Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Anne Heideman, Robert Mitchell, William Reiser; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman; Engineer, Glenn Cook; Attorney, Ron Batty 1. MINUTES OF SEPTEMBER 16, 1986 Moved by Reiser, seconded by Scherer to approve minutes of September 16, 1986, as presented. Motion declared carried 3. MINUTES OF SEPTEMBER 23, 1986 Moved by Heideman, seconded by Mitchell to approve minutes of September 23, 1986, as presented. Motion declared carried 4. POLICE SERVICE Hennepin County Sheriff's Department Mike Postle, Hennepin County Inspector, reviewed coverage now being provided to Medina; that is, assistance to provide 24 hour per day coverage, that Medina has never had, because of the number of officers on the Medina force. He stated that there has not been, or will there be any charge for that service. He explained that similar coverage is being provided to other northwest Hennepin County communities and that they contract with Medicine Lake at $32. per hour for the amount of time that Medicine Lake wants coverage, currently 8 hours per month. He stated that in the past they had contract with Plymouth and Orono when they needed assistance. Thomas Anderson asked if the existing Medina officers could work under County supervision. Inspector Postle stated that someone in Medina would need to be in charge; that in the Plymouth situation three Hennepin County deputies worked while a Sargent from Plymouth was in charge of their remaining officers; in the Orono situation a Hennepin County Deputy, in County uniform, used an Orono police car. he explained the patrol division operation and how cars are stationed in the northwest area of the county. He stated that they respond to all emergency calls in the county but do not perform some tasks such as delivering agendas or making bank deposits. He stated that the average response atime in the county is from 4-6 minutes. He explained that Greenfield is being policed entirely by Hennepin County and that they have been advised to take an appropriate amount of time to make a final decisiion as to how to provide police service. Anne Heideman asked how the paperwork was handled. Inspector Postle stated that reports could be back to the city within 24 hours or less and in the situation of there not being a local police force reports are generated on a monthly basis. He stated that Medina will be receiving reports within 24 hours. Orono Police Department Mark BErnhardson, Orono City Administrator, reviewed proposal from Orono for policing of Medina. Thomas Anderson asked if it would be a problem for Orono if Medina hired an additional officer. Mr. Bernhardson stated that it would not be a difficulty. Robert Mitchell explained that it is difficult for the Council to make a speedy decision. Thomas Anderson asked that Councilmembers call Mr. Bernhardson if they have any questions about the proposal. Police Officers 135 Thomas Anderson asked what Council wished to do about the suggestion that Medina hire one additional officer. Anne Heideman stated that she would like to consdier the idea and then take some time to decide the bigger issue of policing. Robert Mitchell stated that he was intersted in the economics of policing for Medina; that Orono's proposal should be considered and Council could then discuss the entire issue at the next meeting. Donna Roehl stated that Council should take more time to consider the issue and ask residents and businesses for their opinion. William Reiser asked if all proposals could be reviewed at a special meeting. Moved by Reiser, seconded by Scherer to hold a special meeting on October 14, 1986, at 7:00 P.M. to consider the proposals for policing of Medina. Motion declared carried Thomas Anderson requested the Police Secretary to write letters to the police officer finalists explaining Medina's situation and he asked Michael Sankey to review the Orono proposal. 5. MEDINA MANOR, SPECIAL ASSESSMENT PUBLIC HEARING, 8:20 P.M. Glenn Cook explained the final cost of the project was $58.970 with $41,470. for street construction and $17,500. for storm sewer, with a per unit assessment of $3770. Dennis Anderson, 1085 Oak Circle asked how the snow plows would avoid damaging the 2" blacktop rise on Lots 3, 4, and 5. Anne Heideman asked that Jim Dillman inspect the area in question. Dick Lecy, 1025 Highcrest Dr., reported that the ditch still does not drain. Glenn Cook stated that he would inspect the area as he was not aware of the situation. Donna Roehl stated that Mrs. Messner, 1055 Oak Circle, had asked her to find out when the project would be completed and if the residents were being assessed for the mistake that was made. Glenn Cook explained that there was some work that needed to be done near the Messner property and that the contractor had corrected the road problem at no additional cost. Moved by Scherer, seconded by Heideman to close the Public Hearing. Motion declared carried Public Hearing was closed at 8:25 P.M. Moved by Reiser, seconded by Heideman to adopt Resolution 86-80, adoption of the Medina Manor Street Improvement, Assessment roll, for a period of 10 years at 9% interest. Motion