MINUTES
REGULAR MEETING
I. ROLL CALL
President Ken Nitz called the meeting to order at 7:30 P.M.
Members Present: Jed Cyr, Mary Davey,Nonette Hanko, Deane Little (arrived at
7:33 p.m.), Peter Siemens, and Ken Nitz.
Members Absent: None
Staff Present: Craig Britton, Thomas Fischer, Cathy Woodbury, Deirdre Dolan, Lisa

11. ORAL COMMUNICATIONS
Judy Baker, 27544 Canyon Road, Los Altos, thanked the District for maintaining the
land. She said Eucalyptus trees have been here since the 1800's. She asked why not
preserve them as a Eucalyptus grove. The oak trees are getting old. She said it was
difficult to keep things the same indefinitely and she would present a petition signed by
those opposed to the cutting of Eucalyptus trees at Pulgas Ridge Open Space Preserve.
Carolyn Chaney, 313 Lakeview Way, Redwood City, said the response to her letter did
not address her concerns. She said she had measured 1,000 square feet under two parts of
the Preserve, one under oak trees and one under Eucalyptus trees. She said the
Eucalyptus trees seem to foster growth of native species. She said there is a profusion of
Eucalyptus trees growing out of stumps where trees have been cut. She had gotten in
touch with Professor Barbara Holtzman from San Francisco State who is probably
California's leading expert on Blue Oaks. She walked with her there, and she was
excited to see the growth of baby oaks and other native species under Eucalyptus trees.
She said there are other non-natives such as acacia, cactus, and broom which could be
removed. She expressed concerns about the selection of trees to be cut. She asked for a
postponement so she and Ms. Holtzman could look at the management plan at Pulgas
Ridge for the cutting to see how the trees were chosen.
K. Nitz informed Ms. Chaney that they did a seeding with acorns.

III. ADOPTION OF AGENDA
Motion: J. Cyr moved that the Board adopt the agenda. P. Siemens seconded and
the motion passed 6 to 0.
IV. ADOPTION OF CONSENT CALENDAR
N. Hanko removed the draft response to the written communication from Carolyn
Chaney. K. Nitz removed agenda item 5, Cancellation of November 8 and 22 Reguular
Board Meetings and Scheduling of Special Meetings of the Board of Directors for
November 15 and November 29, 2000 Beginning at 7:30 P.M.; and agenda item 6,
Annual Seasonal Trail Closures Information Report, Review and Comment on Proposed
Trail Closures.
N. Hanko clarified that she was absent at the meeting where the vote to cut the
Eucalyptus took place. She said she would have voted against the cutting because she
feels Eucalyptus trees have been here long enough to be called natives.
Motion: M. Davey moved that the Board adopt the Consent Calendar, including
approval of the minutes of the September 27, 2000 and October 11, 2000
Special and Regular Meetings; draft responses to written communications
from Hans H. Mueller, 3295 La Mesa Drive#11, San Carlos; Ms. Carolyn
Chaney, 313 Lakeview Way, Redwood City; Ms. Caroline Moore, 1909
Newman Place,Mountain View; Ms. Mikala Caune, 504 Clifton Avenue,
San Jose; and Mr. Richard Moyer, 872 Fielding Drive, Palo Alto; agenda
item 4, Authorization to Purchase One Tractor Mower, Direct the General
Manager to Execute a Purchase Contract with the State Department of
General Services and Powerland Equipment for One Tractor Mower at a
Total Cost Not to exceed $70,000; and Revised Claims 00-17. J. Cyr
seconded the motion. The motion passed 6 to 0.
V. SPECIAL ORDER OF THE DAY
D. Dolan introduced Janet Beaugh who was recently hired as Human Resources
Management Analyst. C. Britton introduced John Maciel, newly hired Operations
Manager.
Matt Freeman introduced and demonstrated some new technology acquired by the
District, including a laptop computer and an LCD projector.
VI. BOARD BUSINESS
A. Agenda Item No. 1 —Status Report on Bear Creek Redwoods Open Space
Preserve, Accept the Oral and Slide Presentation on the Status of Staff Activities
at Bear Creek Redwoods Open Space Preserve—(Report R-00-133).

Staff members reported on the status of various areas at the preserve as follows:
• M. Newburn—Site Safety and Improvements
• S. Sommer- Demolition
• T. Fischer—Bear Creek Stables
• D. Dart—Logging
• M. Newburn—Permits
T. Fischer said they have started monitoring and testing the creek, and the results
are inconclusive. Samples were taken from up and down stream. They are trying
to get information from the County regarding limits of toxics. Board members
commended staff for the presentation.
B. Agenda Item No. 2—Consideration of Adoption of a Resolution Urging Stanford
University to Define Future Land Use and Provide Long-Tenn or Permanent
Protection of Critical Open Space Areas in its Community Plan; Review, Discuss,
Amend and Adopt the Resolution Urging Stanford University to Provide Clear
and Significant Long-Term or Permanent Protection for Open Space Areas in its
Community Plan Proposed for Consideration to Santa Clara County Board of
Supervisors— Report R-00-137.
C. Britton referred to the text of Supervisor Joe Simitian's comments from the
night before and to a letter written by Shute, Mihaly & Weinberger on behalf of
the Committee for Green Foothills. He said he would go to the County hearings
on October 30 (and 31) and present the Board's resolution.
M. Davey said the Palo Alto city council passed unanimously a resolution urging
permanent protection of open space. They also requested that the academic
growth boundary be coterminous with the county's and agreed to keep the golf
course along the urban growth boundary. She said Simitian's proposal last
evening was new to everyone and was a shock to Stanford. They were unaware
that he was going to recommend 99-year protection of open space west of
Junipero Serra Blvd. and 25 years for an additional 1,200 acres which were un-
designated and undefined. She agreed that the Shute, Mihaly & Weinberger letter
should be quoted in the resolution but thought some other things should be added,
including the following:
• The County should urge that Stanford voluntarily allow public access to the
open space in addition to access to the paths on San Francisquito and
Matadero Creeks (page 15 of Simitian's comments to the public).
• Stick to the academic growth boundary, and state that it should be permanent
for 25 years and should exclude the Lathrop 36 acres and the golf course.
• Early protection of tiger salamander and red-legged frog habitat should be
included in the County's work program.
• Additional language to make it clear that the academic growth boundary for
the County and Stanford and the urban growth boundary of the City of Palo
Alto are coterminous and are protected for a firm 25 years.

