Mayor Walker asked that Item 5, on the Agenda, be considered at
this time, which reflects his request of September 27th, being
as follows:
"Having served a few interesting years
as a Member of your Council and later
the Honor of Mayor, I do feel that now
the future might better be served by
others, my future plans being for more
traveling and therefor please accept my
resignation as Mayor.
May I suggest Mr. Koch as your Mayor
and Mr. LaPorte as Vice - Mayor.
Best wishes for continued success."

The resignation from the Mayoralty Office being accepted, and
on motion of Mr. Walker, duly seconded by Mr. LaPorte, the Com-
mission unanimously appointed Mr. William F. Koch, Jr., to the
Office of Mayor.
On motion of Mr. Walker, seconded by Mayor Koch, the Commission
unanimously appointed Mr. William S. LaPorte as Vice -Mayor of
the Town Commission.
On motion of Mr. LaPorte, seconded by Mr. Walker, the Minutes
of the September 8th Meeting were unanimously approved.
The Financial Report for the Month of September - 1972, as sub-
mitted by the Town Manager, was accepted.

5. The following "SUMMARY" of Police Reports for the Month of
September was presented and accepted by the Commission:

Officers Brown and Mumma, assisted by Chief Cowart, arrested
two Colored Males on the charge of "Breaking and Entering" to
commit a felony at 1421 No. Ocean Boulevard. The prisoners
were turned over to the Palm Beach County Sheriff's Depart-
ment. The "Case" had not been disposed of, by said Depart-
ment, as of this Commission Meeting date.
6. The Commission was informed that, under date of September 15th,
BIDS were solicited for TWO NEW POLICE CARS from the 'Dealers'
shown below:

But Two Bids were received, those being as follows:

On motion of Mr. LaPorte, seconded by Mr. Walker, the Commis-
sion unanimously approved acceptance of the LOW BID subject to
its review by the Town Manager and Chief of Police as being in
compliance with ALL specifications as called for and outlined
in the Bid solicitations.
7. On motion of Mr. Walker, seconded by Mr. LaPorte, the Commis-
sion unanimously approved the increase of RETAINER FEE for the
services of its Legal Counsel, Johnston, Lilienthal & Johnston,
as requested by said Firm, from the present $50.00 per month
to $75.00 per month, plus additional charges for services done
over and above the regular course of the Town's business, as
set forth in their letter of July 3, 1972 filed with the orig-
inal and official copy of these 'Minutes'.

8. Concerning the 'Request' of the "Animal Rescue League" for fi-
nancial assistance in its operation, it was brought out that,
not only is this undoubtedly a private undertaking, but Palm
Beach County itself provides for such services when needed.
The Commission directed the Town Manager to inform said Animal
Rescue League that there are no available funds in the 'Budget'
for the current fiscal year and the Town, therefore, must de-
cline any participation in the League's activities.
9. Ordinance No. 72 -4, providing for "Amending Town Ordinance No.
127 relating to Occupational License Taxation under certain con-
ditions and regulations as set forth and contained therein, was
submitted and read on this SECOND and FINAL Reading.
On motion of Mr. LaPorte, seconded by Mr. Walker, the Commission
unanimously approved PASSAGE and ADOPTION of said Ordinance No.
72 -4 on this second and final reading.
10. The Commission directed the Town Manager to petition the County,
through its County Engineer and County Attorney offices, to pro-
vide for improvement of that part of SEA ROAD extending easterly
from AlA (Ocean Blvd.) which is in a deplorable condition, with
the understanding that the Town would share in the cost thereof,
to the extent determined fair and just.
11. Mr. Walker moved that Officer Robert Mumma be made a Sargeant in
the Police Department. On second of said motion, by Mr. LaPorte,
the Commission unanimously approved the appointment of Mr. Mumma
as Police Sargeant.
On motion of Mr. Walker, seconded by Mr. LaPorte, the Commission
unanimously approved the following Wage Increases for this Fiscal
Year, and for which provisions were included in the current Bud-
get, no further appropriations being necessary:

The Commission, due to its action at this meeting in appointing
Mr. LaPorte as Vice - Mayor, unanimously approved the appointment
of Mr. Walker as Police Commissioner.

Some time ago I informed Mr. Worthing of the necessity for our firm
to increase the fee which is now being charged the Town of Gulf
Stream for legal services. I now relate this information to you
for your consideration.
For several years this firm has represented the Town of Gulf
Stream for a retainer of $50.00 per month, with an additional
charge for work done over and above the regular course of the
Town's business. We have found, due to inflation and the increase
in time and effort expended toward the legal problems of the Town,
that it is economically unfeasible for our firm to continue
representation on such a basis. Thus, we submit the following
proposal:
Representation would continue on the basis of $75.00 per month
as a retainer fee. This would include such services as
attending meetings, rendering legal advice and opinions, time
expended on telephone calls, ordinary communications, etc. The
prepartaion of ordinances, resulutions, extraordinary legal research,
litigation and any other matter outside the ordinary course of
business would not be included in the retainer fee. Fees for those
services would necessarily have to be computed on an hourly basis
of $30.00 per hour.
This firm has enjoyed representing the Town of Gulf Stream for
the past several years and would like to continue in that
capacity. We hope that the terms set out herein meet with your
approval. Please feel free to call if you have any questions in
regard to this matter.

Humane Society, which is, the Animal Rescue League of the
Palm Beaches, Inc. is at the service of every citizen of your
community, 24 hours a day, 7 days a week, 365 days a year,
including Christmas and New Years.
The services we perform are enumerated on the attached sheet.
In any community, large or small, the humane society is an integral.
part of its structure. Its operation entails considerable expense.
Since we depend solely upon contributions and appropriations, we
respectfully request that the Town of Gulfstream help us defray these
expenses and include us in its budget with an amount of $100. 00.
