1. The Meeting was called to order by Mayor Koch.
2. The Mayor referred to the Commission having been furnished, at
the regular meeting held on December 8, 1972, "COPIES" of the
Annual Audit of the Town's operation and financial structure for
its Fiscal Year ending September 30, 1972, and inquired if any
Commission Member had any questions relative thereto.
Mr. LaPorte inquired of the State Registered C.P.A. Accnunting
firm Himes & Himes district Manager, Mr. Dan W. Ward, if he ap-
proved of the "Audit ", as compiled by Himes & Himes local office.
Mr. Ward informed Mr. LaPorte and the Commission that he had re-
viewed the "Audit ", approved its contents, and the financial sta-
tus of the Town as a result thereof. Furthermore, Mr. Ward in-
formed the Commission that the Town is in a very sound and heal-
thy condition.
Mayor Koch asked Mr. Ward if the Town appeared to be complying
with the dictates of the Federal Government concerning its Rev-
enue Sharing Program, as well as the handling of any FUNDS re-
ceived by the Town and relating thereto. Mr. Ward stated that
he was not too familiar with the "Program" and its rules and reg-
ulations which, due to the "Program" still being in its infancy,
are somewhat vague and undoubtedly due for early clarification
and possibly revision. Mr. Ward felt that the Town of Gulf Stream
is in full compliance with the current regulations relating to
the processing of any monies received from the Federal Revenue
Sharing Program, particularly inasmuch as the Town Manager had
advised him of having deposited such funds in a Special Trust
Fund as is indicated the Guidelines set forth in the Government's
"31 Code of Federal Regulations - Subtitle B, Part 51 (Federal
Assistance to State and Local Governments) ".
In view of this "Audit" being approved by HIMES & HIMES District
Manager, Mr. Dan Ward, and on motion by Mr. LaPorte, duly second-
ed by Mr. Walker, the Commission unanimously accepted this "AUDIT"
copies of which are on file in the Town Hall and may be reviewed
by any interested parties.

3. On motion by Mr. Walker and seconded by Mr. LaPorte, the Commis-
sion unanimously approved the 'Minutes' fnr the regular Meeting
held on December 8, 1972.
4, The Financial Report for the Month of DECEMBER was accepted as
submitted.
5. The following "SUMMARY" of Police Reports for the Month of Decem-
ber was presented to the Commission:

During the Month, a B&E occurred at 520 Middle Road on Dec. 10th;
on Dec. 12th an attempted B&E occurred at 3232 Gulf Stream Road,
the local officers were assisted by the Delray Beach Police De-
partment and the Sheriff's helicopter division and its powerful
flood lights resulting in the arrest of one, the identification
of the other participant, and knowledge gained that these two in-
dividuals were responsible for the first "Break In" noted above.
6. Plans for a proposed DRAINAGE IMPROVEMENT project, as previously
requested by the Commission, involving a portion of Banyan Road
lying between Gulf Stream Road and Oleander Way; that portion of
Oleander Way extending approximately 105 feet northerly from said
Banyan Road; and that part of Gulf Stream Road beginning at a point
230 feet south of Banyan Road and extending approximately 360 feet
northerly from Banyan Road, were submitted to the Commission.
These "Plans ", copy of which is on file in the Town Hall, have
been prepared by the Town's Consulting Engineer and Surveyor Mr.
Walter A. Cornnell, further provide for re- surfacing of the roads
involved. Cost of this proposed improvement project is ESTI14ATED
to be $25,000.
Following general discussion relating thereto, Mayor Koch requested
the Consulting Engineer, Mr. Cornnell, to come forward and indicate,
on the plans, and elaborate thereon, for the benefit of nearly all
owners of the properties abutting on the "Areas" affected by such
an improvement, who happen to be present at this meeting.
At the conclusion of these preliminary discussions and explanations,
the Commission, on motion by Mr. Walker, seconded by Mr. Whittemore,
unanimously agreed that the Commission would hold a PUBLIC HEARING,
concerning such improvement project, on Monday, January 22nd, at
9:00 A.M., in the Town Hall, for the purpose of hearing objections,
if any, and consideration for possible sharing of the total cost
thereof.