N. Hanko commented on Supervisor Simitian's proposal for 99 year protection of
1,000 acres, noting that it stated for a period of 99 years or the life of the
development, whichever was shorter.
M. Davey said there were three unanswered questions: 1. Definition of where the
first thousand acres is. 2. If you can do 1,000 acres in 99 years, why can't you do
all of it. 3. Which comes first and what is meant by the end of the development—
destroyed or redevelopment?
N. Hanko suggested that there be a clearer definition of what is permitted and
where in reference to open space and field research zone districts.
C. Woodbury emphasized the density bonus overlay, stating that it furthers and
clarifies the concept of the compact urban development. In addition, it provides a
mechanism for implementing it by tying any density bonus to the actual deed
restriction or conservation easement to preserve forever that open space land.
C. Britton said staff would work with M. Davey and N. Hanko on the final
language of the resolution.
M. Davey recognized Denise Dade, Peter Dreckmeier, and Tom Jordan as the
spearheads of innovation and organization in the whole matter.
Zoe Kersteen-Tucker, President of the Committee for Green Foothills, asked for
the Board's continued support. She said the Committee believes that J. Simitian
took a bold step, but they believe that the County has the legal authority to require
permanent protection of all 2,200 acres. She suggested that the Board spell out
the academic growth boundary in more detail, and said the Committee would like
to see the ratio be 1,000 square feet per acre rather than leave it unspecified. They
asked that the open space priority begin at Junipero Serra Blvd. and work west.
Discussion followed about whether to use the term "permanent"protection, and
proposals for priority areas. C. Britton suggested they might want to say begin at
Junipero Serra Blvd. and work west.
C. Britton added that this is the first time that Stanford has come up with a plan
and he thought this was the District's chance to do something. He said everybody
needs to stand up and be counted. The District should take a strong stand for
preservation of open space. He suggested that they include in the resolution
reference to two open space preservation priorities: First priority - the area
between Junipero Serra Blvd. and Highway 280. Second priority—the area west
of Highway 280. He requested permission to streamline the resolution and said
they would bullet and/or highlight points.
Motion: N. Hanko moved that the Board adopt Resolution No. 65,
Resolution of the Board of Directors of the Midpeninsula Regional
Open Space District Urging Stanford University to Offer, and

Santa Clara County to Require, Permanent Protection of
Significant Open Space Areas in the Stanford University
Community Plan. D. Little seconded the motion. The motion
passed 6 to 0.
C. Agenda Item No. 3—Appointment of Unopposed Candidates in Wards 4 and 7;
Adopt the Resolutions Appointing_Unopposed Ward 4 Candidate Deane Little,
and Unopposed Ward 7 Candidate Kenneth C.Nitz to Four-year Terms, Which
Will Begin on January 1, 2001; Have the District Clerk Administer the Oath of
Office to the Appointed Directors—(Report R-00-131 .
D. Dolan presented the staff report.
Motion: J. Cyr moved that the Board adopt Resolution No. 77, Resolution
of the Board of Directors of the Midpeninsula Regional Open
Space District Appointing Director—Ward 4 of the Board of
Directors of the Midpeninsula Regional Open Space District; adopt
Resolution No. 78, Resolution of the Board of Directors of the
Midpeninsula Regional Open Space District Appointing Director—
Ward 7 of the Board of Directors of the Midpeninsula Regional
Open Space District; and direct the District Clerk to administer the
Oath of Office to the appointed Directors. P. Siemens seconded
the motion. The motion passed 6 to 0.
D. Dolan administered the Oath of Office to Directors Nitz and Little.
D. Agenda Item No. 5 - Cancellation of November 8 and 22 Regular Board
Meetings and Scheduling of Special Meetings of the Board of Directors for
November 15 and November 29, 2000 Beginnin at t 7:30 P.M. —(Report R-00-
136).
C. Britton reviewed the Board meeting schedule for November. M. Davey
requested that they schedule the meeting for November 28 instead of November
29.
Motion: M. Davey moved that the Board cancel the November 8 and
November 22, 2000 Regular Meetings and schedule Special Board
Meetings for November 15 and November 28, 2000 beginning at
7:30 P.M. P. Siemens seconded the motion. The motion passed 6
to 0.
E. Agenda Item No. 6- Annual Seasonal Trail Closures Information Report;
Review and Comment on Proposed Trail Closures—(Report R-00-134).

