HomeMy Public PortalAboutResolution 87-2745RESOLUTION NO. 87 -2745 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING ZONE VARIANCE 87 -867, A REQUEST BY THEMISTOKLES KATSAROS FOR A ZONE VARIANCE TO ALLOW A STORAGE ROOM ADDITION 2' 6" INSTEAD OF THE REQUIRED FIVE (5) FEET FROM THE REAR PROPERTY LINE ON A RE- VERSE CORNER LOT LOCATED AT 6050 LOMA AVENUE The City Council of the City of Temple City does hereby resolve as follows: Section 1. Based upon a public hearing for a Zone Vari- ance to allow a storage room addition within 2' 6" instead of the required five (5) feet from the rear property line on a reverse corner lot in the R -1 Zone the Planning Commission finds: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property, which do not generally apply to other properties in the same zone in that this property is a reverse corner lot thus restricting the property owner from constructing a storage room addition within 2 -1/2 feet from the rear property line; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other properties similarly situated but which is denied to the property in question in that other properties in the vicinity being interior lots may have an addition of this nature without need of a Zone Variance, and in fact could in most cases build a similar addition directly adjacent to the rear property line; and 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent property in that the proposed addition would be sharing a yard area with another accessory structure (garage) similarly situated to the rear of a lot; and 4. That there are special circumstances as provided in Sec- tion 65906 of the California Government Code in that this property because of its location and the strict applica- tion of the Zoning Ordinance deprives it of privileges enjoyed by other property in the vicinity and under iden- tical zoning classification. Section 2. This project is categorically exempt from Environmental Review in accordance with Section 15303 of the State CEQA Guidelines. Section 3. Accordingly, said variance is approved subject to the following conditions: 1. That the development be in substantial conformance with the submitted development plans date stamped September 14, 1987, except as modified herein. 2. That the applicant obtain the necessary building permits for the addition. 3. The proposed addition shall contain no plumbing. Section 4. The City Clerk shall certify to the adoption of this Resolution. Resolution No. 87 -2745 - Page 2 PASSED, APPROVED AND ADOPTED this 3rd day of November, 1987.
