Mayor Gilbertson called the regular meeting of the City Council to order at 7:40 p.m. I 2. The invocation was given by Pastor E. E. Perry, 7th Day Adventist Church, 9664 E. Broadway, Temple City. 1 3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson. 4. ROLL CALL: PRESENT: ABSENT: ALSO PRESENT: Councilmen- Briggs, Harker, Merritt, Tyrell, Gilbertson Councilmen -None City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Civil Engineering Assistant Linares, Administrative Assistant Lantz, District Engineer Biddlecomb 5. APPROVAL OF MINUTES: On motion of Councilman Merritt, seconded by Councilman Harker, the minutes of the reguiar meeting of April 20, 1971, were approved as written. UNFINISHED BUSINESS: 6. ORDINANCE NO. 71 -321: 2nd read. Re.. Proposed Amendment to Temple City Municipal Code - Conditional Use Permits for Restaurants and Similar Establishments. City Attorney Martin advised that this ordinance which would require conditional use permits for restaurants and similar establishments had previously received first reading, however because of amendments presented at the last meeting to exclude restaurants with an indoor seating capacity of 150 places and over, it was given first reading. He advised that the phrase that was added to 36A, items 1 and 2, was a clerical error, and should have applied to item 1 only, and presented the ordinance for second reading and adoption, as amended, Councilman Tyrell moved to waive further reading by title only of ordinance No. 71 -321 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY REPEALING SECTION 9390 (56) AND ADDING SECTION 9202 (36A) TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO CONDITIONAL. USE PERMITS FOR RESTAURANTS. AND SIMILAR ESTABLISHMENTS. The motion was seconded by Councilman Harker and carried. Councilman Tyrell moved to adopt Ordinance No. 71 -321, as corrected, seconded by Councilman Harker and carried by the following roll call vote: AYES: Councilmen - Harker, Merritt, Tyrell, Gilbertson NOES: Councilmen- Briggs NEW BUSINESS: 7. RECOMMENDATION FROM PARKS & RECREATION COMMISSION- Meeting of April 27, 1971. RECOSPONSORSHIP FOR TEMPLE CITY YOUTH FOOTBALL, INC. FOR 1971. City Manager Koski presented a recommendation from the Parks and Recreation Commission for recosponsorshi.p of Temple City Youth Football, Inc., for 1971. Councilman Tyrell moved to approve, subject to insurance coverage naming the City of Temple City as co- insured. The motion was seconded by Council- men Briggs and unanimously carried. Council Minutes, May 4, 1971 - Page 2 8. RECOMMENDATION FROM PLANNING COMMISSION: Meeting of April 27, 1971. PROPOSED AMENDMENT TO TEMPLE CITY MUNICIPAL CODE RE. OUTDOOR ADVERTISING STRUCTURES AND NONCONFORMING USES. City Manager Koski advised that the Planning Commission, at their regular meeting of April 27, 1971, passed Resolution No. 71- 415PC, recommending to the City Council an amendment to the Temple City Municipal Code relating to outdoor advertising structures and nonconforming uses. Councilman Tyrell moved to set for Public Hearing on Tuesday, June 1, 1971, at 7:30 p.m., seconded by Councilman Briggs and unanimously carried. Jay Kingry, Pacific Outdoor Advertising, extended an invitation to the Council to tour either their plant at 1740 Narva, Los Angeles, or that of Foster & Kleiser at 1550 West Washington Boulevard, Los Angeles, to acquaint them with the industry, prior to action to be taken by the Council affecting their. business. George Kennedy, Kennedy Outdoor Advertising, 1101 Abbot, San Gabriel, requested that he receive information relative to the proposed amendment to the Municipal Code relating to outdoor advertising structures, and notice relative to the forthcoming hearing. 