1, Mayor Koch called the meeting to order.
2. Mr. LaPorte moved that the Minutes of the Commission's Meeting
held on October 9th, 1970 be approved. Motion was seconded by
Mr. Hart and unanimously carried.
3. The Financial Report, for the month of October, was unanimously
approved on motion of Mr. LaPorte, duly seconded by Mr. Hart.
4. Mr. H. Schuyler Cole complained of the drainage problem and the
accumulation of excessive water on Polo Drive, between Banyan
and School Roads. The Mayor directed the Town Manager to inves-
tigate this matter, obtain grade levels in the immediate area,
and submit a recommendation to the Commission, at its next meet-
ing, for providing relief from this undesirable condition.

6, On October 9th, a 'Variance' request from HILLSIDE APARTMENTS
was submitted to the Commission, requesting permission to re-
locate certain Compressor Units to the south Lot Line of their
property. The developers, on request of the Commission, agreed
to notify the owners of all properties abutting the lands being
improved, of their variance request, which 'Notice', in detail,
was forwarded to said property owners under date of October 20.
Mr. J. Davis Danforth objected to the proposed relocation site
of the Compressor Units as indicated on a sketch submitted by
the builders of Hillside Apartments. Upon assurance from Mr.
Goodrich Littlefield that the location of the 'Units' would be
relocated as far west, from the present proposed location, as
possible and not to conflict with the function of the Compres-
sor Units, Mr. Danforth withdrew his objection and the petition-
ed 'Variance' was granted by unanimous approval of the Commis-
sion on motion of Mr. Hart and seconded by Mr. Walker.

7. The Gulf Stream Golf Club has petitioned, through Summons
filed in Circuit Court, Case No. 70 -C - - Stewart, for DE-
ANNEXATION of "That part of the SEA of the SW-4 of the NE4
of Section 4, Township 46 South, Range 43 East, lying west
of U.S.Highway No. 1 (State Road No. 5) ". This parcel of
land comprises approximately 1'h acres, lies west of U. S.
Highway No. 1 (North Federal Highway /State Road No. 5), and
is the only land within the corporate limits of the Town of
Gulf Stream lying west of said U. S. Highway No. 1.
The Town Commission, determining that there appears to be
no reason for the Town of Gulf Stream to oppose de- annexa-
tion of that parcel of land, on motion of Mr. LaPorte and
seconded by Mr. Walker, authorized the Town's legal counsel,
Mr. Henry F. Lilienthal to file pleadings in the 'Case', on
behalf of the Town, reflecting that said Town of Gulf Stream
has no objection to the exclusion of said described parcel
of land, more fully identified and located in the 'Petition'
and set forth hereinabove.
S. The Commission held interviews on Tuesday and Wednesday, No-
vember 10th and 11th, with the following Consulting Engi-
neering firms relative to providing the Town of Gulf Stream
with a Preliminary Plan and Engineering Report for a pro-
posed Sewage Collection and Disposal System:

John A. Grant, Jr. Inc.,
Russell & Axon
Estimated cost for rendering such Engineering Services, nec-
essary to provide said preliminary plan and engineering re-
port, was as follows:

The Commission reviewed the various offers of the engineering
firms, and upon the Mayor's request for comment thereon, the
Town Manager stated that he was well acquainted with all of
the firms and that each was well qualified and able to perform
the services desired by the Town. He further stated, however,
that he was thoroughly familiar with the several contracts,
for similar projects and services, entered into by Russell &
Axon with the City of Delray Beach, commencing in September,
1959, continuing to the present day, and totaling over the
sum of $10,500,000. All of said projects having been con-
cluded in a most satisfactory manner, without any major dif-
ferences or problems arising between the City and the Consult-
ing Engineers during that eleven year relationship, it is recom-
mended that Russell & Axon be retained as Consulting Engineers
for the project under consideration.