K. Nitz said he thought Sausal Trail (Item 12 of the table) should be designated
Seasonal Interim for equestrians. Other Board members agreed and staff will
correct the table.
VII. INFORMATIONAL REPORTS
J. Cyr: 1. He said he was involved in election activities. He asked about the condition of
the person who was injured on District land. 2. He received a note from B. Crowder's
family thanking him for the comments he made at the memorial service. 3. He went to
the legislative breakfast with D. Little, S. Jensen, and C. Britton.
M. Davey. 1. She had attended the National Land Trust Rally in Portland and said this
District is known nationally. She talked about the seminars she attended.
K. Nitz said he was leaving on vacation Sunday.
C. Britton: 1. He reported on M. Fosters heart problem. 2. He had executed two
emergency permits. The information was in the FYIs. 3. He had a printout of where the
money (about$450 million for one year) is going for the fifteen year program for the
Land and Water Conservation Fund Program if it is approved. Out of the $89 million
appropriated to states, California would get $7.7 million; half would go to state projects
leaving $4 million divided between north and south California, leaving about $1.5 million
for northern California. 4. He had a newsletter from Cargill Salt Co. including a map of
proposed 19,000 acres they might want to sell. 5. Regarding the Land Trust Rally,he
added that the convention center is owned by Metro which is a special district. Peggy
Coats is now one of their budget analysts. He talked about the seminars, including power
listening, and subordination of mortgages for easement acquisition.
D. Dolan said that Mary Ann King, District receptionist, had submitted her resignation
and will be moving out of the area.
S. Jensen: 1. The Creatures of the Night event will be October 13. 2. She is working on
stories on the coastal meetings and dog access.

Donation of Two Surplus District Vehicles to Stevens reek Volu teer Fire Department
GENERAL MANAGER'S RECOMMENDATIO
Determine that the donation of two District pick up trucks,which are scheduled to be declared surplus
property,will further the purposes of the District, and authorize the General Manager to proceed with the
donation.
DISCUSSION
Stevens Creek Volunteer Fire Department has requested the District's assistance in obtaining two patrol-type
vehicles to assist in their response to incidents in wildland areas. The District has two vehicles which are
intended to be declared surplus property,and which would meet the Fire Department's needs. The trucks
involved are a 1991 Dodge and a 1993 Chevrolet.
The District has had a close working relationship with the Stevens Creek Volunteer Fire Department,which
medical response to incidents on District land especially provides mutual aid fire and emergency p p y in the Monte
Bello Ridge and Stevens Canyon areas.
The two vehicles identified as being eligible to be declared surplus have been utilized as patrol vehicles. The
age and mileage of the vehicles are beyond the standards set by the District, but would be appropriate for
utilization by the Fire Department,which does not accumulate many miles on their vehicles. The Fire
Department has stated that they have the capability to do the necessary maintenance and repair on the vehicles
in order to bring them up to their standards, so that the vehicles will remain available to respond to fires and
other emergencies on District lands.
Staff believes that this donation will further the purposes of the District. The District has statutory
responsibility for fire suppression on its land and enters into cooperative agreements with other agencies and
entities to provide fire mutual aid suppression services. The Stevens Creek Volunteer Fire Department
provides such services to the District, and will use the donated vehicles to provide these services on District
lands. The donation of these two trucks to this volunteer fire department is appropriate, given the close
working relationship between the two agencies. The combined value of these vehicles is estimated to be
$5,000 to$7,000.

Tentative Adoption of an Amendment to the Use and ent Plan for Russian Ridge Open
Space Preserve to Open the Ridge Trail to Bicycles
GENERAL MANAGER'S RECOMMENDATIONS
l. Tentatively Adopt an Amendment to the Use and Management Plan for Russian Ridge
Open Space Preserve designating the Ridge Trail between the Hawk Trail junction and
Rapley Ranch Road a multi-use trail.
2. Determine that the proposed actions are categorically exempt from the California
Environmental Quality Act (CEQA)based on the findings of this report.
DISCUSSION
At your December 20, 2000 meeting (Report R-00-155), you directed staff to prepare an
amendment to the Use and Management Plan for Russian Ridge Open Space Preserve in order to
provide bicycle access to the remaining 1.4-mile segment of the Bay Area Ridge Trail. With this
addition of 1.4 miles, the entire section of the Ridge Trail in the South Skyline Region, from
Rapley Ranch Road to the junction of Page Mill Road and Skyline Boulevard, will be open to
multi-use. This section of trail has been closed to bicycles because the former owners specified
in the purchase agreement that bicycles would not be allowed on the adjacent property being
acquired by the District as long as the owners were residing on their land (see Report R-92-130).
As the property has now transferred owners, the bicycle restriction on the District's adjacent
property is no longer applicable.
The 1.4-mile trail segment wraps around the base of Mt. Melville and runs between the Hawk
Trail and Rapley Ranch Road (see attached map). It is an incredibly scenic section of the Ridge
Trail, with sweeping views of coastal hills and the ocean. Staff feels that there will be few
problems opening this trail segment to bicyclists, as it is in good condition and has a gentle grade
following the alignment of the ridge top. Also, although the trail is narrow enough to provide
bicyclists a"single track" experience, it has an excellent line-of-sight as well as enough room
alongside to allow bicyclists to pull over for hikers and equestrians. Photo-monitoring sites will

