HomeMy Public PortalAboutResolution 87-2729RESOLUTION NO. 87 -2729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING ZONE VARIANCE NO. 87 -826 RE: ALLOWING CONSTRUCTION OF AN INDUSTRIAL BUILD- ING WITH NO SIDE OR REAR YARDS WITH A PERCEIVED LOT COVERAGE OF 68% THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon a Public Hearing of an appeal of Planning Commission's decision for Zone Variance 87 -826 to allow the construction of an industrial building with no side or rear yards with a perceived lot coverage of 68% located at 9517 Gidley Street, the City Council finds: (a) That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of such property, which do not generally apply to other properties in the same zone; and (b) That such variance is necessary for the preservation and enjoyment of a substantial property right pos- sessed by other property similarly situated, but which is denied to the property in question; and (c) That the granting of the variance will not be mate- rially detrimental to the public welfare or injuri- ous to the adjacent property; and (d) That there are special circumstances as provided in Section 65906 of the California Government Code. SECTION 2. It has been determined that this project is categorically exempt from environmental review in accordance with the State CEQA Guidelines. SECTION 3. According said Zone Variance is approved subject to the following conditions: 1. That the development shall take place in substantial accordance with the approved site plan, building elevations, and floor plans as filed with the Plan- ning Department and labeled Exhibit "A ". 2. That all proposed mechanical equipment, such as heating, air conditioning, or refrigeration devices be screened from public view and also adjacent "R" zoned properties. 3. That the Temple City noise ordinance be adhered to at all times and that special consideration be taken to not allow activities to interfere with the com- fort of those persons residing in the adjacent "R" zoned properties. 4. That the location of all interior trash areas be subject to the approval of the Los Angeles Fire Department. 5. That all proposed signage conform to the Temple City Zoning Code. 6. That a detailed landscape and irrigation plan be submitted to the Planning Department for review and approval. 7. That all utilities shall be placed underground including electricity and telephone. Resolution No. 87 -2729 - Page 2 8. Permits are to be obtained for all work in the public right -of -way prior to commencement of such work. All work shall meet the requirements of the Los Angeles County Department of Public Works. 9. Provide adequate surface drainage for the site. No drainage shall be allowed to flow across a side- walk. e Fire sprinklers shall be installed d in the proposed industrial building. Said fire sprinkling system shall be subject to the requirements of the Build- ing and Fire Codes and subject to the review and approval of the Building Official and the L.A. County Fire Department. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 4th day of August, 1987.
