Cigarette Sales: The sale of cigarettes and cigarette wrappers in the village shall be governed by the provisions of this section. t2. License Required: No per- son shall directly or indirectly or , by means of any device keep for i sale, sell at retail, or otherwise , dispose of any cigarette or cigar- ette wrapper at any place in the village unless the license therefor I shall first have been obtained. as ' provided in this section and or- dinance. 3. License Fee: The fee for every cigarette license shall be $12.00 per year. Every such license shall expire on December 31 next after its issuance. For any such license issued after Jan- , uary 31 in any year, the fee shall be computed at the rate of $1.00 for each month or fractional part of a month covered by the license. Licenses shall not be transferable from one person to another. 4. License Restrictions: No cigarette license shall be issued i except to a person of good moral character. No license shall be issued to any applicant for sale of cigarettes in any place other than his place of business. No license shall be issued for the sale of cigarettes at a movable place of business, nor shall any license be issued for the sale of cigar- ettes at more than one place of business of applicant. No person shall sell or give away any cigar- ettes, cigarette paper or cigarette wrapper to any person under the age of 18 years. No person shall keep for sale, sell, or dispose of any cigarette containing opium, morphine, kimson weed, bella donna, strychnine, cocaine, mari- juana, or any other deleterious or poisonous drug except nicotine. Crawford, being duly sworn on oath says: that he now is, and during all the times herein stated has been the publisher of the newspaper known as The Wayzata North Shore Minnetonka Herald and has full knowledge of the facts herein stated. That for more than one year immediately prior to the publica- tion therein of the printed ordinance hereto attached, said newspaper was published in the English lan- guage from its known office of publication within the City of Wayzata in the county of Hennepin, State of Minnesota, on Thursday of each week in column and sheet form equivalent in space to 450 running inches of single column two inches wide; has been issued from a known office established in said place of publication equipped with skilled workmen and the necessary material for preparing and printing the same; The Wayzata North Shore Minnetonka Herald has had in its makeup not less than twenty-five per cent of its news columns devoted to local news of interest to said community it purports to serve, the press work of which has been done in its said known office of publication; has contained general news, comments and miscellany; has not duplicated any other publication; has not been entirely made up of patents, plate matter and advertisements; has been circulated at and near its said place of publication to the extent of 240 copies regularly delivered to paying subscribers; has been entered as second class mail matter in the local post office of its said place of publication; that a copy of each issue of said newspaper has been filed with the State Historical Society; that there has been on file in the office of the County Auditor of said county the affidavit of a person having first hand knowledge of the facts constituting its qualifications as a newspaper for publication of legal notices; and that its publishers have complied with all demands of said County Auditor for proofs of its said qualifications.
