1. The Meeting was called to order by Mayor Walker.
2. On motion of Mr. Koch, seconded by Mr. LaPorte, the Minutes,
of the Regular Meeting held on July 14th, and of the Special
Meeting held on July 21st - 1972 were unanimously approved.
3. The Financial Reports for the Months of JULY and AUGUST were
accepted by the Commission.
4. The following "SUMMARIES" of Police Reports for the Months of
JULY and AUGUST - 1972 were presented and accepted by the Com-
mission:

51 In compliance with the Commission's directive at a Special Meet-
ing held on July 2lat, Att'y. Joseph Keeley, on behalf of the St.
Andrews Corp., submitted an "APPLICATION FOR BUILDING PERMIT" to
allow installation of TENNIS COURTS and PARKING FACILITIES. The
Application, in part, stiplulated that NO FLOODLIGHTS would be in-
stalled on the property of the Petitioner as pertains to this in-
tended improvement thereon.
The Building Permit Application was accompanied by an up -to -date
drawing of adequate scale showing specific locations of the Ten-
nis Courts, Parking Facilities, land - scaped parcel and drainage
provisions which were desired by the Commission and the Town Plan-
ning Board.
The Commission, having previously upheld the recommendation of Mr.
LaPorte as made at the Special Meeting of July 21st that the St.
Andrews Club join in the understanding and agreement that NO FLOOD
Lights would be installed on the property involved, was informed,
as follows, by the St. Andrews Corporation's legal counsel, Att'y.
Joseph Keeley:
"The final documents effecting transfer of the pro-
perty involved, from St. Andrews Corporation to St.
Andrews Club, would be so drawn as to provide, in
part, that the stipulated NO FLOOD LIGHT installation
provision, as made in the 'Application' for Building
Permit, be non - amendable."
The following communication from the HILLSIDE HOUSE of GULF STREAM,
Inc., was read:
"In regard to proposed tennis courts to be built by the St. Andrews
Corporation and /or developers, we as owners of Apartment No. 12,
would have no objections to these tennis courts if the Town of Gulf
Stream will restrict the tennis courts as follows:
(1) Tennis Courts must be restricted to a location at least 60 ft
from their west property line running north and south and adjacent
to Hillside House property, except as shown on Gamble & Gilroy's
Drawing dated August 15, 1972.
(2) Adequate drainage for the courts should be installed so that
water does not drain off on Hillside House property. This could
be a major problem to Hillside House owners (12 owners).
(3) Adequate height (6 ft) hedging should be placed along their
west property line running north and south.
(4) The tennis courts should be restricted to day time use only,
and definitely from ever installing lights for night tennis. We,
also, feel that noise during the hours prior to 9:00 a.m, could
be disturbing to older residents of Hillside House."

Following general discussion of this issue, and, on motion of Mr.
Koch, seconded by Mr. Whittemore, the Commission unanimously ap-
proved issuance of Building Permit SUBJECT to the Town receiving,
in writing, assurance of more satiafactory drainage provisions,
and installation of a minimum 6 ft height hedge along the entire
west property line of St. Andrews Corporation's lands involved in
this proposed improvement.

6. The "BUDGET ", as amended, providing for anticipated REVENUES and
estimated EXPENDITURES for the Fiscal Year commencing October 1,
1972 and terminating on September 30, 1973, was unanimously ap-
proved and adopted by the Commission on motion of Mr. Koch, duly
seconded by Mr. LaPorte, Said Budget, reflecting anticipated
Revenues and estimated expenditures during said Fiscal Year is
attached to the official copy of these "Minutes" reflects the
following:

7. On motion of Mr. Koch, seconded by Mr. LaPorte, the Commission
unanimously approved adoption of:
RESOLUTION NO. 11 -72
AUTHORIZING A PRO RATA SHARE OF GENERAL
FUND EXPENSES BE BORNE BY THE WATER FUND
FOR THE FISCAL YEAR COMMENCING OCTOBER 1,
1972 AND TERMINATING ON SEPTEMBER 30, 19730
IN THE AMOUNT OF $68600.00.
8. On motion of Mr. LaPorte, seconded by Mr. Whitney, the Commission
unanimously approved adoption of:
RESOLUTION NO. 12 -72
ESTABLISHING A THREE (3) MILL TAX LEVY A-
GAINST THE ASSESSED VALUATIONS OF ALL TAX-
ABLE REAL AND PERSONAL PROPERTIES WITHIN
THE CORPORATE LIMITS OF THE TOWN OF GULF
STREAM FOR THE CALENDAR YEAR 1972.
9, ORDINANCE NO. 72 -4, amending Ordinance No. 127, relating to OC-
CUPATIONAL LICENSE TAXATION; under certain conditions and regu-
lations as set forth in revised Chapter 205, Florida Statutes,
by Legislative Act provided in Chapter 72 -306, was unanimously
placed on FIRST READING by the Commission, upon motion of Mr.
Koch and seconded by Mr. LaPorte,
10, Mr. Carl E. Grimes, owner of GULFSTREAM SHORES APARTMENTS, at
3851 No. Ocean Blvd., complained of the deplorable condition of
that portion of SEA ROAD lying east of AlA. The Commission in-
formed him that consideration for repair of that public right -
of -way would be given at a work -shop meeting to be held in the
near future, the date and time for which would be furnished him
in order that he might attend and participate therein.

