III Regional Open c ice MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-01-104 Meeting 01-20 September 12, 2001 AGENDA ITEM 1 AGENDA ITEM Authorize the President of the Board of Directors to Execute the Cooperative Agreement for the Assessment of Natural Resource Damages Arising From the Release of Mercury to the Guadalupe River Watershed GENERAL COUNSEL'S RECOMMENDATION Authorize the President of the Board of Directors to execute the Cooperative Agreement for the Assessment of Natural Resource Damages Arising From the Release of Mercury to the Guadalupe River Watershed by and between the County of Santa Clara, the Santa Clara Valley Water District, the City of San Jose, the Midpeninsula Regional Open Space District, Myers Industries, Inc., the Guadalupe Rubbish Disposal Company, Inc., the United States Department of the Interior, and the State of California, Department of Fish and Game. DISCUSSION As you are aware, for the past year several public and private entities have been meeting to discuss potential mercury contamination issues in the Guadalupe River Watershed in Santa Clara County(see Report No. R-01-95 dated August 8, 2001). In March 2001, the District was informed that it was also considered a Potentially Responsible Party for possible damage to natural resources arising from mercury contamination in the watershed. The primary source of concern is in areas where the mining and processing of cinnabar ore historically occurred. The District owns several thousand acres within the Watershed, including the 1,465 acre former Rancho de Guadalupe acquired in 1995. A small portion of this parcel, lying just south of Guadalupe Creek, was apparently the site of some of the mining activities of the Guadalupe Mine operations. Although the District did not own any of the land when mining activities were taking place, the Comprehensive Environmental Response and Liability Act(CERCLA) imposes strict liability upon landowners, regardless of fault, as well as on the actual operators. Several other public entities and private companies were already well engaged in negotiations with the United States and State of California, acting as Trustees of the potentially damaged resources, for a cooperative approach for the resolution of the mercury issue. In May, you authorized the General Counsel to execute the Tolling Agreement, a predicate to inclusion in the cooperative effort. Nitz •General Manager:L.Craig Britton R-01-104 Page 2 At your August 2001 meeting, you authorized the retention of Thomas Trapp of Barg, Coffin, Lewis, and Trapp as outside legal counsel and Locus Technologies as technical consultants to assist staff in the various matters connected to the District's ownership and acquisition of properties within the Guadalupe River Watershed. The Cooperative Agreement, largely as drafted by the Responsible Parties, was accepted by the Trustees and a final version of the document has now been approved by their authorized officials. Counsel for the individual Responsible Parties, both public and private, are now obtaining their respective clients' signatures. The Cooperative Agreement is designed to allow the Responsible Parties and the Trustees to meet and share data with the intention of arriving at some common technical assumptions, reasonable damage parameters and agreements with regard to available data and further collection needs. The technical consultants will meet within 30 days of execution of the Agreement by all parties followed by a tightly orchestrated series of deadlines for reaching consensus on methodology for analyzing and calculating the natural resource damage assessment number, the"debit" side of such a calculation. If an agreement on the"debit" is reached, a similar process of technical meetings will commence to identify projects for the"credit" side resource damage assessment. The goal of all the participants in drafting and signing this Cooperative Agreement is reflected in its title: Cooperative Agreement for the Assessment of Natural Resource Damages Arising From the Release of Mercury to the Guadalupe River Watershed by and between the County of Santa Clara, the Santa Clara Valley Water District, the City of San Jose, the Midpeninsula Regional Open Space District, Myers Industries, Inc., and the Guadalupe Rubbish Disposal Company, Inc., and the United States Department of the Interior and the State of California, Department of Fish and Game. The parties view this as a cooperative effort to work together to assess and, if necessary, remediate any mercury contamination problems in the Watershed. It is hoped that through such a cooperative effort, the resolution of any mercury contamination issues in the watershed will be expedited. Special Counsel, Tom Trapp, and General Counsel, Susan Schectman, have thoroughly reviewed the attached Cooperative Agreement and concur that it is in the best interests of the District to authorize the President of the Board of Directors to execute it and for the District, its counsel, and technical consultants to continue participating in the cooperative process. DISCUSSION At your July 25, 2001 meeting (see Report R-01-88), you tentatively approved the following Use and Management Plan recommendations to: • Change the allowed uses on the Betsy Crowder Trail (formerly known as Sausal Trail) to permit access by hikers, equestrians, and leashed dogs, but not bicycles. • Install an observation area and close the perimeter around Sausal Pond to public use for resource protection. • Realign and make a minor expansion (a net increase of 80 linear feet of trail) to the existing unpaved trail and road