AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING 4.25 ACRES FROM C-2, GENERAL
COMMERCIAL, AND PUD, PLANNED UNIT DEVELOPMENT, TO C-O, OFFICE
COMMERCIAL, FOR LAND ADDRESSED AS 305 AND 307 FLORA DRIVE,
DESCRIBED AS PART OF SECTION 13, TOWNSHIP 44 NORTH, RANGE 12 WEST,
JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, It appears that the procedures set forth in the zoning code relating to
zoning have in all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from C-2 General
Commercial to C-O Office Commercial: Part of the Southeast Quarter of Section 13,
Township 44 North, Range 12 West, all in the City of Jefferson, Missouri, more
particularly described as follows: From the southeasterly corner of Lot No. 11 of said
Spring Valley Subdivision; thence S83 003'54"E, along the easterly line of Flora Drive,
29.15 feet; thence Southerly, along the easterly line of said Flora Drive, on a curve to the
right, having a radius of 430.00 feet, an arc distance of 215.88 feet, (the chord of said
curve being S58°48'17"E, 213.62 feet; thence S44 025'20"E, along the easterly line of
said Flora Drive, 46.67 feet to the POINT OF BEGINNING for this description; thence
N23°38'41"E, 664.11 feet to a point on the westerly line of a tract described by deed of
record in Book 372, page 459, and Book 411, page 205, Cole County Recorder's Office
at its intersection with the southerly line of the property previously described by deeds of
record in Book 362, pages 798, 799 and 800 and presently being the southerly line of

Cole County Recorder's Office, south of tract conveyed to RTR Real Estate, Inc., by
deed of record in Book 362, page 800, Cole County Recorder's Office, all of which is
more particularly described as follows: From the southwest corner of the Southeast
Quarter of said Section 13; thence S86°34'38"E, along the Section Line, 1692.40 feet to
the southeasterly corner of a tract conveyed to Grover H. Gray and wife, by deed of
record in Book 132, page 67, Cole County Recorder's Office, which point is also the

Case No. P12014 — 305 and 307 Flora Drive; Rezoning from C-2 and PUD to C-O.
Application filed by Susan Moore, applicant, on behalf of Gary and Mary Phillips, property
owners, to rezone 1.25 acres from C-2 General Commercial to C-O Office Commercial and to
rezone 3.0 acres from PUD Planned Unit Development to C-O Office Commercial. The property
is located on the north side of Flora Drive 300 feet west of Tanner Bridge Road and is described
as part of Section 13, Township 44 North, Range 12 West, Jefferson City, Missouri (Central
Missouri Professional Services, Consultant).
Mr. Barron described the proposal and explained that this request is to rezone two parcels from
their current zoning designations of C-2 and PUD to C-O Office Commercial. He stated that in
November 1994 a request to rezone the PUD portion of the property to C-2 for the purpose of
constructing mini-storage units was withdrawn by the applicant. Subsequently, in August 2010 a
request to rezone the property to RA-1 for the purpose of constructing apartments was
recommended for approval by the Planning and Zoning Commission but failed at the City Council.
Mr. Barron explained that the purpose of this request is to allow for uses such as daycares, offices,
and assisted living facilities. He stated that this request does not require a comprehensive plan
amendment. Mr. Barron explained that no specific development plan was submitted with the
application.
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding
this request and explained that in August 2010 he believed that the rezoning request was a good
plan based on the lack of density but when the proposal got to Council it did not alleviate the
concerns of the neighborhood. He stated that he came away from that meeting with the sense that
C-O Office Commercial is more acceptable. Mr. Bates distributed the following visuals: (1) depicts
the overall layout with the zoning layer; and (2) depicts what the property looks like as it fits into the
neighborhood.
Ms. Susan Moore, 5201 Sharon Drive, spoke regarding this request and explained that she spoke
with most of the residents on Tanner Bridge Road. She stated that they were very receptive to the
proposed plan as long as it does not involve a multi-family residential development.

No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report.
Mr. Jordan moved and Mr. Vaughan seconded to recommend approval of this rezoning request to
the City Council. The motion passed 6-0 with the following votes:

August 2010 — A request to rezone the property to RA-1 for the purpose of constructing apartments was
recommended for approval by the P&Z Commission but failed at the City Council on a vote of 4-6.

Rezoning Request:
The Flora Drive area currently contains a mix of land uses that include offices, a roller skating rink, a training
center, and a contractor trade shop. The land use pattern in the area is commercial in nature, and the
Development Plan Map of the Comprehensive Plan identifies the property as being intended for commercial
use. The establishment of a lower level of commercial zoning would help to create a transitional zoning
between the more intense commercial uses to the west and the single family uses to the east of the property.

The existing 4.29 acres is currently zoned a combination of C-2 and PUD without
identified permissive uses. A recent proposal for apartment uses was not well received
by the residential neighborhood along Tanner Bridge Road. Subsequently,the developer
met with city staff to propose an alternate zoning plan that would allow flexibility but
limit uses to office, assisted living or day care,as well as,other identified as C-O
permissive uses that are believed to be less objectionable to the neighborhood.
a) There was no error in the original zoning.
b) The area is a combination of commercial and office development. Flora Drive
connects the Christy Drive outer roadway and Tanner Bridge Road, a collector
roadway, the current C-2 zoning for a portion of the site would allow some uses
that would be less desirable with the Tanner Bridge Road residential uses. It is
believed that the C-0 zoning would complement the existing uses and provide a
good transition from commercial to residential.
c) The community will benef t economically from a well planned infill development.
d) The 1996 Comprehensive Plan shows this area as commercial. The C-0 zoning
use would ensure consistency with all other plans.
e) The proposed is compatible and complimentary of existing uses.
f) The owner of the property will have access to an easement for a short sanitary
sewer extension; it is likely this easement will also serve for any enclosed
stormwater system. All other public facilities and utilities are in place and
available.
g) The size and type of any C-0 zoning development is not anticipated to require a
site specific Traffic Impact Study.
h) The existing street network is capable of handling the proposed development.
i) The anticipated density will not create any offensive environmental impact.
j) The existing development and proposed anticipated uses are of a low density
nature. The supply of land is not an issue.
k) The property has been vacant for decades and is well served by core
infrastructure. The proposed zoning change should allow the property to develop
without negative impact to existing development and provide a supporting tax
base for the City.
