buildings in many instances as is demonstrated by the photos below and the attached jpg files. Therefore it is consistent with the architectural style of the home designed. Because the design style is a preferred style for the district, and is in accordance with the historical precedent of Georgian buildings with a terra cotta colored roof, it is consistant with the Town of Gulf Stream Land Development Regulations and should not require a variance in order to have a terra cotta colored roof. 3) Section 70 -238 of the Town of Gulf Stream Land Development Regulations states: "Flat, gray thru and thru, un- coated tile or slate -like tile may be permitted at the discretion of architectural review and planning board and the town commission making a determination that such alternatives are appropriate for the neighborhood." The proposed terra -cotta tile is similar in color to a real terra -cotta colored slate roof tile (sample can be provided if needed). The language this section says "slate - like ", it does not say "gray slate - like ". 4) Please note, There is an oceanfront home which is not Spanish Mediterranean a few doors north of 3211 North Ocean at 3421 North ocean which has a terra cotta colored flat concrete tile roof. Therefore there appears to be precedent in Gulf Stream for use of a red roof on a non - Mediterranean style home. Additionally, another home at 3545 North Ocean Blvd on the ocean has a green colored roof which is not allowed in the Land Development Regulations. Therefore if the variance process is pursued to achieve a terra cotta color roof, another precedent for a non — white or slate colored roof exists on the ocean. I would like your review this proposal which is a "tear down ". This is an introduction of a "new architectural style' which normally might be mildly accepted. However, this would be introduced into the Beach Front district and may be much more sensitive to neighborhood context. Rita and I feel that there are sections of the code which could prohibit this proposal from obtaining approval. We showed this to the Mayor and when we mentioned it would /could be a variance application, she was very reluctant and uneasy about such a submittal. I cannot imagine any changes that could be made to the proposal to eliminate the "variance(s) ". I will be forwarding two more emails from the architect for you to review. You have one to two weeks for this work up if you need that much time. It seems that the code allows the ARPB and Commission to review "grey types ", but not terra cotta. If you agree, it seems it would be a variance application as something prohibited. Also, I want you to calculate the window pane coverage on the rear. To our eye, it seems over the limit allowed. The Town Commission will have to consider the colored tile and determine whether it is appropriate for the neighborhood. I think Ben would need to make a stronger case that Georgian homes with a terra cotta roof is "appropriate for the neighborhood" and not that it has been done somewhere up north. For the rear elevation, it certainly looks close. We would need to have a CAD drawing of the elevation to truly confirm.