be established in conjunction with the resource management program to observe the change in
impact, if any, on the trail from bicycle use.
Tentatively adopting this amendment will allow the public additional time to comment. Staff
anticipates returning to the Board of Directors in March or April of 2001 for the final reading of
this proposed amendment to the Use and Management Plan. The actual opening of the trail to
bicycles will occur after your final adoption of this amendment.
CEQA COMPLIANCE
The District concludes that this Use and Management Amendment will have no significant
impact on the environment and is, therefore, categorically exempt from California
Environmental Quality Act(CEQA) under sections 15301 and Section 15061 (b) (3).
Section 15301 addresses the operation of existing public facilities involving negligible expansion
of use beyond that previously existing. This project consists of allowing bicycles to use an
existing public trail. No alterations of existing physical conditions of the land are proposed and
staff anticipates a negligible expansion of existing use.
Section 15061 (b) (3) provides that a project is exempt from CEQA when it can be seen with
certainty that there is no possibility that the activity may have a significant effect on the
environment. This project allows bicycles to use an existing trail and will not result in a physical
change to the environment.
PUBLIC NOTIFICATION
Staff notified the following people concerning this evening's meeting: the adjoining owners to
Russian Ridge Open Space Preserve,people who have expressed interest in bicycle use on the
preserves, and subscribers to the Board meeting agendas.

Approval of Access Easement and Maintenance Agreement or Pro sed Connor Property Addition to
Russian Ridge Open Space Preserve
GENERAL MANAGER'S RECOMMENDATION
Adopt the attached resolution approving the Access Easement and Maintenance Agreement with the
Connor Trust for Rapley Road to complete the acquisition of a portion of the Connor property as an
addition to the Russian Ridge Open Space Preserve.
DESCRIPTION (see attached man)
At your meeting of December 13, 2000, the Board approved the purchase of the 98.16-acre portion of the
267.7-acre Connor property as an addition to Russian Ridge Open Space Preserve (see report R-00-142).
As part of this transaction, the seller is retaining and reserving easements to Rapley Road from Skyline
Boulevard to serve as access to the remaining Connor property. The attached agreement sets forth the
road maintenance obligations and responsibilities. Currently, Rapley Road is maintained by Langley Hill
Quarry, whose business constitutes the heaviest use of this road. Key terms of this agreement include:
1. The parties' road maintenance obligations are based upon each parties' proportionate use of the road
compared to the use by all parties who hold access easements to Rapley Road.
2. The agreed upon road standard is to an unpaved condition passable by passenger vehicles in all
weather conditions.
3. If the owners of the remaining Connor property are required to improve the road as part of the
subdivision or future development, those property owners shall be responsible for all costs associated
with the improved roadway. The District will cooperate with development of required roadway
improvements.
This road maintenance agreement is consistent with the District's Policies for Road Maintenance
Agreements.

The Board of Directors of Midpeninsula Regional Open Space District does resolve as follows:
Section One. The Board of Directors of Midpeninsula Regional Open Space District previously
approved that certain Purchase Agreement dated December 13, 2000 by and between William E.
Connor H Living Trust u/t/a and Midpeninsula Regional Open Space District by Resolution No.
00-69, which remains in full force and effect. In order to complete said purchase transaction, it is
now necessary to enter into an Access Easement and Maintenance Agreement for the remaining
Connor ro ert .

Section Two. The Board of Directors does hereby approve and accept the that certain Access
Easement and Maintenance Agreement with William E. Connor II Living Trust u/t/a, a copy of
which is attached and incorporated by this reference, and authorizes the President or other

Section Three. The General Manager and General Counsel are further authorized to approve any
technical revisions to the attached Agreement and documents which do not involve any material
change to any term of the Agreement or documents, which are necessary or appropriate to the
closing or implementation of this transaction.

ACCESS EASEMENT AND MAINTENANCE AGREEMENT
This Access Easement and Maintenance Agreement is made and entered into as of the

William E. Connor II LivingTrust ult/a dated August 20 1991 "Connor" and the

Midpeninsula Regional Open Space District, a Public District formed pursuant to Article
3 of Chapter 3 of Division 5 of the California Public Resources Code("District").
WHEREAS,Connor is the owner of those certain parcels of land located in the
unincorporated area of San Mateo County, California, more particularly described as
Parcels 1,2 and 3 in Exhibit A, attached hereto and made a part hereof("Connor
Property"),
WHEREAS, Connor has entered into an agreement dated November 20,2000 to sell to
the District a portion of the Connor Property more particularly described as Parcel 1 in
Exhibit A, attached hereto and made a part hereof("District Property");
WHEREAS,Connor is retaining that portion of the Connor Property remaining after the
conveyance to the District of the District Property ("Remaining Connor Property");
WHEREAS, as part of the conveyance of the District Property to the District,Connor
retains or reserves various perpetual non-exclusive easements in favor of and appurtenant
to the "Remaining Connor Property" over and across the District's Property for utilities
and for pedestrian and vehicular ingress and egress to and from the Remaining Connor
Property, and a perpetual non exclusive easement in favor of and appurtenant to the
Remaining Connor Property over the District Property for grading,paving and otherwise
improving and/or maintaining the easement roadway as is set forth more fully below; and
WHEREAS,it is the intention of the parties hereto that the reservations,agreements,
terms and conditions contained herein supplement the various reservations of easements
contained in that certain Grant Deed between Connor(as grantor) and the District(as
grantee)dated January 10, 2001,recorded as Document No. in the

