DISCUSSION The application by the District to the San Mateo County Local Agency Formation Commission (LAFCo) to annex the San Mateo County Coastal Annexation Area must address a number of technical questions. Therefore, the application will include the Service Plan for the annexation area, an Environmental Impact Report, and a Fiscal Analysis. The Draft Service Plan not only outlines the way in which the District will conduct its business and the services the District will provide to the annexation area, it also acts as the "project description" for the environmental review process and serves as a foundation for the fiscal analysis. At the public workshop held at the District's office in Los Altos on October 16, 2000, you provided comments and guidance concerning the content of the District's Preliminary Draft Service Plan for the San Mateo County Coastal Annexation Area. In addition to that workshop, public workshops were also held in Pescadero on October 17, 2000 and in Half Moon Bay on October 19, 2000. Subsequently, revisions have been made to the Preliminary Draft Service Plan based on comments from the general public, local agencies, and the District's Board of Directors. The Guiding Principles contained in the Draft Service Plan recognize that the District's Basic Policy, and other related policies, may not be pertinent to the particular landscape and open space resources of the coastal area or to the particular needs of the area's residents. The Guiding Principles, therefore, provide a foundation for the District's development of policies more specific to the Coastal Annexation Area once the San Mateo County LAFCo gives its final approval to that annexation. All three of these alternatives assume that the acquisition of lands or easements by the District would be from willing sellers only; that is, without the use of eminent domain. The Draft Service Plan is being presented for your acceptance as the Coastal Area Annexation project description for the Environmental Impact Report(EIR). The Draft EIR will be circulated for public comment following the guidelines of the California Environmental Quality Act (CEQA). After all revisions to the Draft EIR are completed, the District Board of Directors will hold a public hearing to certify the EIR and adopt the final Service Plan and Fiscal Analysis as part of the District's LAFCo application. We expressed our desire for an Open Space District to protect the area; but our ardent opposition to the Power of Eminent Domain. In most arenas of honest disagreement there is a small window of time in which to reach a win-win agreement. During the break, at that meeting, several Board Members asked if I would put into writing my verbal assurances of support for MROSD if MROSD would only drop the Power of Eminent Domain, In the intervening time, three events have occurred at the meetings of MROSD's Coastal Advisory Committee: • A presentation by David Hansen on July 27 demonstrating that MROSD would be far more effective if it adopted Sonoma's status as not having the Power of Eminent Domain • A presentation by Norman Matteoni, Esq., demonstrating that a "policy" provided no protection from the Power of Eminent Domain • And at the last meeting Director Hanko's comments that she would support the dropping of the Power of Eminent Domain. It therefore seems appropriate that 1, and others who are currently circulating petitions, express our support for the annexation of the Coastside by MROSD ff it will act to make the dropping of the Power of Eminent Domain a reality! I would request that the Board place on the agenda of its next meeting a Resolution authorizing a request of the State legislator for"friendly" legislation, supported by all parties with standing, to amend the Public Resuorces Code {Sec 5500-5595} eliminating MROSD's Power of Eminent Domain. It is equally clear that there is a minority which in reality do not. The "Final Draft Service Plan" is like a nice building which is built on a faulty foundation. This building might stand no longer than the next board election! Page 10, Land Acquisition: • PA rests solely on a "POLICY"! It is subject, by definition, to change. P.I.B.(i) By making this "POLICY" a Finding by S.M. LAFCo rather than providing greater protection arguably incorporates by reference the transient nature of a policy as defined by MROSD. "Permanent Policy" -on its face this term is an oxymoron. I can find no basis in this or any other document for an attribution of permanency. To the contrary, I can find an easy definition of how it may be changed. I would welcome any further documents or Code references which would allay my concerns. Short of that, I would like to reiterate my desire [inc. by ref. 22Sep99 letter] to work with you to see an Open Space District covering the Coastside without the Power of Eminent Domain whether that be at LAFCO, the Board of Supervisors or Sacramento.
