ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES ACROSS A TRACT OF
LAND RECORDED IN BOOK 546 PAGE 150.
WHEREAS, Ordinance 13811 (Bill No 2004-101) recorded in Book 513, Page 990,
purported to vacate this easement but contained an inexact title and
incorrect book and page causing the title company to request a clarifying
relinquishment; and
WHEREAS, by an easement recorded in Book 262, Page 479, of the Records of Cole
County, Missouri, a sewer easement was granted to the City of Jefferson, a
Municipal Corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of sewer in, under and
through the lots, tracts or parcels of land described in Section 1.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed for any public purpose:
Part of an existing 10 foot wide sanitary sewer easement recorded in Book
262, Page 479, Cole County Recorder's Office, and being situated in the
south half of Section 4, Township 44 North, Range 12 West, in the City of
Jefferson, Missouri, said 10 foot wide easement to be vacated being more
particularly described as follows:
From the southwesterly corner of Lot 8 of EL MERCADO INC.
SUBDIVISION, SECTION THREE, as per plat of record in Plat Book 11,
Page 770, Cole County Recorder's Office; thence S03 055'16"E, 210.00
feet; thence N85 007'05"E, 373.12 feet; thence N8601 1'57E, 432.99 feet;
thence NO3 043'31"W, 139.57 feet to the centerline of the existing 10 foot
wide easement as recorded in Book 262, Page 479, Cole County
Recorder's Office at Station 0+60.48 Private Sewer No. 384 and the POINT
OF BEGINNING for the centerline of this easement to be vacated; thence
N65 048'40"W, 344.43 feet to Sta. 4+04.91 Private Sewer No. 384 and the
POINT OF TERMINATION of this easement to be vacated.
Section 2. The easement described in Section 1 is hereby relinquished, and the
City does hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any
necessary legal document relinquishing all of the City's interest in the tract of ground
described in Section 1.
Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval. 7,