Mateo County, State of California; thence from said point of beginning and running
northeasterly along the centerline of said roadway to a point of intersection with a straight
line drawn from the Easterly 1/4 section comer of said Section 7 to the Northwest corner
of the Southwest 1/4 of the Northeast 1/4 of said Section 7, said point of intersection
being the terminus of the hereinabove described 50 foot easement for purposes of
installation and maintenance of public utilities; pedestrian and vehicular ingress and
egress to and from the Remaining Connor Property; and for purposes of grading,paving,
and otherwise improving and/or maintaining said roadway.
3. Maintenance of Rapley Road. Pursuant to California Civil Code Section 845,Connor
and District shall each contribute all amounts necessary to maintain that portion of
Rapley Road which traverses the Remaining Connor Property and the District Property in
proportion to their respective ctive actual use of Rapley Road when compared to the actual use

of Rapley Road by all parties who hold easements for use of Rapley Road. Rapley Road
shall be maintained to the following standard: an unpaved condition passable by
passenger vehicles in all weather conditions in accordance with the District's Policies for
Road Maintenance Agreements adopted on June 23, 1982. In the event that Connor
desires to improve that portion of Rapley Road which traverses the District Property
and/or the Remaining Connor Property to a standard greater than the standard stated
above including, but not limited to paving,or the installing of curbs, gutters, or utilities,
all such improvements and all costs of repair and maintenance of said improvements shall
be at the sole cost and expense of Connor. The District will fully cooperate, to the extent
allowed by law, with Connor if Connor is required to undertake reasonable roadway
improvements/modifications by any governmental entity as a condition to the
development or further subdivision of the Remaining Connor Property,provided,
however that all such compliance and cooperation by the District will be at the sole cost
and expense of Connor.
4. Appurtenant Easements. The parties hereto expressly agree that the reservations of
easements made herein and in the Grant Deed are appurtenant to the Remaining Connor
Property and shall run with the land pursuant to any and all applicable laws,including,
but not limited to, Sections 1462 and 1468 of the California Civil Code.
5. Successors and Assigns. This Agreement shall be binding upon and inure to the
benefit of the parties hereto and their respective successors and assigns.
6. Attorneys Fees. In the event of any litigation or arbitration arising out of this
Agreement, the prevailing party shall be entitled to recover from the other all attorneys
fees and costs incurred therein.
7. Further Assurances. Each of the parties hereto agrees to execute such documents, and
perform such acts, as may be necessary to give full effect to the agreements contained
herein.
8. Partial Invalidity. The invalidity, illegality or unenforceability of any one or more
provisions of this Agreement shall in no way effect or impair the validity, legality or
enforceability of the remaining provisions hereof, which shall remain in full force and
effect.
9. Preparation of Agreement. No inference, assumption or presumption shall be drawn
from the fact that a party or his attorney prepared and/or drafted this Agreement. It shall
be conclusively presumed that both parties participated equally in the preparation and/or
drafting of this Agreement and that each party has sought the advice of its separate
counsel and has placed no reliance on the other party's counsel.

GENERAL MANAGER'S RECOMMENDATIO — —'
Authorize the General Manager to enter into a contract with Bay Construction Services Inc. of Hayward,
California in the bid amount of$144,157, plus a 10% contingency amount, for a total contract amount not
to exceed $158,573 for the Improvements to the District's Administrative Office Building at 330 Distel
Circle in Los Altos.
DISCUSSION
At your regular meeting on December 20, 2000, you authorized staff to solicit bids for improvements to
the District's Administrative Office Building in Los Altos (see Report R-00-157).
The report was discussed at that time and was the basis for developing the bid documents. The base bid
included sufficient equipment, labor and materials to accomplish the main features of the improvement
project, and Alternates A and B addressed the costs associated with the possible expansion of the kitchen
area and the Long Ridge Conference Room, respectively.
A notice to bidders was advertised in the San Jose Mercury News on January 14, 2001. Copies of the
plans and specifications were given to two local builders exchanges, and a notice to bidders was sent to
II'I five potentially interested contractors.
A mandatory pre-bid meeting was held on-site on January 19, 2001. Five contractors attended. Sealed bids
were due on January 31, 2001. Two bids were received, which are summarized in the breakdown below
(low bid, per category, in bold).