SUBJECT: PUBLIC HEARING ON PROPOSED BUDGET
Dear Property Owner and /or Resident:
Reference is made to the scheduled Town Commission Meeting
to be held on Friday, September 8, 1972, at 9:00 o'clock A.M., in
the Town Hall, Gulf Stream, Florida.
This "Special Notice" of said Meeting is for the purpose
of notifying you that, during said Commission Meeting, the proposed
Budget for the coming fiscal year beginning October 1, 1972 will
be considered for adoption. The Budget provides, in part, for a
DECREASE in the ad- valorem tax rate for the Town from the current
four (4) mill levy against all taxable properties within the Town
of Gulf Stream to three (3) mills for the calendar year of 1972.
The fiscal year, referred to herein, commences October 1,
1972 and terminates September 30, 1973. It is mandatory, in com-
pliance with the Laws of the State of Florida, that a Budget for
said Fiscal Year, reflecting estimated expenditures during that
period, and anticipated revenues necessary to provide sufficient
funds for such expenditures, be adopted this month.
A copy of the scheduled Commission Meeting AGENDA, as well
as a detailed copy of the above mentioned "Budget ", is on file in
the Clerk's office at Town Hall for review by anyone desiring to
do so, between the hours of 9:00 A.M., and 3:00 P.M., Monday
through Friday.
The Town Commission solicits your attendance at the Meeting
to be held on September 8th, and all Commission Meetings through-
out the year which are scheduled to be held on the second Friday
of each month, in the Town Hall, at 9:00 o'clock A.M., as indicat-
ed on the enclosed "Commission Meeting Schedule ".

A RESOLUTION OF THE COMMISSION OF THE TOWN OF
GULF STREAM, PALM BEACH COUNTY, FLORIDA, AUTH-
ORIZING A PRO RATA SHARE OF GENERAL FUND EX-
PENSES BE BORNE BY THE WATER FUND FOR THE FIS-
CAL YEAR COMMENCING ON OCTOBER 1, 1972 AND TER-
MINATING ON SEPTEMBER 30, 1973.
WHEREAS, in lieu of there being any WATER DEPARTMENT personnel,
the Administration, functioning within the General Fund, performs
all necessary services relating to:
1. Determining Water Consumption of individual properties through
the process of Meter Readings;
2. Billing of Water Charges;
3. Collection of said Charges; and
4. Proper accounting of all funds accumulating to the Water Fund:
NOW, THEREFORE, BE IT RESOLVED, that the following amounts
shall be paid by the "Water Fund" to the "General Fund" for the
Fiscal Year commencing October 1, 1972 and ending on September
30, 1973.
Share of General & Administrative expenses - - - $ 61400.00

You requested my opinion as to the interpretation of Chapter
72 -306, Florida Statutes, regarding the levy of the Occupational
License Tax.
As you will note, under 205.042 the three categories of persons
subject to the tax are set out. The same are recited in the Town of
Gulf Stream's ordinance. It appears that the revenue the town will
receive under subparagraphs 1 and 2 will be very little since there
are very few, if any, businesses or occupations located within the
Town's municipal boundaries. However, it is my opinion that under
subparagraph 3 the Town is entitled to levy the occupational tax
just as it has in the past, at least as to persons engaged in inter-
state commerce, and I would recommend that billing thereunder continue
until the legislature or the courts provide a conflicting opinion.
Any person who transacts a business or profession within the Town and
is engaged in interstate commerce is subject to the tax. If anyone
objects to the tax the burden will be on them to prove that they are
not engaged in interstate commerce and thus not subject to the tax
under 205.042 (3).

APPLICATION FOR BUILDING PERMIT
September 7, 1972
TO: TOWN OF GULF STREAM
In accordance with the report of the Town of Gulf Stream
Planning Committee Meeting of July 18, 1972; St. Andrews Cor-
poration is herewith submitting a formal application for a
permit to construct tennis courts on property owned or to be
owned by it, within the Town of Gulf Stream, as shown by the
drawing dated August 15, 1972, attached to this application
and made a part hereof by reference.
St. Andrews Corporation represents that any construction
on the property will be substantially in accordance with the
above - mentioned drawings entitled "Proposed Plans" and dated
August 15, 1972, and further represents that these proposed
plans will be the final plans used in construction on the pro-
perty if this application for Building Permit is approved.
St. Andrews Corporation stipulates that no flood lights
will be installed on the property covered by this application,
and this exclusion of flood lights is further noted on the
attached drawing.

Tennis Court Drainage
Dear Mr. Worthing:
In accordance with the instructions of St. Andrews, we here
describe the intended method of tennis area drainage and hope
it meets with your approval.
As the enclosed sketch indicates, the courts themselves are
expected to drain into the grassed soakage areas east and
south of the courts - a special underground tile drainage
field will pick up the diversion of water draining from the
west court.
Please note the retaining walls are planned to extend above
court grade forming a curb and prevent the court water from
flowing into adjoining properties or private road.
Water from the parking strip, however, is intended to drain to
the low point of the private road and the new St. Andrews
access road. Here a catch basin is to be built which in turn
drains via a conduit to the lake and thence can be pumped, if
necessary, to the waterway.

Gentlemen:
In regard to proposed tennis courts to be built by the Saint Andrews Club and /or
developers, we as owners of Apartment No. 12 would have no objections to these
tennis courts if the Town of Gulf Stream will restrict the tennis courts as follows:
1 .) Tennis courts must be restricted to a location at least c/ �ro/yfloZUZt
60 feet from their west property line running north
and south and adjacent to Hillside House property.' // d
2.) Adequate drainage for the courts should be installed
so that water does not drain off on Hillside House
property. This could be a major problem to Hillside
House owners (12 owners).
3.) Adequate high (6 ft.) hedging should be placed
along their west property line running north and
south.
4.) The tennis courts should be restricted to day time
use only, and definitely from ever installing lights
for night tennis. We, also, feel that noise during
the hours prior to 9:00 a.m. could be disturbing to
older residents of Hillside House.