network. • Adopt the name"Sequoias Trail" for a 0.2-mile trail that connects to the Town of Portola Valley trail, and formally designate the allowed uses to be hikers, equestrians, and leashed dogs, but not bicycles. Discussion at the Board level from the July 25 meeting is summarized below, with staff responses: Discussion item l: A number of Board members expressed a desire for clarification as to whether the uses proposed for the District's segment of the Sequoias Trail will conflict with the uses currently allowed on the Town's portion of the same trail. Response: Staff has reviewed the on-site signing indicating the permitted uses on the Town of Portola Valley Sequoias Trail and has confirmed that the uses for both segments of the Sequoias Trail will be consistent. The Town trail allows hiking, equestrian use, dog access, but no bicycles. The Board discussed a number of options for the segment other than the recommendation of the Use and Management Committee, including leaving the"Road to Restore" open subject to seasonal closures to minimize the wet season impacts to the trail surface. Response: Staff has observed two major problems related to the circulation network in the southeast corner of the preserve: 1. The steep turn at the lower reach of Spring Ridge Trail is difficult in the winter for patrol vehicles and visitors because of muddy soils. 2. The"Road to Restore" section passes a seasonal sag pond formed by the San Andreas Fault, leading to maintenance problems and intruding on resource values. • Sag ponds are uncommon topographic depressions associated with active faults that provide a seasonal source of standing water. The current road is located within a few feet of the sag pond, intruding on this rare and valuable ecological resource and constraining its potential as a wildlife habitat. • The road is seasonally impassable to patrol vehicles and presents a precarious and muddy experience for visitors. Drainage improvements could be installed on the road, but because of the fault geology, would present an ongoing maintenance challenge. The proposed 540-foot"Road Reroute" segment is intended to address these problems, while maintaining the generalized circulation pattern between Portola and Alpine Road preserve entrances. The proposed reroute would gradually climb at a maximum 10%grade(the District standard)up approximately 50 vertical feet through chaparral and oak woodlands to connect with the Kabcenell driveway. Tree removal would be minimal. If the"Road to Restore" trail connection were to be kept seasonally open and the"Road Reroute" segment constructed, then three parallel routes would exist within approximately 100 feet of each other, leading to the same general destination within the preserve. Such high trail density situations are undesirable due to the reduced natural trail experience and increased resource impacts. If the"Road to Restore" trail connection were to be kept seasonally open and the"Road Reroute" segment not constructed, then the vehicular connection between Portola Road and Alpine Road would not be available during the wet season, eliminating the highly desirable patrol through access. The seasonal closure would also prohibit wet-season use by equestrians and bicyclists, requiring less convenient, alternative detour routes. The seasonal closure of a critical link within the preserve may be difficult to enforce. Staff believes that the tentatively-approved"Road Reroute" realignment offers the best solution to the existing circulation problems because it effectively balances concerns over excessive trail density, natural resources, and maintenance costs. R-01-105 Page 3 Comment Received Since the meeting, staff has received no further public comment on this matter. Implementation Upon final approval of the Use and Management Plan Amendment, staff will initiate the replacement of signs and modification of the Windy Hill Open Space Preserve brochure to show the Board approved uses. Implementation of the resource protection measures for Sausal Pond will begin. Staff will work with the Town of Portola Valley to determine whether a Site Development Permit is needed to construct the observation area and trail realignments. Dependent on the permitting requirements, construction may extend into fiscal year 2002-2003. CEQA COMPLIANCE At your July 25, 2001 meeting, you approved the Mitigated Negative Declaration and Mitigation Monitoring Program, and adopted findings stating that the Use and Management Plan Amendment avoids or YP negative an mitigates potential environmental effect to a point that clearly g no significant effect on the environment would occur under the California Environmental Quality Act (CEQA). On July 26, 2001 staff filed a Notice of Determination with the San Mateo County Clerk reiterating these findings. PUBLIC NOTIFICATION i A notice of this meeting and your intention to adopt the recommended Use and Management Plan Amendment was mailed to property owners within a 300-foot radius of the Preserve. At the same time, this notice was mailed to other parties who have previously identified themselves as generally interested in Windy Hill Open Space Preserve, dog use issues, and equestrian use issues. This notice has been posted on-site and on the District web page. Approve the concept of a District preserve and trail guide book, as outlined in the attached Request for Proposals. 