It was further reported that there had not been any B & E or
other major law violations during the Month of April.
51 The Planning Board submitted its "Report" to the Commission con-
cerning the Board's meeting with firs. LeRoy W. Caddell and her
representative cr. Robert Crauch relative to the proposed devel-
opment of the 12.8 acres tract of land recently acquired by Mrs.
Caddell and her son mr. John Be Caddell II. Planning Board "Re-
port" is as follows:
"RE: Recommendations of the Town Planning Board in reference to
the proposed CADDELL subdivision.
The planning Board wishes to call to the Commission's atten-
tion a portion of the Town Zoning Ordinance No. 108, approved in
Yay, 1952, as set forth on Page 23, Section X. sub- Section "A"
which reads as follows:
'All plans, and re- plans, plats or re -plats of land herein-
after laid out in building lots or streets, alleys or other por-
tions of the same intended to be dedicated to the public use, or
for the use of purchasers or owners of lots fronting thereon, or
adjacent thereto, and located within the Town shall be submitted
to the '=own Commission, or a Committee thereof designated for such
purpose, for its approval or rejection; and it shall be unlawful
to receive or record such plans, re- plans, plats or re- plats, in
cont.

any public office unless the same shall bear thereon, by endorse-
ment or otherwise, the approval of the Town I'ayor and Clerk upon
authority of the Town Commission, and the corporate Seal of the
Tot m. The disapproval of such plans, re- plans, plats or re -plats
by the .own Commission shall be deemed a refusal by the mown of
the proposed dedication shown thereon. The approval by the Town
Commission shall be deemed an acceptance by the Town of such pro-
posed dedication, but shall not impose any duty upon the 'Town con-
cerning the maintenance or improvement of any such dedication or
dedicated parts until the proper authorities of the Town shall
have made actual appropriations of the same by entry, use or im-
provements.
All plans, re- plans, plats or re -plats of lands hereafter laid
out within any area of the sown, located in 3.esidence District "A ",
or in .+partment or Residence )istrict "C", shall provide for lots
or tracts of land having a frontage of at least one hundred (100)
feet on a dedicated street, road or avenue, and a land area of at
least ten thousand (10,000) square feet, for each lot or tract
shown on said plat."
Possible exception to the above should be noted on the 24CLOUTH
subdivision Plat, approved in July, 1954, RE- PLATTED and approved
in Hay, 1957, which may not conform to the above section X, Sub-
section "A ", in regard to dedicated roads.
It is the recommendation of this Board that access roads should
be paved at least twenty (20) feet in width and provided with swales
on both sides of said roads, each Swale to be at least five (5) feet
wide. Catch Basins and drainage layout should be provided on a form
to be approved by the Town's ':ngineer.
The north Road in the Caddell subdivision should be laid out in
a manner so that it does not intersect with AIA adjacent to the
South Road of the McLOUTA Subdivision, for safety reasons.
The Planning Board further recomi.�ends that no approval of the
CmIdell subdivision Plans be given until complete engineering draw-
ings and specifications, showing the layout of access roads and a
drainage syster.., have been examined and approved by the Town's En-
gineer, all being subject to necessary survey.
It should be further noted that the Planning Board feels that
the general layout of this project is very attractive and if the
matter of the access roads, and properly designed drainage, can be
straightened out, there would be no objection to such proposed de-
velopment of the subdivision.
Following general discussion of the Planning Board's recommend-
ations between the commission, Planning Board Member Mr. L. St. Ball
and Mr, Robert Grouch, representing the owners of the proposed Sub-
division, during which discussions Fir. Koch, Vice -Mayor of the Com-
mission, cited the advisability of providing swales of ten (10) ft
in width, instead of five (5) ft., Fiayor walker informed For. Grouch
that engineering plans and specifications, for such proposed devel-
opment, reflecting suggestions as made by the Commission and there
should also be reflected the recommendations of the Planning Board,
be provided for re- submission to the Town Commission for further
consideration.