As defined in the Bid Proposal, the basis for selecting the low bid was the base bid only. The Information
to Bidders noted that "the contract will be awarded to the bidder determined to be the lowest responsible
and responsive bidder." Having reviewed the bidders' qualifications, and the bid proposals, staff
recommends award of the contract to Bay Construction Services, Inc., for the amount of$144,157.
Change orders are anticipated in this type of project, and the costs for these incidental items would not be
expected to exceed 10% of the contract. This additional work would be controlled by unit prices, which
were established during the bidding process. Due to the nature of the project, this method of controlling
the work and budget was determined to be the most cost effective. A 10% contingency would increase the
contract amount by $14,416, bringing the total contract amount to $158,573. Staff recommends that this
additional amount be authorized on a "not to exceed basis" to complete the project. This amount and the
unit prices are in line with staff s projected estimates for the work.
At your meeting on December 20, 2000 you authorized the General Manager to extend the existing
agreement with Panko Architects and approved increasing the total payment due them to $32,500 (see
Report R-00-157). Therefore, staff will continue to retain the professional services of Panko Architects
to monitor the construction phase of this project. The individual assigned by that firm will certify the
compliance of the contractor's installations to the plans and specifications and work in concert with District
staff.
At present, a building permit from the City of Los Altos Planning and Building Department has been
approved for all of the items contained in the Base Bid. However, a variance to the parking requirements
is necessary in order to expand the kitchen area (Alternate A) and the conference room (Alternate B).
Provided that this variance and the subsequent building permits for the expansion of these rooms is received
by mid-March 2001, construction will encompass all aspects of the project. Construction is scheduled to
commence on March 12, 2001 and is anticipated to be completed on April 21, 2001. If the variance for
the expansion of the two rooms cannot be obtained in a timely fashion, construction would proceed as
scheduled on the main features of the project as contained in the Base Bid. Inclusion of construction on
the Alternates is contingent upon Los Altos Planning and Building Department approval. Contractors were
advised in the pre-bid documents that such approvals were a condition of any eventual contract, and
selection of Alternates. The nature of the work does allow for the construction of the Alternates at a later
date, if necessary, with only minimal impacts to cost and effeciency. Staff will keep the Board advised of
this issue.
The Administrative Office will remain open, and work in the "Tenant's Space" will be performed during
evening and weekend hours only. All construction will be restricted during those hours when the Board
conducts its scheduled meetings. Notification of this construction will be posted on the District's Web-site
and signs will be installed at the building's entrances to inform District staff and visitors of the occurrence
of the project.
CEQA COMPLIANCE
Project Description
The project consists of minor alterations to the District's existing administrative office in the City of
Los Altos. Alterations include demolition of certain interior walls, construction of new interior walls,
relocation of electrical and communications outlets, an approximately 80 square-foot expansion of the

floor area, and replacement of certain windows.
CEQA Determination
The District concludes that this project will not have a significant effect on the environment. It is
categorically exempt from CEQA (California Environmental Quality Act) under Section 15302.
Categorical Exemption 15302 — Replacement or Reconstruction
The proposed alterations will replace certain interior building elements such as, walls and electrical and
communications outlets; and reconstruct and expand a minor floor area. The structure will have
substantially the same purpose and capacity before and after the project is implemented.

Dear Mr. Denevi:
Thank you for your letter of January 10, 2001, requesting consideration of a long-term lease of
the former Alma College property for golf course development. Your letter was considered by
the Board of Directors at its meeting of January 31, 2001.
As you know, the District is a public agency dedicated to acquiring and managing open space
land for preservation and low intensity public recreational use. The guiding basis for all
proposed uses is encapsulated in the District's mission statement, which reads as follows:
"To acquire and preserve a regional greenbelt of open space land in perpetuity;
protect and restore the natural environment; and provide opportunities for
ecologically sensitive public enjoyment and education.
The Bear Creek Redwoods Open Space Preserve is currently closed to public use except for a
limited access "pen-nit" system related to the existing horse stable at the site. Following
acquisition of the "upper"property from Peninsula Open Space Trust (POST) and completion of
the logging operation that pre-dated District purchase of the property,we will commence with
development of a Master Plan for the entire site. We anticipate that the Master Planning process
will take several years because of the complexity and number of issues (current horse stable
operation, use issues associated with possible historic structures, potential Ridge Trial
connection, and an acutely interested local population). After a public participation process,the
Master Plan will identify low intensity public recreational uses that are compatible with the
public interest and the environmental carrying capacity of the site. Resource inventory and
restoration needs will also be a focus of the study.
There will be several public hearings associated with the Master Planning process, and all final
decisions will be made by the Board of Directors at a public meeting. We welcome you to
participate in that process. However, given that the District's current policies and land
management practices are founded upon providing low intensity recreational uses such as dirt
trails and small gravel parking lots, we anticipate that inclusion of a golf course in the Master
Plan for this preserve would be highly unlikely. Furthermore, in the event that, in the future,the
District's Board of Directors were ever to make a decision to include a golf course in the final
plan, the development of such a project would be subject to an additional open and public

process. This would be necessary to allow for proposals to be submitted by any and all interested
parties, before the final selection of an appropriate party to be considered for any long-term
agreement.
In summary, based upon the District's Mission Statement and Board policies that have been
formulated over the last 28 years, we anticipate that ultimate uses at Bear Creek Redwoods Open
Space Preserve will be low intensity and focus primarily on trailhead parking and public trails.
Most of the site will be left in a natural condition and the District's future efforts will focus on
restoration and enhancement of the native fauna and flora.
Given all of the factors discussed above, we cannot provide you with a statement of interest that
the District desires to collaborate with you to develop a golf course at Bear Creek Redwoods
Open Space Preserve.

