HomeMy Public PortalAbout047-2001 - Rezoning - Wernle and Henley Rds.ORDINANCE NO. 47 - 2001 A SPECIAL ORDINANCE AMENDING THE REZONING AT SOUTH SIDE OF WERNLE ROAD AND RUNNING EAST FROM INTERSECTION WITH HENLEY ROAD WHEREAS, the Zoning Map designates and describes the property at South side of Wernle Road and running east from intersection with Henley Road, as A-1 District; and WHEREAS, it is desirable to change the zoning designation to a R-1 District to allow the use of the property for construction of single family residential dwellings, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of the property at South side of Wernle Road and running east from intersection with Henley Road, and more particularly described below is hereby changed to a R-1 District to allow the use of the property for construction of single family residential dwellings: Situated in the Southeast Quarter of Section Ten (10), Township Thirteen (13) North, Range One (01) West, Wayne Township, Wayne County, Indiana, including approximately 6.744 acres currently described in Deed Records Volume 454, Page 361, parts of Lots 1 through 3, parts of Lots 5 through 14 of Forest Hills Estates as recorded in Instrument Number 1996004396, and all of Woodbine Hills Section 1 as recorded in instrument Number 2000005844 in the Office of the Wayne County Recorder, and being more particularly described as follows: Beginning at the northwest corner of said Southeast Quarter, in the intersection of Wernle Road and Henley Road; Thence South 00º03’29” East 750.00 feet along the west line of said quarter to the TRUE POINT OF BEGINNING for the tract herein described; Thence North 89º37’15” East 1686.04 feet along the south line of the existing R1 Zoning, also being the north line of the existing A1 Zoning; Thence South 00º03’32” East 5.28 feet, to a point; Thence North 89º56’28” East 374.47 feet, to a point; Thence South 00º33’50” East 1270.15 feet, to the southeast corner of Lot 13 of Forest Hills Estates; Thence South 89º56’48” West 619.97 feet along the south line of said Lot 13, to a point of curve, non-tangent, concave northeastwardly, and having a radius of 25.00 feet; Thence along said curve, to the left, through a central angle of 34º40’53”, an arc distance of 15.13 feet, (the chord for said curve bears South 30º49’18” East 14.90) to a point of reverse curve, tangent, concave northwardly and having a radius of 50.00; Thence along said curve, to the right, through a central angle of 276º22’45”, an arc distance of 241.19 feet, (the chord for said curve bears North 89º58’21” West 66.67) to a point of reverse curve, tangent, concave northwestwardly and having a radius of 25.00; Thence along said curve, through a central angle of 34º30’37” an arc distance of 15.06 feet, (the chord for said curve bears North 30º57’43” East 14.83) to a point on the north line of Lot 9 of Forest Hills Estates; Thence South 89º56’48” West 674.33 feet along the north line of said Lot 9, to a point; Thence South 00º32’29” East 655.86 feet along the west line to a point; Thence South 89º24’28” West 726.02 feet along the south line of said Southeast Quarter, to a stone found at the southwest corner of said quarter; Thence North 00º03’29” West 1928.45 feet along the west line of said quarter, to the point of beginning, containing 71.431 acres, more or less.