The Commission, on motion of Mr. Koch, seconded by 13r. LaPorte,
unanimously approved acceptance of the Planning Board's Report,
together with the understanding that mr. Grauch proceed with
providing for engineering design plans and specifications for
possible development of the Caddell property to reflect the rec-
emendations of the Planning Board and the Commission, as well
as the intent of fir. Grauch relative to possible sewage facili-
ties.
6. Ordinance No. 72 -3, providing a basis for local Police control
over LOITE.:;RS and /or PR0WLERS was submitted for Commission con-
sideration, such ordinance being deemed necessary in the beat
interest of the Town in view of the fact that the United States
Supreme court recently declared the State Vagrancy Law being un-
constitutional.
On motion of Mr. Koch, soccnded by Fir. LaPorte, the Commis-
sion unanimously approved placing Ordinance No, 72 -3 on FIRST
reading.
7. The Commission was informed that satisfactory arrangements with
the City of ; Delray Beach for use of its jail facilities, by the
Town of Gulf stream, for detention of prisoners, when necessary,
have been concluded. On motion of 1,.r. Koch, seconded by tar.
LaPorte who further expressed his appreciation for the coopera-
tion extended by the City of selray Beach, the Commission unani-
mously approved execution of a prepared "Agreement ", by the pro-
per Town officials, whereby the City of Delray Beach will provide
jail facilities for detention of prisoners from the Town of Gulf
Stream, when such service is needed.
81 The Commission directed the 'Town's legal counsel (Johnston, Lil-
ienthal G Johnston), represented at the meeting by Att'y. John
C. Randolph, to initiate legal procedure for amending Paragraph
2, Section S. of Article IV, Chapter 22306, Laws of Florida,
Special Acts of 1943, being the Charter Act for the Town of Gulf
Stream, Florida, in order to provide an "i: =NDMiNT" thereto,
when so amended, to read as follows:
"All public moneys shall be deposited in the name of
the Town of Gulf t,tream, in a bank or banks in Palm
Beach County, to be designated by the Town Commission,
and all public moneys shall be disbursed only on check
to be signed by either one of the following:
(a) The Town Manager and any one (1) commissioner; or
(b) ;ny Two (2) ?•;embers of the Commission. Any person
performing any duties in which he or she collects,
receives or handles any public funds shall give
bond to faithfully account for same."
Upon motion of tar. Koch, seconded by fir. LaPorte, the commission
unanimously approved directing the Town legal counsel to proceed
with effecting such Charter Change.

The Palm Beach County Legislative Delegation passed a local bill,
COPY of which is enclosed, creating a 50 Vember Commission to
study the functions, structure and operations of all governmen-
tal units and bodies within the County. This includes all agen-
cies, commissions, boards, authorities, municipal public bodies
and county government. 1`he `study Commission is to determine
and report to the Legislative Delegation if there is a need for
consolidation, separation, removal or revision of any such body.
In order that each COmrunity may have an opportunity to be repre-
sented, you are being advised so that you may submit one or more
proposed members to serve on this study Commission, which the
Delegation will consider in naming the Commission.

'ollowing general discussion as to the apparent intent of the
Palm Beach County Legislative elegation, as indicated in the
letter from the nelegationIs Chairman - fir, ray d?oudry, Mr.
LaPorte suggested that, in vies: of knowledge gained in dura-
tion of many years in serving the Town's governmental functions,
a:, well as familiarity with County Government operations, this
Commission is fortunate in having ono of its .:embers well quali-
fied through such exxricnce gained, to represent the Town and
serve on the ' °study Commission ", Mr. Koch be recommended by the
Town Commission as a proposed Plember thereof, rare LaPorte fur-
ther requested that this Commission be kept informed of the pro-
gress of such 50- D7ember Study Commission.

INDEMNIFICATION AGREEMENT
THIS AGREEMENT of indemnity, entered into this 22nc1 day of
"iAy , 1972, by and between the TOWN OF GULFSTREAM, Palm
Beach County, a municipal corporation existing under the laws of the State of
Florida, hereinafter referred to as the party of the first part, and the CITY
OF DELRAY BEACH, Palm Beach County, a municipal corporation existing
under the laws of the State of Florida, hereinafter referred to as the party of
the second part;
WITNESSETH:
WHEREAS, the party of the first part is presently without any penal
detention facility; and
WHEREAS, the party of the second part is willing to cooperate in
providing its penal detention facilities so as to permit the party of the first
part to place its prisoners therein on a temporary basis;
NOW, THEREFORE, in consideration of the sum of $1.00, in hand
paid by the party of the first part to the party of the second part, the receipt
of which is hereby acknowledged, the party of the first part does hereby
covenant and agree to protect, indemnify and save harmless the party of the
second part from and against any and all loss, damage or liability, incurred
by reason or in consequence of the transfer, detention or removal of
prisoners taken into custody by the party of the first part and quartered
within subject facilities.
The party of the second part shall not be liable to the party of the first
part, its employees, patrons, guests or visitors, in or upon the premises for
any damage to persons or property caused by any act of neglect of any other
agent, servant, or employee of the party of the second part; nor due to the
building on said premises, or appurtenances thereto, being improperly
constructed or being or becoming out of repair; nor for any damage from
any defects or want of repair of the building upon which subject premises
form a part, and the party of the first part accepts subject premises as
suitable for the purposes intended and each and every appurtenance thereto in
the condition of same at the beginning of this Agreement and waive all defects
thereon.
The party of the first part shall pay the party of the second part
$20.00 per day, or fraction of a day, for each person turned over to party
of the second part. A day shallbebased on24 hours from time received by
Party of the second part. The $20.00 shall include meals and transportation
to and from hospital if needed.
The party of the first part guarantees that all police officers employed
comply with the requirements of F. S. 23.
This Agreement shall become terminated upon either party giving
written notice of its intention to terminate at least thirty (30) days prior to
such termination date.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed by their duly authorized officers the day and year
first above written.

