HomeMy Public PortalAboutResolution 87-2749RESOLUTION NO. 87 -2749 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING CONDITIONAL USE PERMIT 87 -876 AND ZONE VARIANCE 87 -877, A REQUEST TO ALLOW TWO (2) ADDITIONAL DWELLING UNITS ON A SITE WITH AN EXISTING SINGLE FAMILY RESIDENCE IN THE R -3 ZONE AT 5945 PRIMROSE AVENUE. ALSO A ZONE VARIANCE TO ALLOW THE SECOND STORY PORTION OF THE PROPOSED BUILDING TO BE TEN (10) FEET FROM THE SIDE PROPERTY LINE IN LIEU OF THE REQUIRED FIFTEEN (15) FOOT SETBACK THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: Section 1. Based upon a public hearing for the above referenced Conditional Use Permit and Zone Variance, the City Council finds: CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that it provides 50 feet of lot width and 175 feet of depth; and 2. That the site has sufficient access to streets and highways adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that it fronts Primrose Avenue, a local street, with a 60 foot right -of -way; and 3. That the proposed use will not have an adverse effect on the use, enjoyment or valuation of adjacent pro- perty or upon the public welfare in that the proposal complies with the density restrictions set forth in the General Plan and Zoning Code. ZONE VARIANCE 1. That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of such property, which do not generally apply to other properties in the same zone in that many neighboring properties similarly zoned are already developed with high density residential projects, many with non- conform- ing setbacks and parking; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right pos- sessed by other property similarly situated but which is denied to the property in question in that other properties have narrower setbacks and a lesser number of overall parking spaces; and 3. That the granting of the variance will not be materi- ally detrimental to the public welfare or injurious to the adjacent property in that the access to park- ing facilities would be taken from an alley located at the rear of the site and away from Primrose Avenue. Also the second story portion of the pro- posed building would be a minimum of 10 feet from the interior side property line; and 4. That there a special circumstances as provided in Section 65906 of the California Government Code in that this variance would not be the granting of a special privilege inconsistent with either the Gen - eral Plan or the Zoning Code. Section 2. This project is categorically exempt from environmental review in accordance with Section 15303 (b) and 15305 of the State CEQA Guidelines. Resolution No. 87 -2749 - Page 2 Section 3. Accordingly, the Conditional Use Permit and Zone Variance are approved subject to the following conditions: 1. That the proposed development is in substantial compliance with the submitted development plans date stamped November 6, 1987, and comply with all stan- dard conditions of approval for multiple family residential development (Attachment "A "). 2. A minimum six foot high block wall be provided and continuously maintained upon the perimeter of the subject site except the front yard area. All proposed wall detail shall be subject to approval by the Planning Department. 3. That detailed trash enclosure plans be approved by the Planning Department prior to the issuance of buildings permits. 4. That detailed landscape and irrigation plans be submitted prior to the issuance of building permits. Said plans shall include at least one 15- gallon size tree for each dwelling unit. 5. Any and all work within public right -of -way or alleys shall conform to adopted standards of Los Angeles County. 6. If any work is proposed on Primrose Avenue new curb, gutter and drive approach will be required. 7. Existing mature street trees shall be protected and maintained undisturbed. 8. Adequate surface run off facilities shall be provided on the subject property as required by City Code. No run off shall be allowed to flow across the side- walk. 9. Sewers and sewer easements shall be required as necessary and as required by the development. 10. Appropriate permits shall be obtained prior to com- mencement of any work in the public right -of -way. Section 4. The City Clerk shall certify to the adoption of this Resolution.