Dear Mr. Graham:
Midpeninsula Regional Open Space District staff have reviewed the Proposed Negative Declaration for
the Atwood project and have very serious concerns about this proposal and the adequacy of the
environmental review with respect to aesthetics and environmental resources. The Initial
Study/Negative Declaration currently suffers from inadequacy of documentation and analysis, as well as
reliance on future studies or processes to analyze significant effects.
Under Initial Study Section A, Aesthetics: No analysis is presented regarding the aesthetic significance
of the grading and architecture proposed by the applicant. The Initial Study states that the Architectural
and Site Approval process will require submittal and review of items that ensure the architectural
compatibility of the project with the site; however, no specific mitigation measures are proposed. The
visibility of the level graded area, which the Environmental Setting describes as "on top of a hill," and
the aesthetic implications of the removal of over 30 native trees are not addressed. Further, the
mitigations proposed do not describe reseeding and replanting requirements or how results will be
measured.
Under Section D, Biological Resources: No substantial evidence is presented to form a factual basis to
conclude that impacts to riparian habitat are less than significant. The Initial Study/Negative
Declaration defers the review of this issue to the California Department of Fish and Game by requiring
that a future Streambed Alteration Agreement (SAA) be obtained. The environmental documents
conclude that compliance with the SAA will "mitigate any potential impacts to the riparian habitat," but
do not describe how this will occur. Since the Department of Fish and Game is responsible for
determining whether a project requires an SAA, not the County, this evaluation needs to be completed
as part of the Initial Study/Negative Declaration.
Under Section F, Geology and Soils: It appears the analysis is deferred until future topographic and
geologic studies are submitted. Again, the Initial Study/Negative Declaration concludes that
compliance with this measure will "mitigate any potential impacts to the riparian habitat," but does not
describe how this will occur. The driveway-grading plan at Overlook Road does not indicate where
the new fill blends with the existing grade. The plan as shown would result in the removal of
additional large trees not currently identified for removal. Therefore an analysis of the aesthetic and
geologic effects of grading cannot be made. The submitted plans do not include information on the

bridge construction, such as creek cross sections or abutment details, which is necessary to determine
the project's impact on the hydrology or riparian environment of the tributary to Almendra Creek.
At the core of our concerns is the belief that the proposed application to construct a massive, highly
visible home with excessive grading and retaining walls is not appropriate for the setting given the steep
topography, washouts, riparian environment, and significant tree cover. We implore the County to
consider how to avoid the impacts discussed in the Initial Study/Negative Declaration by working with
the applicant to modify the application, rather than simply adopting mitigation measures and deferring
important studies to other agencies to address in the future with little public involvement.
We respectfully request the County to defer action on the proposed Atwood Grading/Building approval
until such time as the additional information and analysis discussed above are included in the Initial
Study/Negative Declaration. In addition, we request that the County require the applicant to make
substantive revisions to the project. We suggest the following measures at minimum:
• Build to respond to the hillside nature of the site by nesting into the hill and stepping with the grade
0 Utilize architectural features that emphasize the horizontal nature of the structure
• Minimize retaining wall heights (less than 6 feet) along the driveway
• Avoid unnecessary on-site grading, especially in watercourses
• Replant visually appropriate evergreen trees in graded areas in patterns that reflect the natural
environment

Thank you for your letter of January 6, 2001 regarding the education of visitors about littering in
District preserves. The District's Board of Directors reviewed your letter at its regular meeting
last night, and is very appreciative of your support and of your concern about this issue.
The District is committed to maintaining the preserves in the best possible condition, and in their
natural state. Additional signage is something which we are always evaluating, but our
experience has been that adding more signs tends to have a very limited benefit.
Our staff continue to enforce District regulations, which prohibit littering, and to educate visitors
about the need to care for the Open Space areas. Our staff also continues to provide regular
patrols of the trails to deal with any littering problems.
Thank you for sharing your thoughts with us and we hope that you will continue to enjoy your
open space preserves.

The District Board of Directors reviewed your December 19, 2000 letter concerning the
Zinfandel Trail at Picchetti Ranch Open Space Preserve at their regular meeting last night.
Thank you for expressing your concerns regarding the condition of the trail during the rainy
season.
When constructing trails, the District incorporates practices that attempt to prevent trail surfaces
from flooding or eroding. Such practices include the installation of water bars or rolling dips that
channel water off the trail and allow it to drain without damaging or destroying the trail. In areas
where these methods are unsuccessful, other measures are used. However, there are occasionally
trails that are seasonally inundated with so much rain and discharge that they have to be closed
until they drain naturally. Staff monitors these "Seasonal Trail Closures" annually and once they
are closed, appropriate public notification is made and signing is placed on the preserve to inform
users of the closures.
Staff regularly patrols District trails to identify those that flood seasonally. The Zinfandel Trail
at Picchetti Ranch Open Space Preserve is not known to be one of those trails. However, staff
will examine the condition of this trail and will take the necessary precautions to address this
issue.

The District Board of Directors reviewed your January 18, 2000 electronic message concerning
bicyclists at Purisima Creek Redwoods Open Space Preserve at their regular meeting last night. Thank
you for expressing your concerns regarding your hiking experience on the trails at Purisima Creek
Redwoods Open Space Preserve.
In recognition of public concerns similar to yours, the District Board of Directors, on July 12, 2000,
amended the District's Trail Use Policies to close seven preserves to bicyclists. This action was
prompted by the need to protect the opportunity for tranquil nature study and observation and to balance
the desires of all constituents by providing a wide range of open space opportunities. The District can
now direct constituents who seek an open space experience undisturbed by mountain bikes to Foothills,
Los Trancos, La Honda Creek, Pulgas Ridge, Picchetti Ranch, Thornewood, and Teague Hill Open
Space Preserves. In deciding which preserves to close to bicycle use, the Board selected preserves that
were geographically distributed throughout the District and that provided a variety of environmental
settings. The Board also considered the potential impacts on existing trail use patterns. I understand
that your specific concerns pertain to Purisima Creek Redwoods Open Space Preserve. This preserve is
highly popular among hikers and bicyclists due, in part, to its spectacular landscape and to the vital link
it provides to bicyclists travelling from Skyline Boulevard to the coast. In an effort to maintain these
regional trail connections for bicyclists and to minimize the impact of the permanent trail closures on
preserves heavily used by bicyclists, the Board did not include Purisima Creek Redwoods Open Space
Preserve in the closures.
The District hopes that the recent Board decision will help accommodate the needs of hikers like
yourself and serve to address your concerns regarding conflicts between hikers and bicyclists.
Enclosed are brochures for the seven preserves that are closed to bicycles. We hope that you are able
to visit these preserves and enjoy the tranquil nature experience that they provide.