The Palm Beach County Legislative Delegation passed a local
bill, copy of which is enclosed, creating a 50 member com-

During the regular session of the Town Commission meet-
ing on Friday, May 12, 1972, Mayor George W. Walker did ap-
point Town Vice -Mayor William F. Koch, Jr., as a represent-
ative of the Town of Gulf Stream for consideration by the
Palm Beach County Legislative Delegation, for membership on
the 50 member commission, to be created by the Delegation
and to be known as a "Study Commission ". The appointee,
Mr. Koch, has acknowledged being available to serve, and
his resume, as requested in your communication of May 3rd,

PROFESSIONAL EXPERIENCE
A registered Real Estate Broker active in the real estate
and appraisal business in Palm Beach County, Florida since
1954, with offices in Delray Beach, Florida.
EDUCATIONAL BACKGROUND
Graduate with degree of B.A., Rollins College, located in
Winter Park, Florida.
Appraisal courses at the University of Florida, conducted
by the American Institute of Real Estate Appraisers.

A bill to be entitled
An act to establish a local government
study commission in Palm Beach county,
Florida, to study the structure, func-
tions and operations of all governmental
units and bodies located within the said
county, including the county government,
municipal governments, public bodies,
corporate, and all offices, agencies,
commissions, boards, authorities and
other subdivisions thereof; to determine
the need if any, for consolidation,
separation, addition, removal or other
revision of such structures, functions
and operations; to determine whether
tax savings can be made and whether
efficiency can be gained through such
revision of such local governmental
structures, functions and operations;
to provide that said commission may
draft a plan or plans for any solution
of problems disclosed as a result of
such study and submit the same to the
members of the Florida Legislature from
Palm Beach county; to provide for the
designation of the members of such
commission and to provide a method of
filling vacancies; to provide for the
organizations and terms of such commission,

prescribing its duties and powers; to
provide for appropriations from Palm
Beach county for the payment of the cost
of operation of such commission; pro-
viding an effective date.
It Enacted by the Legislature of the State of
orida:
Section 1. There is hereby created in Palm
3each county a commission to study the structures,
:unctions and operations of all governmental units and
)odies located within the said county, including the
:ounty government, the municipal governments, public
Lodies, corporate, and all agencies, commissions,
Loards, authorities and other subdivisions thereof.
,uch commission shall be known as the "local govern -
Lent study commission of Palm Beach county ", and shall
e hereinafter referred to as the commission.
Section 2. The commission shall conduct re-
earch and study to determine the need, if any, for
he consolidation, separation, addition, removal or
ther revision of the aforementioned local governmental
tructures, functions and operations.
Section 3. It shall be the further function
nd duty of the commission to draft a plan or plans
or the solution of any problem disclosed as a result

feasible, desirable and economical and to submit such

to the members of the Florida Legislature from
Palm Beach county.
Section 4. The commission shall be composed of
fifty (50) citizens of Palm Beach county, of whom the
first seventeen (17) named shall constitute the
executive committee. The members of the commission
shall be appointed by the members of the Florida Legis
lature from Palm Beach county. The actual work of the
commission shall be done at the direction of the
executive committee under rules adopted and approved
by the commission. In the event a vacancy occurs in
the membership of-the commission, whether caused by
death, resignation or otherwise, such vacancy shall be
filled for the unexpired term, and the 'members of the
Florida Legislature from Palm Beach county may appoint
the successor to such vacancy. The commission shall
appoint an advisory committee composed of representa-
tives of organizations within Palm Beach county which
possess knowledge and expertise deemed to be of sub-
stantial value to the commission and of such other
persons as the committee shall deem appropriate. The
advisory committee or sub - committees thereof shall,
ipon request of the commission, advise and consult
aith the commission on various aspects of the plan or
flans formulated by the commission.
Section 5. The commission as hereinabove
.onstituted shall meet and organize on or before

ctober 1, 1972 and shall elect a chairman from the