8. The Commission, sustaining the recommendation of the Manager,
unanimously approved retaining Russell & Axon as Consulting
Engineers for the preparation of a 'Preliminary Plan and Engi-
neering Report' for a possible Waste Water Collection and Dis-
posal System, on motion of Mr. Hart and seconded by Mr. Walker.
9. The Commission, being advised by the Town Manager that the
'Lease Agreement' for USE of the present Dump Site expires on
December 31, 1970, unanimously approved renewing the current
Lease Agreement for the ensuing year, to terminate on December
31, 1971 on motion of Mr. Hart and seconded by Mr. LaPorte and
authorized execution of said Agreement, by the proper officials,
upon being assured there would be no increase in cost therefor
over the current annual charge of $600.00.
10. Resolution No. 11 -70, proposing endorsement of the National
Flood Insurance Program was tabled for further study, on motion
of Mr. Hart and seconded by Mr. Walker,
11. The Commission, on motion by Mr. Hart and seconded by Mr. Walker,
that, due to absence of Commissioners during the Summer months,
Mr. Worthing be authorized to sign checks jointly with any one
Commissioner who may be in residence. This action of the Com-
mission is subject to it not being in conflict with existing
Charter provisions.
12. The request of Mr. Ganger, relative to a prepared resolution and
supporting petition, concerning the Town obtaining a 'Blanket
Permit' from the U. S. Army Corps of Engineers and the State's
Department of Natural Resources, permitting construction of
rubble revetments in front of existing vertical seawalls, pre-
sently unprotected, was tabled for study and possible solution
and recommendation at the next regular meeting, subject to nec-
essary information being obtained in time to enable such action.
13. Ordinance No. 70 -2, proposing adoption of the Building, Electri-
cal, Plumbing, Life Saving and Concrete Codes, and amendments
thereto, as adopted by Palm Beach County, and further providing
for INSPECTION of all construction within the Town of Gulf Stream
by the County's Building Department, was submitted on second and
final reading. This Ordinance also provides for the Town of Gulf
Stream to be responsible for the issuance of all building permits
for construction in the Town, with 'Charges and Fees' for such
building permits to be the same as those contained, and set forth
in the "Permit Fee Schedules" of the County for Building, Elec-
trical and Plumbing.
On motion of Mr. Hart, seconded by Mr. LaPorte, the Commission
unanimously approved adoption of said Ordinance No. 70 -2 on this
final reading. Said Ordinance becomes effective January 1, 1971.

14. Mr. J. D. Danforth referred to a petition of several months
ago wherein the owners of properties abutting County Road
had requested that Right -Of -Way be made ONE -WAY traffic.
The Commission directed the Town Manager to check into the
matter, confer with, and obtain the co- operation of the
County Traffic Engineer's Department, for establishing ONE -
WAY traffic as petitioned for, and, in fact, deemed to be
in the best interest of the Town of Gulf Stream and its
citizens in considering Traffic Safety and General Welfare
of the Town.

The undersigned requests that a variance to the zoning ordinances be
granted with respect to the following land:
A portion of Lot 17, Benson Bros. Subdivision, being approximately
1 .136 acres in Section 34, Township 45 South, Range 43 East, Town
of Gulf Stream, Florida, according to Plat thereof recorded in Plat Book 5,
Page 27, Public Record of Palm Beach County, Florida.
The variance requested is as follows:
That air conditioning compressor units be located per attached sketch.
The following are the reasons why such variance should be granted:
1. This location would be adjacent to the Little Club Golf Course, and
would not be detrimental to the course or any adjacent, future buildings.
2. This location renders the units as for as possible from the tenants served.
3. Because of these facts, the intent of the ordinance is in no way violated.

Dear Mr. Worthing:
I received the copy of Petition for Exclusion of
Lands and the Summons which were served on the Town on
October 20th. Since the next meeting of the Town
Commission does not occur until November thirteenth and
it is imperative that pleadings be filed in the case
not later than twenty days from the date of service,
my inquiry is:
Does the Town Commission wish to oppose the
exclusion of the land involved, which is
designated as:
"That part of the SEA of the SW; of the NE
of Section 4. Township 46 South, Range 43 East,
lying West of U.S. Highway No. 1 (State
Road No. 5)"
or is there no objection?
My pleadings in behalf of the Town will of course reflect
the decision of the Town Commission on this point.
Since I have no available map showing the exact
location of the property, I would assume that it is a small
piece of property isolated by U.S. Highway No. 1 and that
there are no other lands in the Town lying west of U.S. 1.
Will you please consult with the Mayor and other
members of the Commission and let me know what their feelings
are with respect to the matter and I shall be governed accord-
ingly. Any nonofficial decision of the members of the Com-
mission may be confirmed at the next regular meeting.

