Mr. Walker moved that the Minutes of the Commission's regular meeting held on September 11, 1970 be approved. Motion was seconded by Mr. LaPorte and unanimously carried. 3. The Financial Report, for the month of September, was unani- mously approved on motion of Mr. Hart and duly seconded by Mr. LaPorte. 4. Mr. Bailey Wolforth, on behalf of the builders of HILLSIDE APARTMENTS, located on Little Road, appeared before the Com- mission and requested a 'Variance' from the 10 -foot Setback requirement on the south side of the property to allow for installation of Air Conditioner Compressor Units at the south property line. Mr. Wolforth submitted revised architect's plans and, as re- flected thereon, explained to the Commission the desired re- location of the Compressor Units. Following discussion thereon, the Commission deferred action on the 'Variance' request until the next regular meeting, it being understood and agreed that the Petitioner, in the mean- time, would inform the owners of all properties abutting the Hillside Apartment development area of the builder's desire to relocate the Compressor Units and identify the location as de- sired. 2 6. Mr. Paul Speicher, a local insurance representative, address- ing the Commission, explained in detail the availability of Flood Insurance to protect properties in Gulf Stream. This coverage is only available to property owners if the munici- pality recognizes the public need for such insurance protec- tion to properties lying within determined flood plain areas and lands subject to possible flooding and flood damage. Many towns and cities in south Florida have adopted, and pro- vided for participation in, the National Flood Insurance Pro- gram, however, prior to endorsing the 'Program', the Commis- sion requested that further criteria, concerning the Program, be obtained from the Corps of Engineers, and any other avail- able source, for consideration by the Commission at its next regular meeting. 7. The following 'Bids' for installation of a Sprinkler System on the Town Hall property were submitted: Kilpatrick Lawn Sprinklers, Inc. $ 770.00 National Sprinklers & Wells, Inc. 544.00 Jim Womack's Sprinkler Service 830.00 Mr. Hart moved that the low qualified bid be accepted, and that an appropriation of sufficient funds to cover the cost thereof, be made from the Contingency Account. Motion was seconded by Mr. Walker and unanimously approved. 8. Ordinance No. 70 -2, proposes entering into a contract with the Palm Beach County Building Department to provide for com- plete INSPECTION of all construction within the boundaries of Gulf Stream, and further provides for adoption of the Build- ing, Electrical, Plumbing, Life Saving and Concrete CODES, with amendments thereto as adopted by Palm Beach County. Said Ordinance No. 70 -2 also provides that the Town of Gulf Stream shall issue all building permits for construction in the Town and the Charges and Fees for such issuance of build- ing permits shall be the same as those set forth in the cur- rent Permit Fee Schedules of Palm Beach County, and future a- mendments thereto, as pertain to Building, Electrical and Plumbing. Ordinance No. 70 -2 was placed on first reading on motion of Mr. LaPorte, duly seconded by Mr. Walker and will be submit- ted to the Commission for second and final reading at the next regular meeting, scheduled to be held on Friday, Novem- ber 13th, at 9:00 o'clock A.M., in the Town Hall. ATT1 SV: Deputy.Clerk��]`— M A Y O R ORDINANCE NO. 70-9 AN ORDINANCE OF THE TOWN OF GULF STREA3+I, FLORIDA, ADOPTING THE BUILDING, ELECTRICAL, PLUMBING, LIFE SAVING AND CONCRETE CODES, AND AMENDMENTS THERETO, AS ADOPTED BY PALM BEACH COUNTY; PROVIDING FOR THE ISSUANCE OF BUILDING PERMITS BY THE TOWN AND THE CHARGES THEREFOR; PROVIDING FOR INSPECTION OF PROJECTS BY PALM BEACH COUNTY BUILDING DEPART- MENT AND MATTERS RELATING THERETO; PROVIDING FOR ADOPTION AND EFFECTIVENESS OF FUTURE CHANGES IN CODES BY PALM BEACH COUNTY; PROVIDING PENALTY FOR VIOLATION OF THIS ORDINANCE. WHEREAS, the Town Commission of the Town of Gulf Stream, Florida, deems it advisable that the building codes as in force and effect in Palm Beach County, as adopted by the Roard of County Commissioners of Palm Beach County and the planning and building departments of said county, he adopted by the Town; and 6IHEREAS, Section 165.191 Florida Statutes permits the adoption of codes by reference; and 17HEREAS, the required number of copies of such codes have been filed with the Town Clerk; NOW, THEREFORE, BE 11' ORDAINED, BY THE TO14N COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, as follows: Section 1. The Town of Gulf Stream hereby adopts by reference the provisions of all building codes now in force and effect in Palm Beach County as adopted by the Board of County Commissioners of Palm Beach County, Florida, and the Building Department of said County, said codes being as follows: The Southern Standard Building Code and Amendments thereto; County Amendments to The Southern Standard Building Code; The National Electric Code; County Amendments to The National Electric Code; The Southern Standard Plumbing Code and Amendments thereto; County Amendments to The Southern Standard Plumbing Code; The American Concrete Institute Code; The Life Saving Code Number 101. Section 2. The Town of Gulf Stream shall issue all building permits for construction in the town. Charqes and fees for issuance of building permits shall be the same as those charged by the Building Department of Palm Beach County. The -1- Town Pianager or the contractor will request the County Building Department for inspection for a given time and date and the permit inspection card and plan shall be on the construction site at all times and the inspector on completion of his in- spection will mark the card as to acceptance and the date thereon, or will note reasons for rejection. Upon completion of the project and final inspection the inspector will report this to the municipality which shall then issue the certificate of occupancy to the builder. Section 3, The County Puilding Department shall process plans that are submitted in duplicate, checking the same for compliance with the codes, and will determine the amount of the permit fee and supply a copy of the same to the Town. For this and the inspection service the County shall receive seventy - five per cent. (75 %) of the permit fee received by the Town. The share of the fee to the County shall be paid as soon as it reasonably can be after issuance of building permit by the Town. Section 4, Upon copies of future changes by Palm Beach County in said codes being filed with the Town, such changes shall become effective immediately in the Town. Section 5. Violation of the provisions of said codes by persons or corporations engaged in construction pursuant to permit issued by the Town shall be punished by fine of not more than $100.00, or by imprisonment for not more than one month, or by both such fine and imprisonment, Section 6. This Ordinance shall become effective January 1, 1971.
