Larson, being duly sworn, on oath says he is and during all the times herein stated has been the publisher and printer of the newspaper known as the SOUTH CROW RIVER NEWS and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 1,200 square inches. (2) Said newspaper is dis- tributed at least once a week for 52 weeks each year. (3) Said newspaper, in at least half of its issues each year, has no more than 75 percent of its printed space comprised of advertising material and paid legal notices; and in all of its issues each year, has at least 50 percent of its news columns devoted to news of local interest to the community which it purports to serve, and not more than 25 percent of its total nonadvertising column inches in any issue wholly duplicates any other publica- tion unless the duplicated material is from recognized general news services; (4) Said newspaper is circulated in and near the municipality which it purports to serve, and has at least 500 copies regularly delivered to paying subscribers, and has entry as second-class matter in its local post of- fice; (5) Said newspaper purports to serve the Cities of Rockford, Greenfield, Corcoran, Loretto, Medina, Independence, Hanover, and Rockford Township in the County of Hennepin and the County of Wright and it has its known office of issue in the City of Rockford in said Hennepin County and Wright County, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and is maintained by the managing officer of said newspaper or persons in its employ and is subject to his directions and control during all such regular hours and at which time said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making applicable payment. (8) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper annually publishes and submits to the secretary of state a sworn United States Post Office second-class statement of ownership and circulation. C - >t'INNESOTA NENNE:W �C UNTY M...Csrnmiss icn Expires May 9, IC67 AFFIDAVIT OF PUBLICATION MEDINA ORDINANCE NO.213 AN ORDINANCE RELATING TO TRESPASS UPON LAND FOR PUR- POSES OF CONSUMPTION OF ALCOHOL OR CONTROLLED SUBSTANCES THE CITY COUNCIL OF THE CITY OF MEDINA DOES ORDAIN AS FOLLOWS: SECTION I The Code of the City of Medina is amended by adding the following: 640. FIELD PARTIES, TRESPASS 640.01. Trespass -Unlawful. It sahll be unlawful for any person to do any of the following: Subd. 1. Trespass by Individual. The uninvited entry on to the land of another for the purpsoe of consuming alchoholic beverages or using controlled substances; Subd. 2. Trespass by Motor Vehicle. The uninvited entry by motor vehicle on to the land of another to facilitate the consumption of alchocolic beverages or the use of controlled substances. Subd. 3. Permitting Trespass by Motor Vehicle. Determination of Purpose of Entry. Subd. 1. To determine the purpose of an uninvited entry of a person or motor vehicle onto the land of another, the fac- tors to be considered include, without limitation, the following: (a) Time of day; (b) Presence of containers intended to contain or containing alcoholic beverages: (c) Presence of equipment used to dispense alcoholic beverages; (d) Presence of paraphernaila con- taining identifiable residues of a con- trolled substance; (e) Noise level; (f) Liohtina; (g) Identified physiological responses; and (h) Conduct of persons in the presence of a peace officer. 640.07. Defenses. If the trier of fact finds that the landowner or lessee ex- pressly consented, endorsed or ratified the entry onto land, such a finding shall constitute an absolute defense tocharges under this section. 640.09. Owner, Lessee Liability. An landowner, or lessee who expressly con- sents to, endorses, or ratifies and entry onto land is not presumed to be in con- trol of the persons gathered on the land, nor is the landowner or lessee presumed to have knowledge or an un- lawful act merely because of eXpress consent, endorsement, or ratification. 640.11 Penalty. Any person violating this ordinance shall, upon conviction thereof, be subject to a fine not to ex- ceed $700 or imprisonment for a period not to exceed ninety (90) days, or both, together with the costs of prosecution. This ordinance becomes effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 7th day of August, 1984.