2. Authorize District staff to contract with Mr. Barry Spitz to perform research, writing, and draft revision services to author the District's book in an amount not to exceed $40,000. DISCUSSION This summer, under direction of the Board's Legislative, Finance, and Public Affairs Committee(LFPAC), staff sought and obtained proposals for authorship of a District book, to be produced in time for celebration of the District's 30'h anniversary in November 2002 (see attached Request for Proposals). The book would provide for the public an authoritative and comprehensive source of information regarding District preserves and trails, natural resources, land management, and public programs. It would also provide a more personalized view, than does a brochure, regarding what District staff and supportive volunteers do to acquire, preserve, and restore lands and to educate community members about the overall importance of open space conservation and management. We envision a book describing the natural and some cultural history features of the District's preserves, including maps of preserves, narratives of specific trail and special "loop" descriptions, and key points of interest. The book would also include a foreword describing the formation and history of the District, as well as feature boxes containing information about various District programs (for example, resource management or volunteer programs). In response to the RFP, the District received several proposals from qualified and experienced authors, representing a variety of subject expertise areas. Two authors demonstrated particularly relevant experience: one had produced several regional trail guide books, and the other had produced a trail and preserve book for Marin County Open Space District. This book, titled Open Spaces, is particularly similar in content and format to the book envisioned for the District. Nitz •Genera(Manager:L.Craig Britton R-01-108 Page 2 From September 2001 to July 2002, Mr. Spitz would hike and measure every mile of District trails, and familiarize himself with preserve features. He would also interview many staff members, volunteers, and Board members, both to obtain more District and preserve information, and to develop feature profiles of those who work with the District. He would rely upon his own knowledge of plants and wildlife, as well as the District's Natural Resources Database and other sources to develop detailed inventories of botanical and wildlife resources found across District lands. He would also use tapes, historical archives, and oral interviews to write about key points of cultural or historical interest for brief inclusion in the preserve chapters. He would be expected to work on a tight schedule to deliver drafts, revisions, and a final manuscript, in time for the book's production in late summer 2002. Staff is particularly impressed by Mr. Spitz' superlative references and his proposal to dedicate approximately 1,600 hours(that is full-time)focused attention to development of this book for the duration of the project. References corroborated his attention to detail, punctual delivery of very clean manuscripts, and knowledge of and sensitivity to open space issues. His products demonstrate a high-quality, artisanal approach to his work. Staff recommends that you approve the concept of the book project and authorize the General Manager to negotiate a contract with Mr. Spitz, not to exceed $40,000, for authorship of the District's preserve and trail guide, including possible responsibility for various production coordination services. The aforementioned approximately 1,600 hours of time will be spent on tasks such as trail surveys, research, interviews, preparing an outline, writing(to District specifications), submitting drafts and revisions, and production coordination work from September 2001 to summer 2002. No amount has been budgeted for this project and much of the authorship funds will be spent this fiscal year. The entire$40,000 amount needs to be budgeted from the New Lands Commitments category in the Acquisition Department budget for this unanticipated cost. Staff would then include in the budget for the forthcoming fiscal year a request for expenditures of an estimated $50,000 for all additional costs associated with production and distribution of approximately 4,000-6,000 copies of the District book, including cover and other graphic design, typesetting, and printing. Based upon the sales experience of Marin County Open Space District, which is currently printing the second edition of its highly successful Open Spaces, it is possible that the District book could, in a few years, "pay for itself." The Marin District expects to recoup its initial outlay of expenditures within a year or so, halfway into sales of its second edition. Staff recommends that you consider the public informational value of the book meritorious of a total outlay of approximately $90,000, at least half of which is conservatively estimated to be recovered through sales. Prepared by: Stephanie Jensen, Public Affairs Manager Contact person: Same as above Request for Proposals Authorship of Trail Users' Guide Book to the Midpeninsula Regional Open Space District Overview The Midpeninsula Regional Open Space District is seeking proposals from qualified authors to write a book about the District's formation, current operations, open space preserves, and low-intensity public recreational opportunities. Midpeninsula ReEional Open Space District The Open Space District is a public agency created in 1972, located in portions of San Mateo, Santa Clara, and Santa Cruz Counties. To date, the District has preserved over 46,500 acres of diverse open space land and manages 26 open space preserves. District lands provide permanently protected wildlife habitat, natural resources, watershed, and a variety of