7. Due to recent changes in the status of some Commission Members,
and necessity for up- dating certain legal requirements, the fol-
lowing Resolution was presented for Commission consideration:
RESOLUTION NO. 1 -73.
A RESOLUTION OF THE TOWN COMMISSION FOR THE TOWN
OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, PRO-
VIDING FOR AUTHORIZED SIGNATURES CONCERNING THE
"WATER FUND "; ASSET REPLACEMENT FUND; AND FEDERAL
REVENUE SHARING FUND ACCOUNTS AT FIRST NATIONAL
BANK OF DELRAY BEACH, FLORIDA.
On motion by Mr. Walker, seconded by Mr. LaPorte, the Commission
unanimously approved PASSAGE and ADOPTION of Resolution No. 1 -73
on this first and final reading.
8. The Commission was then informed that, due to the recent comple-
tion of the RECONSTRUCTION and PAVING of that portion of Polo Dr.
lying between Banyan Road and old School Road; also those portions ,
of Banyan Road extending a distance of 200 feet both easterly and
westerly from the centerline of said Polo Drive, an ASSESSMENT ROLL
has been prepared in accordance with previously established basis
for the Town of Gulf Stream and the owners of the properties abut-
ting on said portions of the Streets identified herein sharing the
total cost thereof. Accordingly, the following RESOLUTION is sub-
mitted for Commission consideration:
RESOLUTION NO. 2 -73.
A RESOLUTION OF THE TOWN COMMISSION FOR THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLO-
RIDA, PROVIDING FOR PRORATION OF ASSESSMENT
COSTS FOR RECONSTRUCTION AND PAVING OF THAT
PART OF POLO DRIVE LYING BETWEEN BANYAN AND
OLD SCHOOL ROADS; ALSO THAT PART OF BANYAN
ROAD EXTENDING 200 FEET EASTERLY AND 200 FT
WESTERLY FROM THE CENTERLINE OF SAID POLO DRIVE.
Resolution No. 2 -73, attached to which and forming a part thereof,
is the "ASSESSMENT ROLL" referred to hereinabove, was read in full,
and provides, in part, for the Commission to sit in the Town Hall,
in Gulf Stream, at 9:00 o'clock A.M., on Friday, February 91 1973,
for the purpose of hearing objections, if any, to said "ASSESSMENT
ROLL".
On motion by Mr. Whittemore, seconded by Mr. Walker, the Commission
unanimously approved PASSAGE and ADOPTION of Resolution No. 2 -73.
91 The Commission was informed that the "Petition" from the Gulf Stream
School Foundation, requesting a "Special Exception" to allow certain
Permissive Use of a Tract of Land lying between the School's present
Playground Area and Gulf Stream Road; adjacent to and northerly from
the School's private driveway, has been withdrawn.

10. The "Offer" of Mrs. Rosemary W. Austin, through the offices of
Walton Lantaff Schroeder Carson & Wahl, of Miami, to donate the
NORTH COVE, as shown on the Plat of Gulfstream Cove, as recorded
in Plat Book 24, Page 185, Public Records of Palm Beach County,
Florida, was again submitted to the Commission.
The Mayor, being assured that such procedure is just and proper,
by the Town's legal Counsel - Att'y. John C. Randolph, felt that
such acquisition would be in the best interests of the Town.

11. The "Petition" from each of the following: Gulf Stream Golf Club,
the Little Club, and the Bath & Tennis Club, requesting the Town
Commission to provide for RE- CLASSIFICATION of their respective
properties from the current Residential District to a Recreation-
al Zoning, or some category relating thereto, was again brought
to the attention of the Commission.

