DON R. LARSON, being duly sworn, on oath says: that he now is and during all the
time herein stated has been DON R. LARSON, the publisher and printer of the
newspaper known as the Crow River News, and has full knowledge of the facts
herein stated.
That for more than one year immediately prior to the publication therein of the
printed Notice City of Medina

hereto attached, said newspaper was printed and published in the English
language from its known office of publication within the County of Hennepin and
County of Wright, State of Minnesota, on Wednesday and Saturday of each week in
column and sheet form equivalent in space to 450 running inches of single
column 21/2 inches wide; has been issued from a known office established in said
place of publication equipped with skilled workmen and the necessary material for
preparing and printing the same: THE CROW RIVER NEWS has had in its
makeup not less than twenty-five percent of its news column devoted to local news
of interest to said community it purports to serve, the press work of which has
been done in its known place of publication; has contained general news, com-
ments and miscellany; has not duplicated any other publication; has not been
entirely made up of patents, plate matter and advertisements; has been circulated
at and near its said place of publication to the extent of 240 copies regularly
delivered to paying subscribers; has been entered as second class mail matter in
local post office of its said place of publication; that there has been on file in the
office of the County Auditor of said county the affidavit of a person having first
hand knowledge of the facts constituting its qualifications as a newspaper for
publication of legal notices; •4nd that its publishers have complied with all
demands of said County Auditor for proofs of its said qualification. A copy of each
issue has been filed with the State Historical Society, St. Paul.

ORDINANCE NO. 168
AN ORDINANCE PROVIDING FOR AD-
MINISTRATION AND ENFORCEMENT
OF THE MINNESOTA STATE
BUILDING CODE BY THE CITY OF
MEDINA, AND FIXING FEES FOR
BUILDING PERMITS.
THE CITY COUNCIL OF THE CITY OF
MEDINA ORDAINS AS FOLLOWS:
SECTION 1.
1,01 State Building Code Confirmed. The
Minnesota State Building Code, one copy
of which is on file in the Office of the City
Clerk, has been adopted by Laws of 1977,
Chapter 381, as a uniform building code
applicable throughout the State of Min-
nesota. Such code is hereby confirmed as
the building code of the City of Medina and
incorporated in this Ordinance as com-
pletely as if fully set out. By this Or-
dinance, the City undertakes to provide
for the enforcement of the State building
code within the City.
1.02 Additional Provisions. The follow-
ing appendices and supplementary
material to the Minnesota State Building
Code are also adopted as part of the.
building code of the City of Medina:
Appendix A -Standards
Appendix D-Organization and Enforce-
ment except Sections 1, 4, and 5 thereof
Appendix E-Permits and Inspections.
Appendix F-Abbreviations
Appendix G-Flood Proofing Regula-
tions, Sections 201.2-208.2
Appendix H-Minnesota Plumbing Code,
Appendices A, C, D, E, and F
Appendix I -Minnesota Energy Conser-
vation Requirements.
2.01 Administrative Authority. The
Building Inspector/Building Official
designated by the City Council by con-
tract shall be designated as the Building
Department and the Administrative
Authority wherever those terms are used
in the Minnesota State Building Code and
the Appendices adopted by reference in
this Ordinance.
2.02 Fee, Schedule Adopted. Fees for
Building Permits and Plan Checks shall be
as follows:
2:02.1 .The fee for Plan Checks shall be
as set forth in Minnesota State Building
Code.
2:022. The fee for a Building Permit
Alia be the greater of the following:
(a) The amount as set forth in the Min-
nesota State Building Code; or
(b) The aggregate of the City's actual
'cost of inspection plus 25% thereof to
(defray administrative costs.
2:03 Surcharge. In addition to the tee re-
quired by 2.02 hereof, the applicant for a
building permit shall pay a State sur-
charge in the amount fixed by law. The
amount collected hereunder shall be
remitted to the Minnesota Department of
Administration.
3.01 Board of Appeals. In order to deter-
mine the suitability of alternate materials
and methods of construction and to
provide for reasonable interpretations of
the provision of this Code, there shall be
and is hereby created a Board of Appeals,
consisting of the City Council. The Board
shall render all decisions and findings in
writing to the Building Official with a
duplicate copy to the appellant.
4.01 Violations and penalties. It is un-
lawful for any person, firm or corporation
to erect, construct, enlarge, alter, repair,
move, improve, remove, convert or
demolish, equip, use, occupy, or maintain
any building or structure in the city except
an agricultural building as defined in Min-
nesota Statutes Section 16.84, Subdivision
6, or cause the same to be done, contrary
to or in violation of any provision of this
ordinance or the codes adopted by
reference in this ordinance. Any person,
firm or corporation violating this or-
dinance or any code adopted by reference
in this ordinance shall be deemed guilty of
a separate offense for each day or portion
thereof during which any such violation is
committed, continued, or permitted, and
upon conviction of any such violation, such
person, firm or corporation shall be
punishable by a fine of not more than $500
or by imprisonment for not more than 90
days, or by both such fine and imprison-
ment.
SECTION 2. This Ordinance becomes ef-
fective upon its passage and publication.
Passed by the City Council of the City of
Medina this 3rd day of January, 1978.