ecosystems. Twenty for of the District's reserves are now available for low- intensity Y Y P intensity recreational use by the public. The District's mission is "to acquire and preserve a regional greenbelt of open space lands in perpetuity; protect and restore the natural environment; and provide for ecologically sensitive public enjoyment and education." Funding is provided by a small share of the annual total property tax revenues collected within the Districts boundaries. i Protect Description and Specifications After an introduction(see below), the book should be organized by District regions. Each regional section will include chapters describing the features of each open space preserve within that region. Geological, ecological, and land use history or cultural features of interest will be included. In most cases, District staff members possess documents, oral history recordings, and other references. The District will provide associated preserve trail maps. The book's introductory section should include: * a foreword or introduction by the General Manager; * a brief history of the formation of the District; * a section describing the plant communities found on District lands and the species of flora and fauna generally found within each type of plant community(District staff can provide excellent resources from which the author can derive much of this information.) Then, within each preserve chapter, only the plant communities present there require mention; each species present need not be repeated. The book should also contain the following: * Descriptions of current District public programs and resource management projects; * Inclusion of some staff and volunteer profiles; * A select bibliography. 1 The book will be published, distributed, and advertised at District expense. However, the author may receive a number of books as partial compensation and will be encouraged to promote the book(and sell some of his/hers) at bookstore readings, signings, etc. Timeline The District's objective is to have the book printed and available for distribution by October 15, 2002. Given typesetting and printing time requirements, the final draft of the book should, therefore, be deliverable no later than June 1, 2002. The District expects to award a contract for authorship by August 31, 2001. Proposal Contents Proposals must include the following elements: • a cost estimate for the author's time, over approximately one year, to research, compile, draft, revise, and submit a completed written work of publishable quality; • brief outline of the author's vision of a book meeting the aforementioned MROSD goals; • author's general background and qualifications, especially scientific or ecological knowledge; • a short description of the author's specific experience in writing for book and other media publication, as relevant to a governmental agency and/or land conservation or environmental organization; • a copy of a published book primarily authored by the applicant, or jointly authored, or another significant published work and verifiable coordination experience with a publisher; • references from two or more clients, corroborating the author's timely delivery of work to the client's specifications; • author's statement of ability and interest in hiking open space preserve trails to optimally describe them. Evaluation Criteria Award will be made based upon the total cost to the District,related experience of the author, quality of the author's sample work, references, ability to work within the desired timeframe, completeness and timeliness of the author's proposal, and willingness of the author to abide by a contract to be offered by the District's General Manager with review by the District's Legal Counsel and approved by the elected Board of Directors. During the past eight years the District has gained recognition and greater appreciation, and as the region has enjoyed economical growth, donations have grown as well. The District is fortunate to receive between four to eight donations per month, most ranging in amounts of$50.00 to $1,000.00. While all gifts to the District are appreciated and acknowledged, the proposed amendment to the current gift policy would reflect the exceptional gratitude for those gifts greater than $1,000.00. The Legislative, Finance, Public Affairs Committee (LFPAC) has approved the revised schedule shown on the attached strike-out version of the policy (see Section H.A. When a property is acquired, either as an addition to an existing preserve or for the establishment of a new preserve, a name will be recommended in the Preliminary Use and Management Plan. In most cases, "open space preserve" is appropriate as part of the name; however, there may be circumstances when another designation may be used. In some cases, a temporary name may be retained until the next Comprehensive Use and Management Plan review. Memorial plaques that are not part of the District's standard informational signs shall be discouraged. Any Board approved memorial names may be included in site brochures, maps, or other informational materials. A. Open Space Preserves The name given to each open space preserve should be general enough to remain suitable if the site is enlarged, but specific enough to give its location some significance. Properties added to an open space preserve may not always be contiguous with that preserve. 