Resolution Accepting and Approving the Vacation of
Certain Public Access Easements in the Woods Estates Subdivision
WHEREAS, the City of Riverdale, Iowa, has easements over Lots 22, 23, 34, and 35 of Woods
Estates of Riverdale Third Addition, City of Riverdale, Iowa; and,
WHEREAS, the issue of the size of said easements has come to the attention of the City of
Riverdale, Iowa; and,
WHEREAS, the issue of whether the present size of said easements is a benefit to the public was
addressed at a public hearing; and,
WHEREAS, said public hearing was conducted before the city council of the City of Riverdale,
Iowa, on the 14th day of November, 2023; and,
WHEREAS, all comments at said hearing were considered by the city council of the City of
Riverdale, Iowa; and,
WHEREAS, said public hearing was conducted after Notice having been published on the 26th
day of October, 2023, in the Quad City Times; and,
WHEREAS, Iowa Code Section 354.23, allows a City to vacate part of an official plat if the City's
interest in said real estate is of no benefit to the public; and,
WHEREAS, the City of Riverdale, Iowa, deems it to be in the public interest to vacate the
easements as described below.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Riverdale, Iowa, that:
Section 1. That the City of Riverdale, Iowa, vacates its interest in the following described real
estate:
1. Part of the 15.00 foot public access easement being the south 14.00 feet of
the north 15.00 feet of lot 22 of Woods Estates of Riverdale Third Addition
an official plat, in and forming a part of the city of Riverdale, Scott County,
Iowa.
2. Part of the 15.00 foot public access easement being the north 6.00 feet of
the south 15.00 feet of lot 23 of Woods Estates of Riverdale Third Addition
an official plat, in and forming a part of the city of Riverdale, Scott County,
Iowa.
3. The public access easement being the east 15.00 feet of lot 34 of Woods
Estates of Riverdale Third Addition an official plat, in and forming a part of
the city of Riverdale, Scott County, Iowa.
4. Part of the 15.00 public access easement being the east 5.00 of the west
15.00, except the south 60.00 feet of said west 15.00 feet and the east 4.00
feet of the west 15.00 of the south 60.00 feet, all of lot 35 of Woods
Estates of Riverdale Third Addition an official plat, in and forming a part of
the city of Riverdale, Scott County, Iowa.
Section 2. That this Resolution shall be filed and indexed as a conveyance in the records of
the Scott County Recorder and the Scott County Auditor.
Section 3. The City Clerk and the Mayor of the City of Riverdale, Iowa, are authorized to
execute any documents necessary to effect this Resolution.