Thank you for getting back to us. The mission of the Stevens Creek Volunteer Fire
Department has great similarity to the mission of the Mid Peninsula Open Space
District in that both our department are involved with providing fire suppression and
emergency medical services. Our area involves both the public and the residential

areas of Montebello and Stevens Canyon Road.
It is our intent to utilize the surplus patrol units to provide a primary response to
emergencies in our response area. Our history of keeping the larger type 2 fire
apparatus has resulted in our not having a garage large enough to keep our unit safe
from the elements and most of all theft and vandalism. Utilizing the smaller patrol
type units will enable us to park the units in the garages at the residences of our
volunteers enabling us to keep them looking nice and having the units secure.
Preferably we would keep one unit near the top of Montebello Road which would
Wive access to the upper areas of Montebello Road including Mid Peninsula Open
Spac6 areas and the other unit in or near Stevens Canyon Road allowing quick
access the end of Stevens Canyon Road and Charcoal Road areas.
Lastly we want to assure you that we will utilize the donations from the Mid

Dear Mr. King,
The District Board of Directors reviewed your January 18, 2000 electronic message concerning
bicyclists at Purisima Creek Redwoods Open Space Preserve at their regular meeting last night. Thank
you for expressing your concerns regarding your hiking experience on the trails at Purisima.Creek
Redwoods Open Space Preserve.
In recognition of public concerns similar to yours, the District Board of Directors, on July 12, 2000,
amended the District's Trail Use Policies to close seven preserves to bicyclists. This action was
prompted by the need to protect the opportunity for tranquil nature study and observation and to balance
the desires of all constituents by providing a wide range of open space opportunities. The District can
now direct constituents who seek an open space experience undisturbed by mountain bikes to Foothills,
Los Trancos, La Honda Creek, Pulgas Ridge, Picchetti Ranch, Thornewood, and Teague Hill Open
Space Preserves. In deciding which preserves to close to bicycle use, the Board selected preserves that
were geographically distributed throughout the District and that provided a variety of environmental
settings. The Board also considered the potential impacts on existing trail use patterns. I understand
that your specific concerns pertain to Purisima Creek Redwoods Open Space Preserve. This preserve is
highly popular among hikers and bicyclists due, in part, to its spectacular landscape and to the vital link
it provides to bicyclists travelling from Skyline Boulevard to the coast. In an effort to maintain these
regional trail connections for bicyclists and to minimize the impact of the permanent trail closures on
preserves heavily used by bicyclists, the Board did not include Purisima Creek Redwoods Open Space
Preserve in the closures.
The District hopes that the recent Board decision will help accommodate the needs of hikers like
yourself and serve to address your concerns regarding conflicts between hikers and bicyclists.
Enclosed are brochures for the seven preserves that are closed to bicycles. We hope that you are able
to visit these preserves and enjoy the tranquil nature experience that they provide.

The District Board of Directors reviewed your December 19, 2000 letter concerning the
Zinfandel Trail at Picchetti Ranch Open Space Preserve at their regular meeting last night.
Thank you for expressing your concerns regarding the condition of the trail during the rainy
season.
When constructing trails, the District incorporates practices that attempt to prevent trail surfaces
from flooding or eroding. Such practices include the installation of water bars or rolling dips that
channel water off the trail and allow it to drain without damaging or destroying the trail. In areas
where these methods are unsuccessful, other measures are used. However, there are occasionally
trails that are seasonally inundated with so much rain and discharge that they have to be closed
until they drain naturally. Staff monitors these "Seasonal Trail Closures"annually and once they
are closed, appropriate public notification is made and signing is placed on the preserve to inform
users of the closures.
Staff regularly patrols District trails to identify those that flood seasonally. The Zinfandel Trail
at Picchetti Ranch Open Space Preserve is not known to be one of those trails. However, staff
will examine the condition of this trail and will take the necessary precautions to address this
issue.

Thank you for your letter of January 6, 2001 regarding the education of visitors about littering in
District preserves. The District's Board of Directors reviewed your letter at its regular meeting
last night, and is very appreciative of your support and of your concern about this issue.
The District is committed to maintaining the preserves in the best possible condition, and in their
natural state. Additional signage is something which we are always evaluating, but our
experience has been that adding more signs tends to have a very limited benefit.
Our staff continue to enforce District regulations,which prohibit littering, and to educate visitors
about the need to care for the Open Space areas. Our staff also continues to provide regular
patrols of the trails to deal with any littering problems.
Thank you for sharing your thoughts with us and we hope that you will continue to enjoy your
open space preserves.