This cause coming on to be heard upon the Petition for Exclusion of
lands from the corporate limits of the Town of Gulf Stream, Florida, filed
herein pursuant to the provisions of Sec. 171. 02, Florida Statutes 1969, and the
Court having reviewed the pleadings submitted by the respective parties and
heard the testimony presented and the argument of counsel, and being otherwise
fully advised in the premises finds as follows:
That the Town of Gulf Stream, Florida, a municipal corporation, con-
tains less than 150 qualified electors, and that owing to the extent of territory,
the lands and premises hereinafter set out are, from distance and the character
of the said lands and premises and the purposes for which said lands are used
and suited, virtually and commensurately excluded from the benefits of the
municipal organization of the Town of Gulf Stream, Florida, and that therefore
the said lands and premises should be excluded from the corporate limits of the
Town of Gulf Stream, Florida and the Court being advised in the premises,

ORDERED AND ADJUDGED that the following described lands and
premises, to wit:

Reference is made to our discussions this morning concerning the prepa-
ration of a Preliminary Plan and Engineering Report for a proposed waste
water collection system with disposal into the City of Delray's disposal
system.
In accordance with our discussions we submit herewith the following in-
formation:
We will prepare a preliminary engineering report and master sewer plan
based on existing zoning regulations for a proposed sewer collection system
and a cost estimate for the construction cost of these facilities. Included in
this plan will be major lift stations, force mains and trunk sewers to serve
all the areas within the town limits. The town would be divided into various
drainage areas so that the sewage system can be designed as economically
as possible. Included in this report will also be the estimated cost of
operation of these facilities. This report will contain sufficient information
to enable the town to proceed with discussions with fiscal agents.
We propose to furnish the town 20 copies of the master plan report.
We estimate that it will take 60 days from date of authorization to proceed
to complete the engineering study.
We have calculated that our cost on this project is $2, 500.00 and propose to
perform these services for this lump sum amount.
We appreciate the opportunity of submitting this proposal to you and look
forward to discuss same with you at your convenience.

Subject: Engineering Services for Sewerage Program
Gentlemen:
We thank you for the opportunity to present our proposal for engineering
services, and for the courtesies extended during our interview of Novem-
ber 11th. Pursuant to your request we are submitting this prospectus to
summarize the services we propose to provide for the preliminary engineer-
ing study and the charges related thereto.
We propose to review the engineering data used in our 1965 Report, re-
evaluating design criteria in accordance with the latest population data,
zoning requirements and technical improvements in the field of waste dis-
posal. Our report would present complete preliminary cost estimates in
accordance with today's construction prices and finance charges, and
would be of sufficient scope to support a public referendum on the project
as well as the financing program, whether by bond issue or by financial
assistance from Federal or State agencies. We would include estimates
of operating costs and revenue that might be derived from connection char-
ges and customer service charges. Consideration would be given to the
alternate choices for sewage disposal by (a) contractual connection to the
City of Delray Beach system, or (b) separate sewage treatment facilities
for the Town, if necessary.

Subject: Engineering Services for Sewerage Program
Gentlemen:
We thank you for the opportunity to present our proposal for engineering
services, and for the courtesies extended during our interview of Novem-
ber 11th. Pursuant to your request we are submitting this prospectus to
summarize the services we propose to provide for the preliminary engineer-
ing study and the charges related thereto.
We propose to review the engineering data used in our 1965 Report, re-
evaluating design criteria in accordance with the latest population data,
zoning requirements and technical improvements in the field of waste dis-
posal. Our report would present complete preliminary cost estimates in
accordance with today's construction prices and finance charges, and
would be of sufficient scope to support a public referendum on the project
as well as the financing program, whether by bond issue or by financial
assistance from Federal or State agencies. We would include estimates
of operating costs and revenue that might be derived from connection char-
ges and customer service charges. Consideration would be given to the
alternate choices for sewage disposal by (a) contractual connection to the
City of Delray Beach system, or (b) separate sewage treatment facilities
for the Town, if necessary.

The report would be submitted at least 30 days prior to the anticipated
referendum, but no later than the second week of January, 1971. Due
to the advantages to be gained by application of our readily available
data, we can prepare the report on the basis of actual payroll costs,
times the multiplier of 2. 5, plus out -of- pocket expenses for special
services as outlined in ASCE Manual 45; the total of such charges not
to exceed $1,000.00.
We shall be pleased to provide any further information or to meet with
you as desired. We are looking forward to the opportunity to serve the
Town of Gulf Stream again.