9. PROPOSED AMENDMENTS RE. CITY BUILDING LAWS: Increase in Fee Schedules. City Manager Koski advised that the County Board of Supervisors recently adopted several amendments to the County Building laws, increasing fees for building, grading, electrical, mechanical and plumbing permits by approximately 25 %, as well as an increase in the fees for processing substandard properties, provisions on unfinished buildings, and various editorial changes in Chapters 98 and 99 of the County Building Code. He advised further that the last time building permit:,fees were increased by the Council was in 1967. Following discussion of proposed changes as outlined by staff memorandum dated April 27, 1971, together with explanation of fee comparisons provided by District Engineer Biddlecomb, City Attorney Martin presented the following Ordinances for first reading: ORDINANCE NO. 71 -323, entitled AN. ORDINANCE AMENDING ORDINANCE NO. 68 -270, THE BUILDING CODE OF THE CITY-OF TEMPLE CITY RELATING TO UNOCCUPIED BUILDINGS AND TO BUILDING AND PROPERTY REHABILITATION, ORDINANCE N0. 71 -324, entitled AN ORDINANCE AMENDING ORDINANCE NO. 68 -270 OF THE CITY OF TEMPLE CITY RELATING TO FEES, ORDINANCE NO. 71 -325, entitled AN ORDINANCE AMENDING ORDINANCE NO. 68 -270 OF THE CITY OF TEMPLE CITY RELATING TO FEES, ORDINANCE NO. 71 -326, entitled AN ORDINANCE AMENDING ORDINANCE NO. 68 -270 OF THE CITY OF TEMPLE CITY RELATING TO FEES, and ORDINANCE NO. 71 -327 entitled, AN ORDINANCE AMENDING ORDINANCE NO. 68 -270 OF THE CITY OF TEMPLE CITY RELATING TO FEES, which ordinances adopt County Ordinances 10222, 10204 (except for Table 3A set forth separately), 10205, 10206 and. 10207 respectively. Councilman Tyrell moved to waive further reading, and to set for Public Hearing on June 1, 1971 at 7:30 p.m., seconded by Councilman Briggs and unanimously carried. STREET IMPROVEMENTS: PERSIMMON AVENUE - Grand Avenue to Lower Azusa (including portion of Grand Avenue and Fairview Avenue) - Approve Plans and Specifications. City Manager Koski advised that pursuant to City Council action, that plans and specifications for street improvements, Persimmon Avenue, Grand to Lower Azusa Road, east and west sides (including Grand Avenue from Persimmon Avenue, easterly and westerly to join existing curb; and Fairview Avenue, from Persimmon Avenue easterly, an extension of the original petition requested by property owners), had been prepared, and authorization was requested to advertise for and receive bids. Construction costs were estimated at $22,665, with $11,843 to be paid by property owner and $10,822 to be paid by the City. Councilman Tyrell moved to approve plans and specifications and to authorize advertising for and receiving of bids, seconded by Councilman Briggs and unanimously carried. 11. AGREEMENT: 1970 STORM DRAIN BOND ISSUE - Engineering Agreement, Los Angeles County Flood Control District and City of Temple City (revised). City Manager Koski advised that a revised agreement had now been received from the Los Angeles County Flood Control District, to replace the tentative agreement approved by the City Council on January 19, 1971, by and between the Los Angeles County Flood Control District and the City of Temple City for preparation of design on the 1970 Storm Drain Projects 8050, 9606 and 9607. Councilman Tyrell moved to approve and to authorize the Mayor and City Clerk to sign, seconded by Councilman Harker and unanimously carried. 12. RESOLUTION NO. 71 -1099: WARRANTS & DEMANDS - Demand Nos. 4011 thru 4085, in the amount of $23,514.37. Councilman Briggs moved to adopt Resolution No. 71 -1099, entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $23,514.37, DEMAND NOS. 4011 thru 4085. Councilman Merritt seconded the motion which carried unanimously. 13. COMMUNICATIONS: A. Resignation of Keith Corzine from Traffic Commission. On motion of Councilman Tyrell, seconded by Councilman Merritt and carried, the resignation of Keith Corzine from the Traffic Commission, because he no longer resides in the City was accepted with regret and the office declared open. Staff was instructed to prepare an appropriate plaque. B. Request for Replacement of Inadequate Lighting - L.O.P. A request from C. E. Carmichael, Chairman of the Kiwanis Hersperger Project to remodel the former maintenance building at Live Oak Park, for replacement of inadequate lighting fixtures in the amount of $452.43 was received. Councilman Tyrell moved to approve the purchase as an additional budget item and to appropriate additional funds in the amount of $452.43 from the General Fund and amend the adopted budget accordingly. Councilman Harker seconded the motion which carried unanimously. 14. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: A. Boyce O'Bannon, 10316 Olive - urged the City Council to take a stand against the proposed increase in the County Rax Rate. Council Minutes, May 4, 1971 - Page 4 B. Jerry Delauney, DSA Radio, 10661 Freer, spoke on several items: 1) that he would support an effort for no increase in the county tax rate, 2) requested a check of zoning for property at 9962 Olive., for use as a shop for their DSA radio station. Staff was directed to check on the matter and Mr. Delauney was advised to also contact the property owner as to its availability, and 3) Requested that a study session with the Carty Counci 1 be rescheduled. C. Dominic Mortellaro, member of the Chamber of Commerce suggested that the malls be named or numbered, so that they could be identified for special events in the malls, and that the matter be placed for budget consideration to prepare the necessary signs. He was advised that a contest might be conducted by the Chamber to suggest these names, and that the matter would receive budget consideration. D. Mayor Gilbertson noted that other representatives from the Chamber who were present this evening included Matt English, Chamber Manager, and Mrs. Penny Graham. 15. MATTERS FROM CITY OFFICIALS: A. Councilman Tyrell presented a proposal to initiate an amendment to the Charter of the County of Los Angeles which will limit the ability of the Board of Supervisors to tax. He suggested that a study be commenced to estab- lish a fair tax rate, and that appropriate petitions could then be circulated among all cities and all citizens to have this matter of referendum at the next election. B. Councilman Tyrell suggested that another effort be made concerning taxes, that the school board stop further action in connection with their contemplated implementation of flexible scheduling at Temple City High School as proposed, until such time as the majority of persons that have been elected have taken their seats. C. Councilman Tyrell expressed concern for the structure of government when people are elected who are no longer dedicated to government and refuse to salute the Flag, as has happened at Berkeley. D. City Attorney Martin suggested two other approaches in regard to limiting the County Board of Supervisors to levy tax rates, that they be limited in the number of people they represent, or consider an initiative for some change in structure whereby we would change to a burrough system where there is some form of autonomy in the burroughs. E Councilman Harker advised that he had been appointed to serve on the Transportation Planning Committee of the Southern California Association of Governments which is now reorganized and includes the Transportation Association of Southern California (TASC). The first meeting will be on June 3,1971. F Mayor Gilbertson presented Resolution No. 71 -1100 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY COMMEMORATING THE 200th ANNIVERSARY OF THE FOUNDING OF MISSION SAN GABRIEL ARCHANGEL. Councilman Tyrell moved to adopt, seconded by Councilman Merritt and unanimously carried. Council Minutes, May 4, 1971 - Page 5 G. Mayor Gilbertson presented a proposal whereby the City would take the leadership along the lines of encouraging a system, with the assistance of the Traffic Commission and Chamber of Commerce, whereby persons commuting to the inner city to work might register for share the ride, thereby reducing the number of vehicles on the road. H. Mayor Gilbertson advised that Mr. Fred Webster of the California State Department of Employment, Duarte, had suggested that while their office could not greatly assist in handling applications for the number of youth needing summer jobs, that if we could obtain some volunteers from this community, they could support them to the extent of providing supervisory assistance. This matter was referred to the Youth Commission who have already undertaken a pilot project, together with the Chamber of Commerce. 16. ADJOURNMENT: On motion of Councilman Tyrell, seconded by Mayor Gilbertson, . and unanimously carried, the meeting was adjourned to a Study Session at 8:50 p.m., following which adjournment would be to an adjourned meeting to be held on Monday, May 10, 1971, at 7:30 p.m. in the Council Chambers of the City Hall.