declared carried 6. TAMARACK DR. SO. SPECIAL ASSESSMENT PUBLIC HEARING, 8:30 P.M. Glenn Cook explained the cost of the project was $203,423. consisting of a blacktopped street, 22 ft. wide with 2 ft. shoulders. He explained that future plans include widen- ing the west shoulder to 4 ft., where possible. He explained tht assessment procedure to be $110,855 as the cities share with the remainder, or $92,568 divided one third front footage, or $4.10 per foot; one third unit charge ad- jacent to Tamarack or $1285 per unit and one third unit charge for properties off Tamarack but using it as a thru road, at $500 per unit. Tom Turnham, 1512 Deer Hill Rd. asked that Parcel 23-118-23 33 0001, not be assessed as it cannot be used as a separate parcel, because of size. Letter from Phil Zietlow was discussed requesting that he assessment for two lots in Meadowwoods Farm be $500, as he had combined them with his residence lot. Council agreed that each lot should have a $500 assessment because they could be subdivided and built upon at a later time. Letter from Mike Bitterman was discussed, requesting that he be assessed a $500 unit charge rather than $1285 on Parcel 23-118-23 43 0013, as his driveway had been placed onto Cherokee Rd, at the cities request and he did not exit onto TamarackDr. 1 3 (3 Glenn Cook explained that if a parcel had frontage on Tamarack Dr. if had been assessed a $1285 unit charge even though the driveway may exit onto another road. William Reiser asked that the Frank Schneider Parcel 23-118-23 34 0002 be reassessed at the $1285 per unit charge. Glenn Cook stated that a Public Hearing would need to be held for any parcels Council wished to assess at a higher rate. Mrs. Max Von Bluecher, 1425 asked for an explanation of the assessments on their property Glenn Cook explained. Moved by Reiser, seconded by Scherer to close the Public Hearing. Motion declared carried Public Hearing was closed at 8:55 P.M. Moved by Heideman, seconded by Mitchell to adopt Resolution 86-81, scheduling a Special Assessment Hearing on November 5, 1986 at 8:00 P.M. for the Frank Schneider property. Motion declared carried Council discussed whether or not to assess the project at this time or to wait until 1987 when the bonds were sold because the interest rate for bonds was not known. Moved by Heideman, seconded by Mitchell to adopt Resoluion 86-82, adoption of the Tamarack Dr. assessment roll, for 10 years at 81/2% interest, deleting parcel 23-118-23 43 0012, owned by Alex Reiser as it is a 70 ft. road easement and Parcel 23-118-23 33 0001, owned by Tom Turnham because of the size of the parcel. Motion declared carried 7. POLICE DEPARTMENT Clothing repurchase Council discussed request by Mike Sankey for reimbursement for clothing he had purchased while Chief of Police which he could not now use. Council agreed to discuss the request at the October 21st meeting. Health Insurance Moved by Mitchell, seconded by Reiser to pay $211.07 for Mike Sankey's Physicians Health Plan insurance for the month of October. Motion declared carried Demolition Derby Wilfred Scherer asked for the status of the Demolition Derby court case from August, 1985. Michael Sankey explained that it had been continued until December 3rd after having been postponed three time. Anne Theis asked if citizens have a right to ask that a case be dropped. Wilfred Scherer asked what the case had cost the city, thus far. Ron Batty stated that he was not familiar with the case. Bruce Neumann stated only one postponment was due to the drivers who had been arrested. 8. LEAGUE OF CITIES INSURANCE Thomas Anderson explained that the Hamel Fire department would like to secure insurance through the League of Cities but would need approval from Medina agreeing to be second- arily liable for payment of premiums. Moved by Heideman, seconded by Mitchell to request that the League of Cities provide insurance to the Hamel Fire Department with the City of Medina assuming secondary liability for payment of premium. Motion declared carried 9. RECYCLING PROGRAM Carolyn Smith presented a Joint Powers Agreement that she had prepared for the cities of Medina, Long Lake, Loretto, Maple Plain, Orono and Minnetonka Beach, that would provide for the establishment of an on -going recycling program. Thomas Anderson asked that the agreement include language regarding representation of city officials on the Board, how equipment and any funds would be dispersed if the group disbanded and a provision for obtaining any additional funds from the individual cities. Carolyn Smith stated that she had distributed the agreement to the various cities and would compile their comments for a final draft. '10. HOLY NAME DR. IMPROVEMENT Ginny Zeller, 300 Cheyenne Tr. explained that she had not attended an earlier public meeting regarding the improvement of Holy Name Dr. She asked if citizen input would be allowed at a future meeting as they were opposed to paving of Holy Name Dr. She stated that paving encouraged faster traffic and that horse trails were needed along such roads. Thomas Anderson explained that a public hearing would be held at a later date and that she would receive notice of the hearing. 