1. DISCUSSION At your June 27, 2001 meeting you authorized staff to solicit competitive bids to purchase one dump truck(see Report R-01-14). After finalizing specifications, staff solicited competitive bids from truck dealers throughout the Bay Area. The District received the following bids(tax included): 1) Mission Valley Ford/San Jose $66,292.56 2) Monarch Truck Center/San Jose $66,158.64 3) Golden Gate Truck Center/Oakland* $65,588.40, $66,787.20, $67,677.12 * Three bids were received from Golden Gate, one for each different type of engine. Staff reviewed the bids and compared each truck's specifications to the District's bid specifications. Bids received from Golden Gate Truck Center were rejected because they failed to meet the specification requiring an authorized service dealer to be located within the area. Their closest location is in Oakland. The time and cost to take the truck to Oakland was determined to be unacceptable. Monarch Truck Center failed to meet one essential specification requiring that the truck be equipped with a locking differential. This option provides superior traction on unpaved roads. It is a critical specification because the vehicle will be driven regularly on unpaved roads. Mission Valley Ford of San Jose met all required specifications and was the lowest responsive bidder. The 2001-2002 fiscal year budget includes $90,000 for the purchase of a dump truck. Staff estimated the cost to be $90,000 based on budgetary quotations received from local truck dealers during the budget preparation process. DISCUSSION The"El Nino" winter storms of 1998 caused unprecedented levels of damage to District roads and trails, including two large washouts on Old Page Mill Road at Skyline Ridge Open Space Preserve, one of which claimed the entire road width. FEMA grants totaling $122,390 were awarded to the District for the repair of the damage. At your March 28, 2001 meeting, you authorized the General Manager to execute an agreement with Freyer& Laureta, Inc. of San Mateo for civil engineering services on road repairs on Old Page Mill Road, for a sum not to exceed $28,300 (see Report R-01-37). At your August 8, 2001 meeting, you authorized the General Manager to execute an agreement with Cotton Shires & Associates of Los Gatos to investigate the geologic and geotechnical conditions at Old Page Mill Road and to work with the civil engineer to prepare plans and specifications for the site's repairs, for a sum not to exceed $23,000 (see Report R-01-93). To date, a topographic survey has been completed and both firms have started working on conceptual repair approaches. One promising approach under consideration is to borrow fill material from the oversteepened banks adjacent the landslide damage areas, resulting in a dramatic cost savings compared to importing fill. Therefore, staff now recommends an PP increase in the authorization limit for Freyer&Laureta in the amount of$4,600 to cover additional survey work. It is also possible that other unforeseen work scope changes may arise prior to the completion of the project. In such instances, it benefits the District to be able to respond quickly, allowing the work to proceed smoothly rather than stopping to await resolution. For these reasons, staff also recommends that the Board authorize the General Manager to execute future consultant contract changes in the amount of$1,100 for Freyer&Laureta, and $2,000 for Cotton Shires. These contingency amounts will not be applied to the project unless additional work not included in the original scope of work is required. In summary, staff recommends that you authorize the General Manager to execute an amendment to the consultant services agreement up to the following not-to-exceed totals for the two engineering consultants: Freyer&Laureta Cotton Shires Initial Board-authorized amounts $28,300 $23,000 Contract amendments $4,600 $0 Contingency amounts $1,100 $2,000 Not-to-exceed totals $34,000 $25,000 The fiscal year 2001-2002 Planning budget includes $140,000 for the design and repair of the damage. The consultant scope of work includes refining the cost estimates for the construction of the planned repair work. While staff does observe that the consultant services portion of the work accounts for over 40%of the total allocated budget, it is also clear that further investigation of possible creative design approaches will allow the District to select the most cost-effective, environmentally sensitive method of repair. CEQA COMPLIANCE Staff concludes that amending these consultant agreements for engineering services does not constitute a project under California Environmental Quality Act(CEQA). Therefore, the recommended action is exempt. Any future action taken by the Board to implement the consultant's work, such as authorizing bidding for the landslide repairs, will be subject to CEQA review at that time. The three men - Michael More, 47, William McBride, 50, and Neal Daskal, 46 - were subsequently indicted by a federal grand jury in San Francisco on felony charges of conspiracy (18 USC 371) and causing injury to federal property (18 USC 1361) . More was also charged with unlawfully cutting trees on federal property (18 USC 1853) , a misdemeanor. More was a member of the Marin County open space and trails committee, but resigned the post on February 5th. According to the indictment, the defendants and others agreed to construct an illegal bicycle trail in the park in an area not open to 1 in down Construction of the illegal trail entailed cutting bicycles. g g trees and bushes cutting branches g destroying removing and destro in plants, and digging and moving soil. Rocks were gathered and stacked to create retaining walls and trees were cut and moved to create a "jump" area. The route was even marked with flagging. As part of a plea arrangement, the trio pled guilty on August lst to