Councilman Presents the following Ordinance Seconded by Councilman ORDINANCE AMENDING AND SUPPLEMENTING ARTICLE V, ENTITLED DUMPSTERS AND OTHER CONTAINERS, OF CHAPTER 222 "STREETS AND SlDEW ALKS" OF THE CODE OF THE BOROUGH OF CARTERET BE IT ORDAINED BY THE Mayor and Council of the Borough of Carteret ("Borough") as follows: Section 1. Section 222-34, entitled "Prohibited conduct," IS hereby amended and supplemented to add the following new paragraphs to read as follows: C. Driveways. No person shall park, stop, or permit a roll-off container, dumpster or other container on any public sidewalk and/or ih any public street if the site has a driveway or other similarly available -- space upon which to place said dumpster or container. D. Protection required. No person shall park, stop, or permit a roll-off container, dumpster or other container on any public street without first placing a minimum of 12" plywood or similar material under said dumpster or container to prevent the same from damaging or marking the surface of the pavement. Section 2. Section 222-35, entitled "Notice," is hereby deleted in its entirety and replaced with the following. §222-35. Permit required: notice A. Any person who wishes to park, stop or permit a roll- off container, dumpster, or othêr container on any public street or sidewalk, or on any private property, - must first obtain a permit therefore from the Zoning Office. The fee for said permit shall be $15.00 for the first 60 days. An additional fee of $10.00 shall be paid for a 30-day extension of the permit. The roll-off container, dumpster or other container must be removed from site at the end of this period, unless otherwise approved by the Zoning Office, in its sole discretion, and the payment of a new permit fee. B. Any person who wishes to park, stop or permit a roll- off container to remain on a public street must first notify the appropriate police officer in charge of the Traffic Division for the Cartere¡ Police Department. Such notification must take place at least 24 hours prior to the location of the roll-off ccmtainer, dumpster or other container to enable the Police Department to inspect the location and to make sure of the location and installation of flashing devices on that particular container. Section 3, All Ordinances and/or provisions thereof .inconsistent with the provision of this Ordinance shall be and an; hereby repealed as to the extent of any such inconsistencies. If any section, subsection, part, clause or phrasè of this Ordinance shall be declared invalid by judgment of any Court of competent jurisdiction, the section, subsection, part, clause or phrase shall be deemed to be sever able from the remainder of this Ordinance.
