AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, PROVIDING FOR THE VILLAGE TO on OUT OF
AND EXEMPT ITSELF FROM THE REQUIREMENTS OF
SECTION 2-11.1(T) OF THE MIAMI-DADE COUNTY CODE
CONCERNING CONE OF SILENCE REQUIREMENTS
RELATED TO PURCHASING TRANSACTIONS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR INCLUSION IN
CODE; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Miami -Dade County, Florida, has
recently adopted an amendment to Section 2-11.1(t) of the Miami -Dade County Code (the "County
Code"), so as to remove any question of municipal autonomy in purchasing transactions, and to
enable municipalities to opt out of and exempt themselves from the requirements of Section 2-11.1(t)
"Cone of Silence" of the County Code; and
WHEREAS, the Village Council finds that any necessary restrictions upon bidder or
proposer communications with the Village during the competitive bidding or proposal process
related to purchasing transactions may be provided by municipal ordinance or by simply including
appropriate provisions within the specifications for the purchasing transaction, rather than being
mandated by a County ordinance which is not tailored to meet local concerns and procedures.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA:
Section 1. Recitals Adopted. Each of the above recitals is hereby confirmed and
adopted.
Section 2. Opt Out Invoked. It is hereby provided that the provisions of Section 2-
11.1(t) "Cone of Silence," of the Miami -Dade County Code shall not apply to the Village of Key
Biscayne. This Ordinance shall prevail over any conflicting Village Ordinance.
Section 3. Severability. That the provisions of this Ordinance are declared to be
severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held
to invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Village Council, and it is
hereby ordained that the provisions of this Ordinance shall become and made a part of the Code of
the Village of Key Biscayne; that the sections of this Ordinance may be renumbered or relettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 5. Notification. That the Village Clerk shall provide a copy of this Ordinance
to the Miami -Dade County Ethics Commission.
Section 6. Effective Date. This Ordinance shall be effective immediately upon adoption
on second reading.

Notice is hereby given that the following ordinances will be considered
on Second Reading by the Village Council of the Village of Key Biscayne
at a meeting to be held on Tuesday, November 27, 2001 at 7:00 p.m., in
the Council Chamber, located at 85 West McIntyre Street, Second Floor,
Key Biscayne, Florida: • .

AN ART -IN -PUBLIC -PLACES PROGRAM, CREATING AN
ART -IN -PUBLIC -PLACES BOARD; PROVIDING FOR SEVER -
ABILITY; PROVIDING FOR INCLUSION IN CODE; PROVID-
ING FOR AN EFFECTIVE DATE.
The proposed Ordinances may be inspected by the public at the Office
of the Village Clerk. Interested parties may appear at the Public Hearing
and be heard with respect to the proposed Ordinance. Any person wish-
ing to address the Village Council on any item at this Public Hearing is
asked to register with the Village Clerk prior to that item being heard.
In accordance with the Americans With Disabilities Act of 1990, all per-
sons who are disabled and who need special accommodations to,partici-
pate in this proceeding because of that disability should contact the Office