destruction of federal property, a class A misdemeanor. More also pled guilty to cutting the trees. The three were sentenced to pay $34,360.78 in restitution, perform a total of 800 hours of community service (supervised by the NPS) , and serve three years' probation. During the term of their probation, they are banned from entering any area administered by the National Park Service, except to fulfill their community service obligations. Each of the defendants also wrote a statement apologizing for his actions for publication. There are a number of cracks in the structure, and while we have no information or opinion as to whether it constitutes a danger, we realize that earthquakes have a way of `exploiting' even minor defects... (The area is heavily traveled by people of all ages during almost all of the daylight hours). Immediately adjacent the handball court,there is a specimen Bay Laurel tree,probably between three and four hundred years old, in apparently good health, and which was a landmark in days gone by. We understand that efforts are under way to assure its longevity by rerouting the 10+ foot wide trail/road farther away from the tree, since it now essentially bisects the area within its drip line, which could, of course, kill it. Removing the handball court would enable planners more latitude in protecting the tree... The handball court stands essentially idle. Having passed by and observed the court hundreds of times, you might be interested to know that we have, over the past twenty years or so, never seen it in use as a handball court! In fact, its only use has been, on about a dozen occasions, as a practice area for sole tennis players seeking to improve their serves (and the dimensions of the handball court are quite different than those of an actual tennis court, so.....) On balance, in our opinion,the old handball court is quite unbeautiful, has long outlived its usefulness, is at least a potential danger to Park/Preserve users, and as a (life- saving?) good turn to a venerable old tree (the largest of its kind in California?)we would urge upon you a decision to remove it !! Danielson. On 7/2 several gunshots were heard at 10:30 p.m. by L. Paterson. l July 5 Several months ago a witness reported a homicide victim had been dumped off Tunitas Creek Road. A search for a body was conducted by San Mateo County Sheriff's Office in Purisima Creek Redwoods OSP. On 7/19/01 the skeletal remains of a person were found near the initial search location. D. Danielson, W. Phillips, C. Barresi. July 5 Hikers on the Jones Trail in St. Joseph's Hill OSP found a man walking in a daze, who had numerous abrasions from one or more falls. K. Miller received the information from a Los Gatos ranger who as on scene. The man was transported back to the nursing home he had walked away from. July 6 A report was received of a discharge of fireworks, gunshots, and spotlights in Fremont Older OSP. K. Miller requested a deputy. K. Carlson, P. Hearin and K. Miller checked the access points and did not find anything. The deputy was canceled. July 15 On Sunday evening, Minna Sandmeyer was reported missing to District staff. On 7/16/01 patrol rangers checked roads and trails in the Skyline area. On 7/17/01 Santa Clara County Sheriff's Office and volunteers, who were friends of the missing woman, searched preserves that were known to be places Sandmeyer had frequented. Although a formal search by staff was not conducted after 7/17/0, they continued to be on the lookout. Her body was located in Foothills Park on Saturday 8/3/01, an apparent suicide. July 20 While doing a regular patrol check, D. Danielson discovered preparations for a large beer party at Black Mtn. backpack camp in Monte Bello OSP. Eighty to one hundred participants, mostly from a local high school, were expected. Lots of camping gear had been driven in to the site. One person who drove through the south gate was cited for illegal vehicle operation. Two kegs of beer were confiscated. Two minors were taken into custody by Palo Alto police. C. Barresi assisted. July 21 A one-gallon container of an unknown substance was found by B. Malone at Ravenswood OSP. He requested Menlo Fire to respond. The Fire Department determined it was transmission fluid and took care of waste disposal. July 23 K. Carlson observed a new encroachment at Bear Creek Redwoods OSP. A trail had been opened originating from nearby private property that allowed motorcycle access. T. Lausten assisted. The real property encroachment specialist was notified. July 27 San Mateo County Coroner's Office and Sheriff's Office investigated a report of skeletal remains at Purisima OSP. The remains were determined to be those of a deer. Television news media were present. District staff were not notified of the incident and confirmed it a week after the incident occurred. D. Danielson. However, I'd like to restate my support for the amendment tentatively approved on July 25. 1 am particularly interested in the arrangement of trails and patrol roads near the newly constructed driveway. My goal has been to maintain a safe and enjoyable experience for the public. Given the existence of the driveway, it is important to separate preserve visitors from driveway vehicular traffic as much as possible. The tentatively approved amendment provides a scenic mixed-used trail to attract preserve visitors away from the driveway, and it minimizes intersections between the trail and the driveway. The only portion of trail shared with the driveway is the short section between Alpine Road and Corte Madera Creek. I believe that this arrangement will avoid most corifficts.