This matter was referred to the Planning Board by the Commission
at its last regular meeting and Mayor Koch inquired from Mr. L. M.
Ball, the Board's Chairman, as to what progress had been made.
Mr. Ball informed the Commission that the issue had not yet been
resolved, however, the Planning Board is scheduling a workshop
session for the week commencing January 15th at which time it is
expected that the necessary proposed ordinances to accomplish a
re- classification of the lands involved will have been prepared
by Attorneys Patrick C. Coughlan and John C. Randolph, and will
be submitted, together with the Planning Board's recommendation,
to the Town Commission for its consideration thereof at the next
regular Commission meeting or at any Special Meeting, prior there-
to, which may be scheduled.
The Town Manager requested Commission approval for Administration's
issuance of TWO Building Permits:
ONE being for construction of a NEW HOME on Canary Walk,
in Place Au Soleil Subdivision; the OTHER being for a
GARAGE on the Little Club property.
On motion by Mr. LaPorte, seconded by Mr. Walker, the Commission
unanimously approved the granting of this request SUBJECT to it
being understood and agreed that NO PERMIT, for either of these
two items, shall be issued prior to the Administration being fur-
nished, in writing, from ALL property owners whose lands are abut-
ting those properties described above, that they have NO OBJECTION
to such construction at this time.

SCHEDULE A
A parcel of land in Section 3, Township 46 South, Range 43
East and Section 34, Township 45 South, Range 43 East, more
particularly described as follows:
Beginning at a point in the Easterly Right -of -Way line of
the Intracoastal Waterway according to the plat of said Right -of
Way recorded in Plat Book 17, Page 14 -A, Public Records of Palm
Beach County, 525 feet Northerly of, measured along said Easterly
Right -of -Way line, the Northwest corner of Lot 11, Block 3, as
shown on' lat 1, Polo Fields, recorded in Plat Book 26, Page 13,-
Public Records of Palm Beach County; thence Northerly along said
Easterly Right -of -Way line, a distance of 70.72 feet, more or less,
to a point in the South line of Section 34; thence continue North-
erly, making an angle to the East, a distance of 11051, more or
less, along the Easterly Right -of -Way line of the Intracoastal
Waterway, according to the plat of said Rightt -of -Way recorded in
Plat Book 17, Page 13 -B, to a point in a line parallel to, and
248.24 feet Southerly of, measured at right angles to,.the North
line of Lot 17, Benson Bros. Subdivision, according to the plat
.thereof recorded in Plat Book 5, Paa_e 27, Public Records of Palm

An inspection was made November 16th of the curb on the
C west side of Polo Drive between Old School Road and Banyan Road.
This curb was to be removed in accord with the original plan
because the pavement was to be widened. The curb has been taken
out and laid on the side of the road within the right -of -way.
Since the grass slopes down to meet the pavement except for that
portion North of the Driveway at Lot 7, Block 3 of Polo Feilds
Subdivision. North of the driveway the grass is 6 inches above
the pavement and the curb would serve to hold the grass and
earth off the pavement.
By way of summary we would recommend that the curb be placed
back by the contractor North of the Drive to Lot 7 only and the
contractor should remove the curb at Lot 6 unless the adjacent
owner wants it reinstalled at his expense.

It is requested that a small amount of ruble,
resulting from said project, and left lying on the vacant
land at the northwest corner of Banyan Rd. and Polo Drive,
namely Lot 5, Block 3, POLO FIELDS SID, be removed without
further delay, in compliance with Section 7, GENERAL REPAIR,
of the "SPECIFICATIONS ", forming a part of the original CON-
TRACT DOCUMENTS, as specifically set forth in Item 5, sub-
paragraph "A" thereof, on Page 1 -4, identified as "CLEAN UP
SITE AT COMPLETION OF WORK ".
Provision for such "Clean -up work" upon com-
pletion of the Project is further contained in sub - paragraph
H. sub- section 4 of SECTION "C ", Page C -6 of said Contract
Documents.
Mrs. John L. Blair, owner of the parcel of land
described hereinabove desires to landscape and beautify said
