HomeMy Public PortalAboutOrdinance 01:31No. 01-31 rrmsh (gart rd, AN O~INANCE AMENDING AND S~PLEMENTING ARTICLE I "GENE~L PROVISIONS" OF CHA~ER 198 "PROPERTY MAINTENANCE" OF THE CODE OF THE BOROUGH OF CARTE~T BE IT ORDAINED by the Mayor and Council of the Borough of Carteret (the "Borough") as follows: SECTION 1. Chapter 198, Article I, of the Code of the Borough of Carteret entitled "General Provisions" is hereby amended and supplemented to add a new section, 198- 17.l, to read as follows: 198-17.1-Repeat Violator(s) Any abatement period provided for pursuant to a Notice of Violation issued in accordance with the provisions of this Article, any chapter of Part II of this Code, or any other Ordinance of the Borough shall not apply to repeat violators. Said repeat violators shall be subject to immediate action by the appropriate enforcement officer and may be immediately issued a summons for a violation of any such provision. For the purposes of this Article, repeat violator(s) shall mean a person or persons who has previously been served with a notice of violation within the last two (2) years for a substantially similar violation of this Article. SECTION 2. All Ordinances or parts thereof inconsistent with the provision of this Ordinance are hereby-repealed limited to the extent of any such inconsistency. SECTION 3. If any section, paragraph, subdivision, clause or provision of this Ordinance is adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of this Ordinance shall be deemed valid and effective. SECTION 4. This Ordinance shall take effect upon passage and publication according to applicable law.