137 11. PUBLIC WORKS DEPARTMENT Hwy. 55 Waterline Glenn Cook reviewed report regarding providing water to QX Inc., Loram Inc., and the proposed water tower area, all on Hwy. 55. He explained that QX Inc. needed water by the end of October. robert Mitchell asked if they would be willing to petition the city for water, reducing the time needed to proceed with providing them with water. Moved by Heideman, seconded by Mitchell to authorize Glenn Cook to contact QX Inc. regard- ing the possibility of their petitioning the city for water service on Hwy. 55. Motion declared carried Moved by Heideman, seconded by Scherer to adopt Resolution 86-83, acceptance of the Hwy. 55 water line feasibility report and to schedule a Public Hearing on November 5, 1986 at 8:15 P.M. Motion declared carried Elm Creek Addition, Sewer Lines Glenn Cook suggested that the city obtain prices for televising the sewer lines in the Lutz Elm Creek Addition, prior to final approval, by the city. Jim Lutz questioned the necessity of televising, as an inspector had been paid to super- vise the work as it progressed. He also asked who would pay for the televising. Moved by Heideman, seconded by Mitchell to table the matter until October 21st and secure estimates for the work before making a decision to proceed with the project. Motion declared carried Sale of 1978 Pontiac Moved by Mitchell, seconded by Reiser to authorize the sale of the 1978 Pontiac. Motion declared carried Northwestern Bell Telephone Co. Moved by Reiser, seconded by Heideman to adopt Resolution 86-83, allowing Northwestern Bell Telephone to bury lines on Elm creek Dr. and Hamel Rd. Motion declared carried Wright -Hennepin Electric Moved by Scherer, seconded by Heideman to adopt Resolution 86-84, allowing Wright -Henn- epin Electric to construct lines to serve the Greg Ebert property on Pioneer Tr. Motion declared carried Moved by Heideman, seconded by Scherer to adopt Resolution 86-86, allowing Wright -Henn- epin Electrict to construct underground service on Buckskin Dr. Motion declared carried Unpaid Utility Bills Moved by Mitchell, seconded by Reiser to adopt Resolution 86-85, certifying 1986 unpaid utility bills for 1987 Special Assessments. Motion declared carried Hunter Dr. No./Willow Dr. No. and So. Glenn Cook recommended that final approval be given to Hunter Dr. No. and Willow Dr. No. and So. and that final payment be made to Buffalo Bituminous. Motion declared carried 138 12. PLANNING AND ZONING DEPARTMENT Tally Ho Farms Moved by Heideman, seconded by Scherer to adopt Resolution 86-87, allowing for the rearrangement of lot lines in Tally Ho Farms. Motion declared carried Loram, Inc. Conditional Use Permit Moved by Heideman, seconded by Scherer to adopt Resolution 86-88, approving a Condit- ional Use Permit for Loram to construct an addition to their building at 3900 Arrowhead. Motion declared carried Elm Creek Sewer Interceptor Moved by Heideman, seconded by Scherer to adopt Resolution 86-89, requesting Metropol- itan Waste Control to take steps to construct the Elm Creek sewer interceptor. Motion declared carried Gladys Schlosser, Preliminary Subdivision Approval Moved by Heideman, seconded by Scherer to accept the recommendations of the Planning Commission regardint the Gladys Schlosser subdivision and authorize preparation of a resolution granting preliminary approval. Motion declared carried Independence Beach Street Vacation Robert Mitchell explained the neeed to revise a 1985 resolution regarding vacation of portions of several streets in the Independence Beach area due to legal descriptions of several lots that was discovered when title insurance was requested. Thomas Anderson asked if a survey of the centerline of Lakeshore Ave. should be done. Moved by Scherer, seconded by Heideman to contact Gordin Coffin surveyors and request a survey be completed for the centerline of Lakeshore Ave. in the area in question. Motion declared carried Abstaining --Mitchell Tom Haislet Bond Donna Roehl stated that Loren Kohnen, Building Inspector, had issued a final occupancy permit for the Haislet house on Homestead Tr. Moved by Scherer, seconded by Heideman to release the $10,000 bond posted by Tom Haislet for completion of house at 1902 Homestead Tr. as house now meets the Minnesota Building Codes. Motion declared carried 13. ELECTION JUDGES Moved by Reiser, seconded by Scherer to appoint three additional judges for General election; Marcia Wilcox, Wayne Hall and Marie Peterson. Motion declared carried 14. VOTING EQUIPMENT Donna Roehl explained the Optech II voting equipment that had been studied and recommended for cities in Hennepin County for elections beginning in 1988. She stated that prices were based on volume purchase and would only be guaranteed for order until December 31st. Moved by Heideman, seconded by Scherer to authorize Donna Roehl to place an order for one Optech II unit. Motion declared carried 15. 1987 BUDGET Moved by Scherer, seconded by Reiser to certify $741,184 for 1987 General Purposes and $22,200 for City Hall General obligation bonds. Motion declared carried 16. BILLS Moved by Heideman seconded by Scherer 5229 in the amount of $134,335.57 and $13,411.93.
